The Contractor shall be accountable for any damage to Government property, resulting from errors made by the Contractor, his personnel or subcontractors. The Contractor shall be liable for all repairs, parts, and other associated costs to correct such errors.

B.7 ACCEPTABLE LEVEL OF MAINTENANCE

The UPS Systems and associated systems shall be maintained at an acceptable level throughout the contract performance period. An "acceptable level" of maintenance and repair is defined as the level of maintenance which will preserve the equipment in unimpaired operating condition; i.e., above the point where deterioration will begin, thereby diminishing the normal life expectancy of the equipment. The Contractor shall be responsible for performing scheduled and unscheduled maintenance and repairs, as necessary, on a twenty four (24) hour per day and seven (7) day per week basis to keep the total system in a ready state of operation, to assure that it remains in operation and performs as required.

This approval will normally be through the COR who will contact the computer room personnel. The units will normally be placed in by-pass to prevent the need for a shut down.

(b) Advance Shutdown Approval

The Contractor shall schedule shutdown of a utility and/or UPS equipment at least 168 hours

Government may, by contract or otherwise, perform the services or initiate necessary default procedures against the Contractor.

B.12 OPERATIONAL TRAINING

The Contractor shall provide training to NITC federal employees and contract employees

(maximum of 8 personnel at each location, up to 2 times per year) on the operation of the UPS system. Should another contractor install new equipment, then that contractor is responsible to provide training on the new equipment. Should the installing Contractor (new equipment) fail to provide training (as determined by the Contracting Officer (CO) or COR, then training becomes the responsibility of the UPS Contractor.

B.13 TRAINING ATTENDANCE AND MATERIALS

The Contractor shall ensure that their own employees and/or subcontractors attend the appropriate training for their functions. Training materials and equipment information (manuals, etc.) on the system shall be furnished by the Contractor.

If the system must be moved outside the Contractor's designated service area, then the continued applicability of this contract shall be subject to mutual agreement.

The Government shall, normally, give at least 60 days written notice to the Contractor of its intention to move the equipment, except in emergencies. In the case of an emergency move, the contractor will be reimbursed for any additional costs directly attributable to the short notice and/or expedited move.

Maintenance charges shall be suspended on the day the dismantling of the equipment begins, in preparation for shipment.

Maintenance charges shall be reinstated on the day the Contractor completes reassembly. The

Government shall be charged for disassembly and reassembly, at the Contractor's current standard rate, provided that the Contractor charges his commercial customers for such services.
