The CONTRACTOR shall provide written documentation that all on site personnel engaged in the Work have received the Occupational Safety and Health Administration 40 hour Hazardous Waste Operations and Emergency Response (HAZWOPER) Training required under 29 CFR 1910.120.
The CONTRACTOR assumes full and sole responsibility for the means and methods necessary to complete the work in accordance with the project specifications. Conventional construction equipment and techniques may not be appropriate for this project, and the CONTRACTOR shall consider these factors when preparing the bid and planning and scheduling the work.
(b) Project Location. The New World Mining District is located north of Cooke City, Montana in the Beartooth Mountains. The District falls within the boundaries of the Gallatin and Custer National Forests and abuts Yellowstone National Park’s northeast corner. The Absaroka-Beartooth Wilderness Area bounds the District to the north and east. The District lies entirely within Park County, Montana.
The work sites to be addressed by this CONTRACT lie at elevations ranging from about 8,350 feet to 9,500 feet above mean sea level.
The project sites can be reached from two access points off U.S. Highway 212 about 0.6 and 1.5 miles east of Cooke City. A map showing the locations of the work is included in the DRAWINGS. Cooke City is accessible by paved roads from the east over Highway 212 and from the west through Yellowstone Park.
Access to Cooke City through Yellowstone National Park may be permitted, depending on vehicle weight and size limitations, with the following restrictions:

(c) Price Range. Between $500,000 and $1,000,000
(d) Start Work. It is estimated that work will begin on July 1, 2010 and continue until the contract ending date of September 30, 2010. All work under this contract must be completed before the contract ending date.
(e) Period of Performance. [see Part I, Section F, Clause 52.211-10]
(f) Noxious Weed Control. In order to prevent the potential spread of noxious weeds, the CONTRACTOR is required to furnish weed-free equipment. The CONTRACTOR’S equipment shall be cleaned to remove all dirt and plant parts and material that may carry noxious weed seeds into the construction area. Only construction equipment so cleaned and inspected by the Forest Service will be allowed to operate on the project. All subsequent move-ins shall be treated the same as the initial move-
in. Prior to move-in, the CONTRACTOR shall make equipment available for Forest Service inspection at an agreed location. "Construction equipment" does not include personal vehicles or support equipment that remains on the main travel route. Provide the Contracting Officer (CO) with at least 48 hours advance notification when the equipment is ready for inspection.
(g) Maintenance of Roads. Lulu Pass and Daisy Pass Roads are County roads that must be open at all times in a condition that standard passenger vehicles must be able to reasonably pass. The Upper County Connector Road is a Forest Road that also must be left open to passenger vehicles. To insure safe and reasonable access on these roads, the CONTRACTOR shall periodically water, apply road base, as necessary, and blade these roads for maintenance and dust suppression. In addition, all other roads where construction will occur are high clearance roads that must remain passable for high clearance and all-terrain vehicle (ATV) traffic. Road maintenance shall be conducted to the satisfaction of the CO and in such a manner to facilitate vehicular traffic and to minimize excessive construction disturbance to all roads affected by required work and all roads used by construction traffic.
Water for road maintenance is available from Fisher Creek at the Fisher Creek Bridge (MP 2.28). The use at the Fisher Creek bridge water source is limited to a maximum pumping rate of 200 gallons/min with a maximum seasonal use of 156,800 ft3 (3.6 acre-feet). Road maintenance is incidental to other work items.
(h) Control of Work. Contractor shall be responsible for laying out road work using the road logs provided in this contract. The Forest Service will mark the boundaries for the areas to be treated in the McLaren Adit area and along the Daisy Pass Road. The CONTRACTOR shall develop and make all detailed surveys needed for construction of the work involved. The CONTRACTOR shall be held responsible for the preservation of all primary and other control. If control markings are destroyed or disturbed by the CONTRACTOR, the cost for replacement will be deducted from the payment for the work.
The CONTRACTOR shall stake all staging areas, culvert locations, disturbance limits, and all other features of the work and receive approval from the CO before proceeding with the work on these items.
Staking and surveying by the CONTRACTOR is considered incidental to other work items and no separate measurement or payment for this item will be made
(i) Rock Sources. Other than government provided rock described in Section C-2, rock for riprap and drainage gravel shall be furnished by the CONTRACTOR.
(j) Restoration by CONTRACTOR. All areas disturbed by the CONTRACTOR’S operations such as, but not limited to, access roads, staging areas, stockpiles, haul roads, loading operations, and disposal operations, shall be restored by grading to the original contours, seeding, fertilizing, and installing erosion control mat. During the course of the work, the CONTRACTOR shall periodically or as directed by the CO remove and dispose of all surplus construction materials and debris and keep the project area and public right-of-way reasonably clean. Upon completion of the work, the CONTRACTOR shall remove all temporary construction facilities, debris, and unused materials, leaving the project sites in a neat and clean condition. All debris shall be disposed off-site in a state-licensed landfill.
C - 2 - GOVERNMENT-FURNISHED PROPERTY.
The Forest Service will provide the following Government-furnished property for use on this project:
1. Boulders for blocking reclaimed roads are available at the end of FR 3215 (Gold Dust Access
Road) at the ford crossing of Fisher Creek. This road is currently reclaimed to permit ATV use only (six feet wide travel width). The CONTRACTOR may choose to improve access in this area but must restore to existing conditions when finished. Additional boulders are found at select locations throughout the work area, and may be used at the direction of the CO. If boulders are removed for use under the terms of this contract, all disturbances associated with their removal will be reclaimed to the satisfaction of the CO. Reclamation of disturbed areas associated with boulder selection is incidental to the work.
2. CONTRACTOR may choose to incorporate stockpiled materials located at the quarry site as SHOW ON THE DRAWINGS (Sheet 1) into CONTRACTOR supplied materials. Material and estimated quantities are described in Table C-2. The CO shall approve all quarry materials prior to project use.
