Sixmile Bridge Replacement

SECTION C ‐ DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C ‐ 1 PROJECT DESCRIPTION AND LOCATION

a. Description of Work: This project consists of replacing a 25‐foot wood bridge with a 50‐foot, salvaged wood bridge along with the associated site work. The work will involve replacing worn portions of the bridge with new (Government provided), treated timbers. The successful Contractor shall furnish all labor, materials, equipment, supervision, transportation, supplies, and incidentals necessary to complete the work.

b. Project Location: The project is located on the Gallatin National Forest, Yellowstone Ranger District, in Park County, Montana. The site is situated approximately 12 miles north of Gardiner, MT along Sixmile Road #348 and is roughly 0.8 miles from the junction with Dailey Lake Road. The project area is located in T6S, R7E.

d. Subcontractors: All subcontractors must be identified by the time of the postaward conference and must be approved prior to the issuance of the Notice to Proceed. Contractors shall submit a completed SF‐1413 form to the Contracting Officer for each subcontractor (an SF‐1413 form is attached in Section J‐6).

e. Price Range: Between $25,000 and $100,000

f. Pre‐bid Tour: No pre‐bid tour will be conducted. Interested parties may contact Grant Morrison at the Gallatin

National Forest, Supervisor’s Office, 406‐587‐6724, for additional information or for directions to view the project site on their own. Contractors are urged to inspect the sites where the work will be performed.

Interested parties shall take reasonable steps to ascertain the nature and location of the project area and the work to be completed, as well as the general and local site conditions which can affect the work and cost of performance. Failure to take the actions described in this paragraph will not relieve the Contractor from the responsibility of properly estimating the difficulty and cost to successfully perform the work, or from successful completion of the work without additional expense to the Government.

g. Start Work Date: Estimated start date for this project is 19 May 2014. Work may begin as soon as conditions are satisfactory, but not until then.

h. Performance Period: All work shall be completed, including clean‐up, final inspection, and Government acceptance, no later than 30 June 2014. The Contractor shall maintain progress at a rate that will assure completion of work within the time specified above.

C ‐ 2 GENERAL SPECIFICATIONS

a. Existing Utilities: There are no known underground utilities at the project site.

b. Pollution and Erosion Control: During all operations under this contract, the Contractor shall exercise reasonable measures to prevent or minimize soil erosion and pollution of water and other resources. All refuse, including garbage, rubbish, and solid or liquid wastes, from the Contractor's operations, including camps, parking areas, and equipment maintenance areas shall be stored, collected, and disposed of in a sanitary and nuisance‐free manner.

Refuse shall be disposed of in State‐approved containers.

Throughout the work performance period, the Contractor shall make every reasonable effort to direct surface runoff water to stabilized waterways and to keep the drainage systems functioning effectively to minimize soil erosion and water pollution.

c. Noxious Weed Control: In order to prevent the potential spread of noxious weeds, the Contractor shall clean equipment in accordance with Section 151, Special Project Specifications.

Sixmile Bridge Replacement

d. Submittals: Submit two copies to the Contracting Officer (CO) for approval on all construction materials and items required herein. Literature shall be marked or otherwise designated to indicate identifying information such as the exact model, size, etc., of the item(s) the Contractor proposes to use. The information provided shall be adequate to determine compliance with the specifications without additional research by the CO. One copy of the approved submittals will be returned to the Contractor. The Contractor must submit all items with such promptness as to cause no delay in the work. Approvals must be obtained before starting work which involves the item(s). The Contractor shall allow five calendar days for processing of submittals by the Government.

e. Public Use of Facilities: The Contractor shall be allowed to close the road for a period of two weeks past the Lower

Sixmile Trailhead. The Contractor shall notify the Government 30 days prior to closure.

f. Quarry operation and rehabilitation: Conduct quarry operations so as to cause minimum impact on air quality, noise levels, and surrounding natural resources. Do not disturb vegetation or the ground surface outside of the limit of disturbance designated in the field by the CO. At the finish of quarry operations, restore disturbed surfaces to pre‐contract conditions.

g. Waste site operation and rehabilitation: Waste site locations for disposal of excess excavated material, shall be identified. The CO will designate areas for waste placement within these sites. Operate only within CO‐delineated limits of disturbance in waste sites. Where directed by the CO, salvage and stockpile all topsoil prior to waste placement. For measurement purposes, take initial cross‐sections of the ground surface after stripping topsoil (where topsoil stripping is required). Upon completion of the waste placement, retake cross‐sections before replacing topsoil. Place waste by end dumping or similar means and shape as directed by the CO. Shape slopes to gradually transition into the natural ground without noticeable breaks. Spread topsoil uniformly over waste and other disturbed areas.

h. Construction Staking: The Contractor will be responsible for all staking.

i. Storage and Stockpiling of Equipment and Materials: Storage and stockpiling shall take place only within areas approved by the CO.

j. Maintenance of Clean Worksite Conditions: The Contractor will maintain the project work area in a clean and orderly condition throughout the period of performance.

k. Work Done by Others: It is anticipated that work will be performed by other contractors at the site during the period of performance. Other work may include:

Project: Sixmile Road ERFO Repairs – 2 sites near the end of the road Contractor: Cat Tracks, Inc.

The Contractor shall make reasonable accommodations for other work at the project site. The Government will notify the Contractor in advance when this work is planned to occur.

52.225‐9 Buy American Act ‐ Construction Materials (SEP 2010)

(a) Definitions. As used in this clause‐

"Commercially available off‐the‐shelf (COTS) item"‐

(1) Means any item of supply (including construction material) that is‐

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in section 3 of the Shipping Act of 1984 (46 U.S.C. App. 1702), such as agricultural products and petroleum products.

"Component" means an article, material, or supply incorporated directly into a construction material.

"Construction material" means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site

Sixmile Bridge Replacement preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

"Cost of components" means‐

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty‐free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

"Domestic construction material" means‐

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if‐

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

"Foreign construction material" means a construction material other than a domestic construction material.

"United States" means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference. (1) This clause implements the Buy American Act (41 U.S.C. 10a‐10d) by providing a preference for domestic construction material. In accordance with 41 U.S.C. 431, the component test of the Buy American Act is waived for construction material that is a COTS item (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows: NONE

[Contracting Officer to list applicable excepted materials or indicate "none"]

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that‐

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American Act is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American Act to a particular construction material

Sixmile Bridge Replacement would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American Act. (1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including‐

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty‐free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American Act applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American Act applies, use of foreign construction material is noncompliant with the Buy American Act or Balance of Payments Program.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

Foreign and Domestic Construction Materials Price Comparison

52.228‐13 Alternative Payment Protections (JUL 2000)

(a) The Contractor shall submit one of the following payment protections:

A Payment Bond; or An Irrevocable Letter of Credit (ILC); or A Certificate of Deposit.

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within seven days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one‐year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.

52.232‐40 Providing Accelerated Payments to Small Business Subcontractors (DEC 2013)

(a) Upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor.

(b) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.

(c) Include the substance of this clause, including this paragraph (c), in all subcontracts with small business concerns, including subcontracts with small business concerns for the acquisition of commercial items.

52.244‐6 Subcontracts for Commercial Items (DEC 2013)

Commercial item has the meaning contained in Federal Acquisition Regulation 2.101, Definitions.

Subcontract includes a transfer of commercial items between divisions, subsidiaries, or affiliates of the Contractor or subcontractor at any tier.

(b) To the maximum extent practicable, the Contractor shall incorporate, and require its subcontractors at all tiers to incorporate, commercial items or nondevelopmental items as components of items to be supplied under this contract.

In altering this clause to identify the appropriate parties, all disclosures of violation of the civil False Claims Act or of Federal criminal law shall be directed to the agency Office of the Inspector General, with a copy to the Contracting Officer.

(ii) 52.203‐15, Whistleblower Protections Under the American Recovery and Reinvestment Act of 2009 (JUN 2010) (Section 1553 of Pub. L. 111‐5), if the subcontract is funded under the Recovery Act.

(iii) 52.219‐8, Utilization of Small Business Concerns (JUL 2013) (15 U.S.C. 637(d)(2) and (3)), if the subcontract offers further subcontracting opportunities. If the subcontract (except subcontracts to small business concerns) exceeds $650,000 ($1.5 million for construction of any public facility), the subcontractor must include 52.219‐8 in lower tier subcontracts that offer subcontracting opportunities.

(iv) 52.222‐26, Equal Opportunity (MAR 2007) (E.O. 11246).

(v) 52.222‐35, Equal Opportunity for Veterans (SEP 2010) (38 U.S.C. 4212(a));
