Amendment #3 to AG-0489-S-10-0074 O’Brien Creek Passage/Bridge

A. EVALUATION AND AWARD CRITERIA: The relative importance of the evaluation factors has been revised.

· Section M-3 EVALUATION OF OFFERS and Section M-4 AWARD DETERMINATION: Delete solicitation pages 73 and 74 and substitute the attached revised pages 73 and 74. Offeror’s Technical Capability and Offeror’s Past Performance History are considered to be of approximately equal value. These two elements when combined are significantly more important than Price.

B. FOR INFORMATION: The Offeror Questionnaire [technical proposal] was adjusted via Amendment #2 to reflect only two major technical sub-elements, Technical Capability and Past Performance History. If an Offeror submits a Questionnaire in the original format, the Government will renumber Question #3 to Question #1i.

Amendment #3 to AG-0489-S-10-0074 O’Brien Creek Passage/Bridge - revised M-3 & M-4 page 73

SECTION M--EVALUATION FACTORS FOR AWARD

M-1 FAR 52.217-5 EVALUATION OF OPTIONS (JUL 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

M-2 SPECIAL PRICE EVALUATION FACTORS

The amounts used for evaluation will include applicable price evaluation adjustments related to HUBZone Small Business Concerns pursuant to FAR 52.219-4, which is incorporated in Section I by reference.

M-3 EVALUATION OF OFFERS

The Government will evaluate offers based on the best overall value to the Government, price and other factors considered. Other factors to be considered include, but are not limited to:

· Offeror’s Technical Capability based on Questionnaire response

· Offeror’s Past Performance History based on Questionnaire information and other resources

Technical Capability and Past Performance History are considered to be of approximately equal value. These two elements when combined are significantly more important than Price.

Each initial offer should contain the offeror’s best terms.

Each proposal received will be carefully considered and all information submitted will be kept in strict confidence within legal constraints.

This request for proposals does not commit the Government to pay any costs incurred in the preparation or submission of proposals.

M-4 AWARD DETERMINATION

The Government intends to award a single contract as a result of this solicitation.

The term “technical” shall be construed to encompass both “Technical Capability” and “Past Performance History” as described above.

Amendment #3 to AG-0489-S-10-0074 O’Brien Creek Passage/Bridge - revised M-3 & M-4 page 74

Award will be made to that offeror (1) whose proposal is technically acceptable and (2) whose technical/cost relationship is the most advantageous to the Government. The critical factor in making any cost/technical trade-off is not the spread between the technical ratings but, rather, the significance of that difference. The significance of the spread of the ratings will be determined on the basis of what the difference might mean in terms of performance and what it would cost the Government to take advantage of it.

Award may not necessarily be made to that offeror submitting the lowest priced offer.

Award may not necessarily be made for technical capabilities that would appear to exceed those needed for the successful performance of the work.

The Government reserves the right to make cost/technical trade-offs that are in the best interest and advantageous to the Government.

The Government may reject any or all offer(s), issue orders to other than the lowest offer, and waive minor informalities or irregularities in offers received, or elect to not award at all.

If necessary, the Government may conduct discussions with any or all offeror’s.

The Government may issue award contract on the basis of offerors as received, without entering into discussions with any offeror(s).
