SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 Background and Purpose

The intent of this procurement action is to enter into multiple Blanket Purchase Agreements (BPAs) under which road decommissioning, storm proofing or road closing activities may be competed and BPA Calls for project work issued. In accordance with Federal Acquisition Regulation (FAR) Part 37.3 (Dismantling, Demolition, or Removal of Improvements), this work is solely for dismantling, demolition, or removal of improvements in which the Service Contract Labor Standards statute applies as no further work (via the individual BPA Call or via a separate contract) will result in the construction, alteration, or repair of a public building or public work at that location. Work may consist of water barring and installing rolling dips, culvert removal, hauling of excavated material, restoring of stream channels, road surface ripping, fill pullback, seeding and mulching, installing barricades and other work as requested.

While a pre-set limitation is not established regarding the number of BPAs that will be entered in to, the amount may be limited in any geographic area if it is determined that sufficient competition is taking place and the administrative burden of entering in to more agreements offsets the potential benefit.

As identified in Section B.3, the “Areas for Coverage” have been split into two Zones. Prospective offerors will indicate which Zone (1, 2 or both) they are interested in providing coverage. When projects come available in a Zone, BPA holders who have indicated interest in covering the applicable Zone will be requested to provide a quote.

C.2 Mandatory Terms and Conditions for Blanket Purchase Agreement

A. Description of Agreement: The work covered by this Blanket Purchase Agreement is described below in Section C.3. If issued a BPA Call, the contractor shall provide the services as described in accordance with the BPA Call document and the terms and conditions of this BPA.

B. Extent of Obligation: The Government is obligated only to the extent of authorized purchases actually made under this BPA.

C. Purchase Limitation: All calls placed under this BPA will fall under the Simplified Acquisition Threshold.

D. Individuals authorized to purchase under the BPA: Any Contracting Officer operating within the limits of their warrant may make BPA Calls under these BPAs.

E. Delivery Tickets: Use of delivery tickets is not anticipated.

F. Invoices: BPA Call invoicing shall be submitted via the Invoice Processing Platform (IPP). See FAR 52.212-4(g) for Electronic Funds Transfer (EFT) requirements.

C.3 Scope of Work

Section 1 – General

1.1 Scope of contract

The Contractor shall provide any and all labor, equipment, tools, transportation and supplies necessary to perform road decommissioning, storm proofing or road closing in identified project areas.

Work may consists of water barring and installing rolling dips, culvert removal, hauling of excavated material, restoring of stream channels, road surface ripping, fill pullback, seeding and mulching, installing barricades and other work as requested. The Performance Based Statement of Work shall consist of completing the ordered Tasks defined in Section 5 and supplemented as outlined in individual BPA Calls to the desired performance requirement identified in Section 7. Contractor shall perform all work required in accordance with typicals and specifications of the contract. The Contractor shall assume all risk, loss, damage, or expense arising out of prosecution of the work, except as otherwise provided in the contract.

1.2 Project Location and Description

Operations shall be confined to lands within the boundaries of the: Siuslaw, Willamette, Umpqua, Rogue River-Siskiyou, Fremont-Winema, and Mt. Hood National Forests and Columbia River Gorge National Scenic Area; Coos Bay, Medford, Northwest Oregon, and Roseburg BLM Districts. The specific location of the worksites will be provided with each BPA Call. The boundaries of the project areas are within the road prism of the roads to be treated.

1.3 Accessibility

1.3.1 Access to most project areas is by all-weather and seasonal roads. Exceptions are shown on individual project area maps. Some units may require four-wheel drive vehicles or all-terrain vehicles (ATV). Spur roads shown on project maps may not be accessible by vehicle.

1.3.2 Some project area(s), as designated on individual project maps, may require access through locked public or private gates. Contractor shall work with the appropriate Administrative Office to secure keys required for access through locked gates and when additional arrangements are required.

The Contractor shall be responsible for the cost of replacement gate keys and locks if keys are not returned.

1.3.3 Motorized Equipment - Use of motorized equipment, other than hand-held equipment such as power saws and brush cutters, will not be permitted off designated roads in the project area without approval of the Contracting Officer or as otherwise provided herein.

1.4 Equipment Cleaning

In order to prevent the spread of noxious weeds, the Contractor shall clean all construction equipment prior to moving it to the project area. This cleaning shall remove all soil, plant parts, seeds, vegetative matter, or other debris that could contain or hold seeds. Only construction and maintenance equipment and the equipment necessary to transport said equipment, shall be cleaned and inspected by the Forest Service or BLM prior to operating within the project area. All subsequent move-ins of equipment to the project area shall be treated in the same manner as the initial move-in. This requirement does not apply to service vehicles, water trucks, pickups, cars, and/or similar vehicles.

Contractor shall employ whatever cleaning methods necessary to ensure that construction and maintenance equipment is free of noxious weeds. Equipment shall be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. Equipment or components disassembly, or the need for specialized tools, are not required.

Unless otherwise agreed, Contractor shall give the BLM or Forest Service at least 24 hour notice when equipment is ready for inspection. Notification will include an agreed upon location where the equipment will be available for inspection by the BLM or Forest Service. Inspection will be required after every subsequent cleaning ordered by the BLM or Forest Service.

BLM or Forest Service shall approve the methods of cleaning and the locations for the subsequent cleaning.

New infestations of noxious weeds of concern to BLM or Forest Service and identified by Contractor, BLM or Forest Service, on the Project Area or on the haul route, shall be promptly reported to the other party. Contractor and BLM or Forest Service shall agree on treatment methods to reduce or stop the spread of noxious weeds when new infestations are found. A current list of noxious weeds of concern to BLM or Forest Service is available at each BLM or Forest Service office.

1.5 Operating Permits

BLM projects only: State law requires a permit to operate power driven machinery. Permits must be obtained from the State Forestry Office in Salem or at local offices prior to the operation of power driven machinery. This requirement also applies to chainsaws.

1.6 Environmental Considerations

1.6.1 Water Quality: All ground soil disturbing operations are to be conducted during periods of dry weather. Generally, this period would be June1 through October 15; however, these dates will vary depending on weather patterns. All in-stream work shall be conducted during periods of low stream flow, generally between July 1 and October 15 in accordance with ODFW in-stream work timing guidelines, unless otherwise designated in the BPA Call.

1.6.2 Any maintenance work and refueling of equipment shall be done outside the stream channel.

Equipment shall be reasonably clean of dirt and grease prior to operations on Government Lands.

Should any gas or oil leakage occur while working in the stream, Contractor shall immediately remove the equipment from the stream and any contaminants shall be promptly cleaned up by the Contractor to DEQ standards.

1.7 Hazardous Material Containment/Cleanup

1.7.1 The Contractor shall keep a Spill Containment Kit (SCK) on site as described in the modified Spill Prevention, Control and Countermeasure (SPCC) Plan during any operation and provide training to employees on how components of the SCK are used. The SCK must be designed for use with petroleum products and must contain, as a minimum, the following items:

a. Two Bales (4 Booms/Bale, of 8"x10' Absorbent Booms)

c. One Absorbent Sweep (minimum of 18"x100'x3/8")

d. Gloves (PVC and Latex), Goggles, and Garbage Bags

1.7.2 Prior to heavy equipment (excavator) operation in or adjacent to the stream channel, the Contractor shall provide and properly install a petroleum containment boom sufficient to absorb a 40 gallon spill in locations approved by the COR. Stream channels requiring petroleum containment booms will be designated by the Government. Any and all spills of chemicals, including but not limited to petroleum products, shall be reported to the COR and immediately contained and disposed of in accordance with State and Federal regulations. Disposal includes the removal of any contaminated soil and rock material.

1.7.3 During Contractor operations on lands managed by the BLM and Forest Service, in the event of a release as defined in Oregon Administrative Rules (OAR), PART 340, DIVISION 108, HAZARDOUS WASTE MANAGEMENT, the Contractor shall immediately implement the modified SPCC Plan and notify the COR. The Government Representative shall assume function as Incident Commander until relieved by the Hazardous Materials Coordinator or his/her replacement.

1.8 Project Area Priority

The Government reserves the right to direct the sequencing of the work. Certain project areas may be designated as higher priority, which would require earlier completion than other areas. BPA Calls may run concurrently.

1.9 Seasonal Restrictions for Threatened & Endangered (T&E) Species

Some BPA Calls may have seasonal restrictions on mechanical operations due to threatened and endangered species. Specific project areas affected will be identified on each BPA Call.

Section 4 – Contractor Furnished Critical Items/Services

Identified per BPA Call, if applicable

Section 5 – Performance Work Statement Tasks and Critical Subtasks

5.1 Sub-items 1.1, 1.2, 1.3 - Storm Proofing

5.1.1 The Contractor shall storm proof designated roads by installing water bars or drain dips at locations flagged in the field, listed on work sheets, or at intervals as designated on the Typical Diagrams. The Government may increase or decrease the spacing intervals so as to fit specific road conditions.

5.1.2 Water bars shall be constructed so as to channel water away from existing ditch lines and across the road surface to the outside of the road shoulder. Water bars shall be self-maintaining. Water bars will be identified as drivable or as non – drivable on the Schedule of Items or as identified on the BPA Call. See Water Bar Diagrams, Sheets 3 and 4 of Attachment 2.

5.1.3 Unless otherwise designated, water bars shall be placed at 200 foot intervals, or as field conditions allow and with the following exceptions:

a. The 200 foot interval may be reduced by up to 75 feet if placement will facilitate providing a water bar down grade of a functioning culvert that is not designated for removal.

b. The 200 foot interval may be extended or reduced by up to 75 feet in order to discharge water over a less erodible surface. For example, placement of water bars to discharge water over a rock fill rather than an unvegetated soil fill.

5.1.4 Rolling dips shall be constructed to conform to the rolling dip diagram, Sheet 1 of Attachment 2.

5.1.5 All culvert inlets and catch basins shall be cleaned of material that interferes with water flow on culverts not designated for removal. No clean out is required for those culverts that are not functioning due to damage or due to being completely plugged more than two feet from the inlet.

On grades over 6 percent, water shall be shunted off the road either by placing ripping furrows or water bars placed at 200-foot intervals, unless stated elsewhere. The Contractor shall place organic material on top of treated surface as a level of restoration. Reference 5.1.2 for water bar requirements and 5.1.5 for culvert inlets and catch basins requirements

5.2.2 Subsoiling with Excavator – The Contractor shall provide subsoiling of the road prism to a depth of 24 inches with an excavator. The Contractor shall place organic material on top of treated surface as a level of restoration.

5.3 Sub-item 1.6 – Fill Slope Pullback

5.3.1 Excavation equipment shall be capable of a horizontal reach of at least 20 feet.

5.3.2 Fill material placed on slopes greater than 60 percent during original construction or as marked on the ground shall be pulled back into the roadway leaving a finished fill slope of 1.5 (H) :1 (V) or as specified on the BPA Call. Material beyond the reach of the equipment shall be left undisturbed on the slope. Any areas that may trap water must be removed, including berms immediately below pullback area. Excavated material shall be placed on the cut bank side of the existing roadbed, shaped to a slope of 1.5 (H): 1 (V) or flatter, and lightly compacted. Reference to Sheet 5 of Attachment 2

5.3.3 Excavated fill material shall be placed no closer than 20 feet from perennial or intermittent stream channels. On roads with grades exceeding 4 percent, two closely spaced water bars shall be installed up-grade and within 50 feet of material placed on roadway. Reference 5.1.2 for water bar requirements

5.4 Sub-item 1.7 - Road Closure by Berm Barricade Installation

5.4.1. The Contractor shall place berm barricades to completely close off designated roads to vehicle traffic. The barricades shall be placed at locations flagged in the field, or listed on work sheets as shown on Typical Drawing Sheet 2 of Attachment 2. The applicable berm dimensions will be listed on table for the project site designated on the BPA Call.

5.4.2 Berms with trenches shall be constructed from material on-site and placed at the beginning of the designated road, unless otherwise directed by the Government.

5.4.3 Berm barricade trenches shall be constructed to allow water drainage away from streams and erodible surfaces.

5.4.4 When available at the site the Contractor shall place stumps, cull logs, boulders or other vegetation on dirt berm to discourage vehicular negotiation.

5.5 Sub-item 1.8 - Road Closure by Boulder Placement

5.5.1 Boulder source will be identified on BPA Call, commercial sources may be included. Boulders shall have at least one dimension that is a minimum 24 inch in length and overall size to be a minimum of 8.0 cubic feet. A minor amount of sorting may be required.

5.5.2 Boulders shall be buried to a depth of 1/3 to 1/2 of their mass and set on 5 foot centers to prevent vehicle entry or as directed by the COR. Soil shall be replaced and tamped down around boulders. Reference Sheet 2 of Attachment 2

5.6 Sub-items 1.9, 1.10, 1.11, 1.11(A), and 1.15 - Culvert Removal and Channel Rock

5.6.1 Culvert Removal: The Contractor shall remove culverts on designated roads. Specific locations may be flagged in the field, listed on work sheets or otherwise designated on the BPA Call.

5.6.2 Culvert Disposal: The Contractor shall be responsible for disposal of the removed culverts in a legal manner, pay any required fees, and shall submit proof of legal disposal prior to final payment for each applicable BPA Call.

5.6.3 Excavation of fills (not to exceed 40 feet) is broken out into four categories: 8 feet or less, greater than 8 feet to less than 15 feet, greater than 15 feet to less than 30 feet, or greater than 30 feet to less than 40 feet deep measured from the bottom of culvert at the centerline of the road during culvert removal shall be accomplished in a manner that minimizes sedimentation from entering streams.

Temporary sediment control structures such as silt fencing or straw bales for short term sediment abatement shall be installed as needed, immediately downstream before excavation on culverts that have running water or as described in the BPA Call. At live stream crossing culvert removals, specific dewatering requirements may be required. A dewatering plan shall be submitted and approved prior to culvert removal as specified in the BPA Call.

5.6.4 Following culvert removal, the disturbed intermittent or live streambed shall be reshaped to the natural stream gradient with sides sloped to a 1.5 (H) : 1 (V) grade or as described in the BPA Call. The re-established channel shall have a bottom width of a minimum of 1.5 times the diameter of the existing pipe or as described in the BPA Call. When ordered under Sub-item 1.15, place channel rock following culvert removals at live stream crossings. Rock depth, sizes and size distributions will be specified in BPA Call. Rock material source will be identified on BPA Call, commercial sources may be included.

Reference Culvert Removal Typical, Sheets 6, 7 and 8 of Attachment 2

5.6.5 Culvert overburden shall be spread out in uniform depths up and down the existing road prism in a manner that will prevent entry into streams. Remove culverts and excavate all fill material down to the original live stream bed. The disturbed intermittent or live stream banks shall be reshaped prior to seeding and mulching. The removed fill material shall be placed against the cutslope and recontoured as close as possible to the original contours. The material shall be outsloped at a minimum of 20 percent gradient and no closer than 20 feet from the excavated trench edge.

5.6.6 Trees approved to cut or otherwise removed in the clearing area for the culvert removals shall be felled directionally in a manner that protects the trees outside the road prism from damage.

5.7 Sub-item 1.12 – End Haul of Waste Material

A dump truck shall have the capability of hauling soil and rock from stream crossing fills and hauling culverts off-site for dispersal as described in 5.6.2. Waste material from the culvert removal that cannot be utilized as fill material shall be hauled to a Government designated site, not to exceed ½ mile, unless otherwise stated on the BPA Call. Prior to commencing end-hauling operations, the Government shall designate the method of measurement of the end haul material (e.g. counting trucks, piles, etc). Waste material piles at the waste site shall not be leveled, unless otherwise agreed.

5.8 Sub-items 1.13, 1.14 - Seeding & Straw Mulching for Culvert Removal

Intermittent or live stream banks disturbed due to culvert removal shall be seeded at a rate of 15 pounds per acre. Mulching shall consist of a two inch thick layer of straw or other approved on-site vegetative matter. Straw mulch or approved vegetative matter shall be used to cover all exposed excavation and culvert overburden and shall be spread evenly. Examples of on-site vegetative matter are on-site brush, tree limbs or small trees removed during culvert fill removal. On live streams, seed and mulch shall not be placed within the stream channel up to the wetted perimeter, as shown on Culvert Removal Typical sheets 6, 7 and 8 of Attachment 2. Straw bales shall be staged at culvert removal sites before moving to the next removal site.

5.9 Sub-item 1.16 - Project Access and Unexpected Work

All work ordered under this item will be directed by the Government. On a BPA Call basis, the Contractor may be required to remove obstructions in order to gain access to the project area and perform unexpected work required to complete contract obligations. Obstructions may consist of brush, boulders, logs, rock barriers and other objects, which may impede the Contractor’s access to the project area.

5.10 Sub-item 1.17, 1.18 – Mobilization with Initial Equipment Cleaning and Subsequent

Equipment Cleaning

5.10.1 Mobilization includes the initial equipment cleaning (reference Section 1.4), movement of personnel, equipment, supplies, and incidentals to the project site. Mobilization is complete when 100 percent of the personnel, equipment, supplies, and incidentals necessary to complete the work have been moved to the project site. Access to all sites shall be on existing paved, gravel, or native surface roads.

5.10.2 Subsequent Equipment Cleaning may be ordered by the BLM or Forest Service as needed.

5.11.2 End Haul of Waste Material (Sub-item 1.12) – Payment will be made by the cubic yard price shown in the BPA Call. Measurement will be based on the number of full loads when hauling material or at the Government designated waste site. Loads will be measured to the nearest load based on dump truck size. Any difference between the Government’s and the Contractor’s figures pertaining to number of loads shall be reconciled at the end of each project, or the Government figures will apply.

5.11.3 Stream Channel Rock (Sub-item 1.15) – Payment will be made by the cubic yard price shown on the BPA Call. Measurement will be based on as-constructed dimensions as measured in the field.

5.11.4 Subsequent Equipment Cleaning (Sub-item 1.18) – Payment under this Sub-item will only be made if subsequent cleanings are ordered by the BLM or Forest Service. Payment will be on a “lump sum” basis, meaning one complete cleaning of all equipment required for the identified treatment area.

Subsequent cleanings necessitated by the Contractor’s action but not directed by the BLM or Forest Service will not be included in the measurement for payment.

5.11.5 Final payment will be withheld until the Contractor has returned all accountable Government furnished property, e.g., gate key(s). Keys must be returned prior to final payment of each BPA Call.

Keys not returned within 10 days after completion of the BPA Call are subject to a deduction from the final payment for actual cost associated with replacing gate key(s) and if applicable, gate locks.

1) DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE

The Contracting Officer designates the Contracting Officer's Representative (COR).

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government, which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract.)

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

2) SUPERINTENDENCE BY THE CONTRACTOR (FAR 52.236-6)(APR 1984)

At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor.

(e) The Contracting Officer may, in writing, require the Contractor to remove from the work any employee found to be working in an unsafe manner.

8) CONTRACTOR QUALITY CONTROL PLAN

A. Quality Control Plan

The Contractor shall provide a Quality Control Plan (QCP) as part of this Technical Proposal. The Plan must demonstrate how the Contractor shall assure that quality of performance meets the objectives and requirements of the contract. The QCP shall specify:

- How quality will be monitored to ensure performance standards are met.

- How the work will be supervised.

- How results of the monitoring will result in quality performance.

- Identify the personnel responsible for performing quality control.

B. Contractor Quality Control Inspection

The Contractor shall assure themselves that performance meets contract specifications, in accordance with FAR 52.212-4, Contract Terms and Conditions -- Commercial Items, paragraph (a), prior to requesting the Government to inspect for payment or acceptance. The Contractor shall contact the Contracting Officer upon completion of a unit. The Contracting Officer may observe the Contractor’s inspection at any time and shall otherwise have unlimited access to the inspection data.

9) GOVERNMENT QUALITY ASSURANCE SURVEILLANCE PLAN

The Government will periodically evaluate the Contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The Government representative will evaluate the Contractor’s performance through intermittent on-site inspections of the Contractor’s quality control program. The Government may inspect each task as completed, increase the number of quality control inspections, or decrease the number of quality control inspections if deemed appropriate.

Acceptance will be determined by a visual inspection of the work areas ordered and will be based on adherence to requirements stated in the specifications.

10) UNSATISFACTORY PERFORMANCE

Nonconformance with any of the specifications will require rework at the Contractor’s expense, to bring the work up to specification standards.

11) REWORK AND REINSPECTION AFTER REWORK

When inspection results are unsatisfactory and the deficiency is correctable, payment will not be made until the deficiency has been corrected. Reinspection after rework will be made in the same manner as the first inspection but may be at different locations. The Contractor shall pay for inspections necessitated by the rework, at the request of the Contracting Officer.

12) USE OF PREMISES

a. The Contractor shall comply with the regulations governing the operation of premises that are occupied and shall perform its contract in such a manner as not to interrupt or interfere with the conduct of Government business.

b. Before any camp is opened or operated on National Forest land or lands administered by the Forest Service, the Contractor shall request permission (in writing) from the COR.
