FAR 52.217-6 Option for Increased Quantity (MAR 1989)

The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor within the time specified below. Completion/delivery of added items shall continue as shown elsewhere herein.

The exercise of an increased quantity will be accomplished by a unilateral contract modification issued by the Contracting Officer. There may be multiple modifications.

The quantities for the Payment Items shown above are considered to be base quantities. Each individual Payment Item may be increased by any quantity up to and including 100% of the base quantity specified above. [As an example: Item 2C Payment Item 851F(6) Hazard Removal, 5 each, may be increased by an addition of either 1, 2, 3, 4 or 5 each].

The exercise of the option for any one payment item is independent of any other payment item.

If an option quantity is exercised for only part of the allowed 100% increase, an additional option quantity may be exercised to cover the remainder.

Exercise of an increased quantity of any single Payment Item will be available to the government from the date of award until work on the base quantity for that same Payment Item is completed, unless a later date is mutually agreed, but in no event shall any exercise of option quantities be later than September 30, 2010.

Offers on Subitems and Payment Items Offerors may submit prices for only Item 1 or for only Item 2 or for both Items 1 and 2.

Offerors submitting prices for Item 1 shall submit a unit price and amount for every Payment Item on every Subitem for Item 1.

Offerors submitting prices for Item 2 shall submit a unit price and amount for every Payment Item on every Subitem for Item 2.

Award By Item Subitems 1A, 1B and 1C are separated for accounting purposes only. These subitems are grouped together as Item 1 for award purposes. Award will be for the total of all payment items under Item 1.

Subitems 2A, 2B and 2C are separated for accounting purposes only. These subitems are grouped together as Item 2 for award purposes. Award will be for the total of all payment items under Item 2.

Item 1, Mt Baker RD work is independent of Item 2, Darrington RD work. Award may be made for each item separately or award may be made for both items together.

HUBZONE Small Business Set-Aside This is a 100% set-aside for HUBZONE small business enterprises. HUBZONE concerns must be certified by the Small Business Administration in advance. See www.sba.gov/hubzone.

Offers may be submitted by non-HUBZONE small business enterprises, but will only be evaluated for award purposes if no offers are received from HUBZONE firms or if all offers from HUBZONE firms are considered to be unreasonably priced.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
