FAR 52.212-1 -- INSTRUCTIONS TO OFFERORS -- COMMERCIAL ITEMS (APR 2014)

FAR 52.212-2 -- EVALUATION -- COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Refer to “Table of Evaluation Factors” on Pages 138-139.

Acceptable Technical and Past Performance firms will have prices evaluated.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.216-1 TYPE OF CONTRACT (APR 1984)

The Government contemplates award of an Indefinite Delivery-Indefinite Quantity contract resulting from this solicitation.

52.216-27 SINGLE OR MULTIPLE AWARDS (OCT 1995)

The Government intends to award multiple task order contracts for the same or similar services to no more than five (5) sources under this solicitation.

L/M.2 GENERAL INSTRUCTIONS-PROPOSAL INSTRUCTIONS

(a) General: Offerors shall submit a written proposal as described in this solicitation. The proposal shall be presented in a clear and logical manner. Any narrations shall clearly convey specific details of the planned approach sufficient to describe how the offeror plans to meet the requirements of the proposed contract. Offerors are cautioned that statements such as “will comply”, “will meet the intent of”, or other such paraphrasing will not be acceptable. The technical portion of the proposal shall contain sufficient information to enable the evaluators to make a complete analysis of the proposal.

(b) Discrepancies: If an offeror believes the requirements in this solicitation contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the Contracting Officer (CO) in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on initial proposals, as received, without discussions.

(c) Source Selection Evaluation Process: The source selection process will be a 2-Phase process utilizing the Lowest Price Technically Acceptable Source Selection process identified in FAR Part 15.101-2.

Phase I: This phase of the solicitation will consist of issuing the solicitation documents for the IDIQ contract, the Technical Information offerors are required to submit as identified in the Table of Evaluation Factors, Contractor Submittals, and Pricing. The Government will conduct an evaluation for determining offerors either Technically Acceptable or Technically Unacceptable. Offerors determined as Technically Acceptable will be allowed to continue to Phase II. Firms determined to be Technically Unacceptable will be promptly notified.

Phase II: Price proposals for offerors determined Technically Acceptable will be evaluated for the initial Task Order(s) identified in Section J of this solicitation. The Government will award the IDIQ contract to no more than five (5) of the Technically Acceptable firms with the lowest acceptable evaluated prices. The firm(s) with the lowest prices will be awarded the initial Task Order(s). The Government reserves the right to award orders to other than the lowest offeror (multiple awards) in order to meet minimum guarantees.

(d) Source Selection Evaluation Team (SSET): The SSET will evaluate the technical proposals.

Criteria for the technical evaluation of the contractor’s performance capabilities are set forth in the Table of Evaluation Factors, Contractor Submittals, and Evaluation Process and will be the sole basis for determining the technical acceptability of offerors. The technical evaluation will be an objective evaluation of the Offeror's proposal.

(e) The Written Offer. Submittal envelopes/packages shall be clearly marked with the solicitation number. Proposals must be received not later than the date and time specified in the solicitation.

AG-05M6-S-13-0038 Project: MBS Road Maintenance MATOC Page 133 of 147

Technical information includes: Similar Past Performance (Prime) to include associated questionnaires, Key Personnel (Project Manager – Prime). Past Performance information is obtained for evaluation purposes only.

Information submitted that was not requested, as part of this solicitation will not be evaluated.

Offers shall be submitted on 8 ½” by 11” sheets of paper. Pages may be printed front to back.

Type shall be 12-point font. Text shall be spaced a minimum of 1 ½ spaces or not to exceed 35 lines per page and 100 characters per line. Use of bold face type for paragraph headings is acceptable. Each page of each copy should be marked with the following text:

“Source Selection Information”

NOTE: Offerors are cautioned to submit sufficient information to enable the evaluator(s) to fully ascertain the Offeror’s capability to perform the requirements of the solicitation.

Volume 2: An original and complete copy of proposals for Blanket Task Orders (BTOs) must be submitted. Offerors are cautioned to review all sections carefully and complete the necessary fill-ins and certifications. BTO documents to submit include the Standard Form 1449 and the Section B – Schedule of Items for at least one of the following BTOs:

Attachment 3 – BTO #1, AG-05M6-S-13-0043 (North Bend) Attachment 4 – BTO #2, AG-05M6-S-13-0044 (Enumclaw) Attachment 5 – BTO #3, AG-05M6-S-13-0045 (Skykomish) Attachment 6 – BTO #4, AG-05M6-S-14-0025 (Mt. Baker) Attachment 7 – BTO #5, AG-05M6-S-14-0026 (Darrington)

(f) Evaluation: Offers will be evaluated using the criteria listed in the Table of Evaluation Factors, Contractor Submittals, and Evaluation Process. Noncompliance with the RFP requirements may raise serious questions regarding an offeror’s technical and/or price performance and may be grounds to eliminate the proposal from consideration for contract award. Completion and submission of an offer (proposal) will indicate the offeror’s unconditional consent to the terms and conditions in this RFP, including all amendments.

i. General: The Government intends to evaluate proposals and make award without discussions. However, during the evaluation period the Government may determine that it is necessary to conduct discussions. In that case, the Contracting Officer will establish a competitive range and conduct discussions with the firms in that range. Award of an IDIQ contract will be made to the offeror(s) whose offer provides the greatest overall value to the Government based on Technical and Price evaluations. Award may or may not be made to the proposal with the lowest proposed price.

ii. Responsibility Determination: Award shall not be made to any offeror failing to be determined responsible in accordance with FAR 9.104. As part of this determination, all contractors must have adequate financial resources to perform the contract or ability to obtain them.

AG-05M6-S-13-0038 Project: MBS Road Maintenance MATOC Page 134 of 147

iii. Phase I – Technical Proposal: Offeror’s are cautioned to submit sufficient information to enable the evaluator to ascertain fully the offeror’s capability to perform the requirements of the solicitation. The data submitted with each proposal shall be complete, concise, and conform to the requirements set forth in paragraph (e), the written offer, Volume 1 of this section, and the Table of Evaluation Factors, Contractor Submittals, and Evaluation Process.

iv. Phase II – Price Proposal: Prices shall be submitted for Task Orders listed in Section J.

Award of the basic IDIQ will be made based upon the sum of the total proposed prices for each of the Task Orders. The purpose of the price evaluation is to determine whether an offeror’s proposed prices are reasonable and realistic in relation to the solicitation requirements. Offerors are advised that unrealistically high or low price estimates, initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the offeror does not understand the requirement, or has made an unrealistic proposal.

(g) Basis of Award: Lowest Price Technically Acceptable Source Selection procedures identified in FAR Part 15.101-2, shall be utilized to select the successful contactors. Those firms determined Technically Acceptable for Factor 1 will receive an overall rating of Technically Acceptable. Award of the IDIQ contract will be made to the Technically Acceptable Offeror(s) whose offer provides the greatest overall value to the Government based on the lowest acceptable evaluated price.

(h) Debriefings: In accordance with FAR 15.505 & 506, offerors excluded from the competitive range or otherwise excluded from the competition during Phase I technical evaluations may submit a written request for a pre-award debriefing to the Contracting Officer. After award, unsuccessful offerors may submit a written request for a post-award debriefing to the Contracting Officer. Unsuccessful offerors will be debriefed and will be furnished with the basis for the selection decision. Debriefing information will include the Government's evaluation of the strong and weak or deficient factors in the Offeror's proposal; however, item-by-item comparisons with other offerors' proposals will not be made. Debriefings will not reveal the relative merits or technical standing of competitors or the evaluation results of competitors. Moreover, debriefings will not reveal any information that is not releasable under the Freedom of Information Act (FOIA).
