APPENDIX A - DESCRIPTION/SPECIFICATIONS/WORK STATEMENTS

TECHNICAL REQUIREMENTS FOR SERVICE WORK ITEMS

A. Silvicultural Goals and Desired Condition

Reduce hazardous fuels and uncharacteristic fire behavior by reducing conifer tree density and woody debris on National Forest Lands northeast of Idaho City and adjacent to private lands and residences along the State Highway 21 corridor. Reduce competition between trees and provide space for the residual overstory & largest/best understory leave trees to grow, develop and maintain or improve their vigor. Reduce the incidence of insect and diseases that affect growth and tree health; and improve desirable tree qualities, tree species mix and characteristics of the leave stand. Reduce the understory conifer ladder fuels and remove the suppressed understory Douglas-fir and ponderosa pine.

B. Scope of Service Work

Service work requires tree thinning with insect/disease sanitation, treatment of slash associated with service work, and related work in compliance with its terms, specifications, and provisions. Methods of accomplishing thinning and slash work include hand felling, bucking and lopping with powersaws; re-arrangement and pull-away from leave trees and designated areas; and decking attached tops of merchantable material. Service work includes furnishing all labor, equipment, supervision, transportation, operating supplies, and incidentals.

C. Leave Tree Description for trees up to 10.0 inches DBH

1. Selecting Leave Trees:

The average spacing requirement for leave trees is 22 feet. Individual contract unit spacing requirements, cutting specifications, and major work categories are specified on the Summary Information Chart (Appendix A - Exhibit 1). In all units, the spacing shall be varied up to 50% to select the best leave trees based on the prescription and characteristics of desirable trees.

Desirable leave trees shall generally be those of the tallest height, largest crown (in dominant & co-dominant crown positions - see Appendix A, Exhibit 2), and straightest stems without forking that are free of damage due to insects, disease, physical, or mechanical causes. Leave tree priorities are as follows:

a. Leave all conifer trees, which exceed specified maximum DBH cut limit on the Summary Information Chart (Appendix A - Exhibit 1) unless defined as Cull below, under Section I (Definitions), insect, disease and Damage. (There may be some areas where most trees present are larger than 10 inches DBH and acceptable spacing shall be less than the specified spacing, however this will not be the general rule.)

b. Select additional leave trees from healthy undamaged conifers under specified maximum DBH cut limit as necessary to achieve specified average spacing. Spacing shall be varied up to 50 percent to select the most dominant and desirable leave trees. (While a variable spacing is required to leave the best trees, the overall average spacing specified shall be maintained, and not materially increased or decreased.)

c. If no disease-free, undamaged tree exists at the required spacing interval, leave trees with minor damage.

d. If no disease-free tree with minor damage exists, all trees defined as Cull, and trees between 2 feet in height and 10 inches DBH in excess to the specified spacing shall be cut.

(Acceptable spacing will be greater than specified in areas where trees are nonexistent or most of the trees are cull.)

COMMERCIAL ITEM – AG-0261-S-09-9001 Mores South Stewardship Re-Issue Page 3

2. Additional Leave Tree Specifications

a. Preferred Leave Tree Species: Leave tree species priorities are specified by individual contract unit on the Summary Information Chart (Appendix A - Exhibit 1).

b. Detailed site specific leave tree and cutting requirements, including additional information on leave tree priorities, are specified by individual contract unit in the Remarks columns on the Summary Information Chart (Appendix A - Exhibit 1).

c. Leave all trees within 30 feet (as measured from the stream bank) along all intermittent streams designated on the Contract Maps. Leave all trees within 50 feet (as measured from the stream bank) along all perennial streams designated on the Contract Maps.

d. In isolated tree patches where only 2 to 3 acceptable leave trees will exist, spacing shall be as close as 4 feet to select the best trees, if trees are free to grow on 2 sides or more.

D. Cut Tree and Associated Slash Treatment Requirements:

1. All trees other than leave trees shall be cut below the lowest live limb, except when prevented by natural obstacles. All live limbs below the cutting point shall be removed. Trees shall be completely severed from the stump. Stump height shall not exceed 8 inches above ground level or 4 inches above natural obstacles.

2. Due to an ongoing Ips bark beetle problem in ponderosa pine, all portions of felled green ponderosa pine trees in excess of 3 inches in diameter and 2 feet in length shall be removed at least 8 feet from the base of ponderosa pine leave trees.

3. All hang-up trees shall be pulled down and be made to lie on the ground. Portions of severed tress shall not be left entwined with standing leave trees.

4. Cut trees shall be felled away from or removed from the following: traveled roads, designated trails, stock driveways, established fire-breaks, fence lines, gates, designated leave trees, culverts, and drainage ditches, perennial and intermittent streams channels.

5. All slash created by operations performed under this contract shall be removed at least 15 feet above all culvert intakes.

6. All slash created by operations performed under this contract shall be pulled back at least 5 feet from the top of road cuts and at least 2 foot beyond the traveled surface of the road prism on the fill side, for all roads as shown on the Contract Maps.

7. All slash, created by operations performed under this contract, which falls outside the unit boundaries shall be pulled back into the unit(s), unless otherwise authorized by the Forest Service.

8. All harvest and thinning slash created under this contract, not designated for hand or machine piling, shall lie within 24 inches of the ground. The boles of felled trees shall lie on the ground surface. Slash shall be lopped and bucked to meet these conditions. The 24-inch slash depth will be measured from the ground surface to the top of suspended limbs

9. Where cut trees are not designated for removal, the individual cut trees selected from among a clump of trees shall be directionally felled away from the clump into surrounding open area(s) to eliminate the accumulation of slash among the remaining leave trees. All cut trees not designated for removal shall be directionally felled in a scattered pattern and out into the open as much as possible to promote rapid

COMMERCIAL ITEM – AG-0261-S-09-9001 Mores South Stewardship Re-Issue Page 4 drying of the slash, and to maximize the distance between the felled tree crowns and adjacent leave trees. The crowns of felled trees shall be placed as far away from leave trees as possible, and as far above leave trees on the slope as conditions allow. Crowns of cut trees shall be pulled away from leave trees a minimum of 8 feet.

E. Tractor/Jammer Yarding Unmerchantable Material (Unit 8-mandatory & 27-optional)

1. Contractor shall leave tops and limbs attached to cut trees. Whole tree yarding of cut trees greater than 5 inches DBH shall occur (smaller diameter material may also be removed, but not required).

Trees shall be processed at the landing with the boles placed in appropriate decks and the slash placed in a pile at a location designated by the Forest Service. Decks shall not be stacked against standing green trees. Yarding and skidding equipment shall stay on approved skid trails and endline or winch material to skid trails. Adverse skidding and/or forwarding may be required on slopes up to 35%.

2. Skid Trails: Unless otherwise agreed in writing by the Forest Service, the Contractor shall locate and flag skid trail locations. All skid trail locations and clearing limits for landings, disposal areas and skid trails, shall be approved by the Forest Service prior to felling operations or their installation. Average skid trail spacing shall be 150 feet apart, center-to-center, unless otherwise approved by the Forest Service. Equipment shall not operate off approved trail location. Clearing and excavation shall not exceed that needed for the Contractors safe and efficient operation. Refer to Appendix B, K-F.3.4# for skid trail closure methods and K-G.4.1.1#, K-G.4.2# for utilizing skid trails.

F. Equipment Authorizations and Requirements

1. Use of motorized equipment other than hand-held equipment such as power saws and brush cutters shall not be permitted off designated roads and skid trails in the project area without prior approval of the Forest Service.

2. Work will not be permitted when, in the opinion of the Forest Service excessive soil disturbance would result from equipment usage or road/trail damage would occur from vehicles gaining access to the project area.

3. The contractor shall not alter drainage or closure structures on spur roads and skid trails in the project area(s) without the prior written approval of the Forest Service. All alterations shall be repaired or replaced prior to the next winter/rainy season or completion of the contract, whichever occurs first.

INSPECTION AND ACCEPTANCE

A. Inspections

1. The Contracting Officer shall make periodic inspections. The Contractor or his representative is encouraged to observe the inspection and will receive inspection summaries upon request.

2. Each unit as designated on the contract maps will be inspected as a separate unit and will not be averaged with any other area for acceptance or payment.

B. Inspection Plot Size and Sample

Each unit as designated on the contract maps will be inspected as a separate unit and will not be averaged with any other area for acceptance or payment. The inspections will be made of 1/20th acre plots on a systematic grid over the entire area on units where thinning is specified. Sufficient plots will be taken to total at least 2 percent of the unit being inspected. This will constitute the minimum number of plots. Plot centers will be marked and numbered on the ground. The corresponding number will be entered on the inspection report form used to record data for the plot.

C. Inspection Quality Evaluation

Each plot shall be examined to record findings on Form 2400-4 (Thinning Inspection Plot Form, Appendix A, Exhibit 3) for the items listed below:

1. ACCEPTABLE TREE AND TREES ABOVE MAXIMUM DBH (Columns 3 and 4)- Includes acceptable leave trees and trees above the maximum DBH designated for not cutting. The total of Columns 3 and 4 must not exceed the maximum acceptable trees per plot. (S1 and S2).

2. CREDIT FOR NONSTOCKED SPOTS (Column 4)- Includes the number of spots nonstocked on individual plots that are not stocked due to insufficient original stocking or a missing tree cut because of insects and disease. (S3 and S4).

3. SURPLUS TREES AND TREES SPECIES IGNORED (Column 5)- Includes surplus of acceptable trees above the maximum allowable trees per plot. (S2 and **).

4. CATEGORY "A" TREES (Columns 6 and 7)- Includes leave trees cut and leave trees left not meeting contract specifications. (A1-A5).

5. CATEGORY "B" TREES (Column 8)- Includes excess trees that should have been cut and stumps with live limbs. (B and B1).

6. CATEGORY "C" TREES (Column 9)- Includes trees not completely severed from stump, hang-up trees, high stumps, trees left with excess damage and disease, trees not girdled, and trees improperly girdled). (C1-C7).

D. Thinning Quality Calculation

Upon inspection of all plots for a unit, the quality of thinning shall be calculated as follows:

1.00 - ((Col. 6 + Col. 7 + Col. 8)/ (Col. 3 + Col. 4)) X 100 = Percent Quality

COMMERCIAL ITEM – AG-0261-S-09-9001 Mores South Stewardship Re-Issue Page 8

E. Category "B" Trees

When inspection results are below 90 percent and CATEGORY "B" TREES constitute any part of the deficiency, payment shall not be made until excess tree deficiency has been corrected. Inspections after rework will be made in the same manner as the first inspection but on different plot lines. The Contractor shall pay for inspections necessitated by the rework.

F. Category "C" Trees

The total number of CATEGORY "C" TREES shall not exceed 5 trees per acre, exception for disease (C5 - C7) where all trees shall be cut or girdled. Payment will not be made until the deficiency has been corrected and thinning quality is above the minimums. The Category "C" Trees are not included in the thinning quality calculation because these deficiencies are critical to the primary stocking and disease sanitation objectives for the thinning project.

G. Rework and Reinspection

If the original inspection results are unacceptable to the Contractor and a second inspection is requested without rework, the same inspection procedure shall be used. However, the inspection pattern will be shifted.

If the second inspection shows less than 5 percent variance from the first inspection, the Contractor shall pay the cost of the second inspection, and the result of the first inspection shall be used in determining payment.

Requests for reinspection must be made in writing within 5 calendar days.

H. Acceptance of Slash Treatment

Acceptance for slash treatment shall be determined by an inspection of the treatment areas and shall be based on adherence to the specifications for thinning slash treatment. Nonconformance with any of the specifications shall classify the treatment as unsatisfactory and rework is required to bring the treatment up to specification standards.

DELIVERIES OR PERFORMANCE

CONTRACT TIME

Contract Time Requirement by Contract Item/Sub-item

Item (or Sub-item) Estimated Beginning Date Ending Date All June 1, 2009 November 30, 2011

The Contractor shall maintain progress at a rate, which will assure completion of work within the period of performance (3 years). The count of contract time shall start on the date of contract award.

The Normal Operating season is defined as June 1 through October 31. Approval to operate outside the Normal Operating season must be approved by the Forest Service.

Ips bark beetles may be a problem within this contract area in thinning units containing ponderosa pine. If ponderosa pine trees are thinned between the period of September 15 to July 1, the Contractor may also be required to provide a continuous food chain of green trees for the Ips beetle during the period of July 1 to September 15, as a part of the thinning operation and/or be required to leave 10% of the unit(s) unthinned to provide a source of green trees for future Ips food. Such green material shall be provided from periodic cutting or thinning within the unit(s); or where such material is inadequate or not available, green material may be provided by thinning of non-included trees adjacent to the unit boundary upon approval of the Contracting Officer. Thinning outside the unit boundaries shall not exceed 10 percent of the unit's acres.

COMMERCIAL ITEM – AG-0261-S-09-9001 Mores South Stewardship Re-Issue Page 9

CONTRACT ADMINISTRATION DATA

MEASUREMENT AND PAYMENT

A. Acreage for thinning units as described on the Schedule of Items and Summary Information Charts has been estimated from on the ground measurements using GPS (geographical positioning system) methods.

B. The Contractor may at any time after award request remeasurement of any treatment area. The request must be made in writing. Remeasurement must be made within the established boundaries. If remeasurement indicates a variance of 5 percent or less, the Contractor shall pay for the actual cost of remeasurement, and no adjustment shall be made in the acreage. If remeasurement indicates a variance greater than 5 percent, payment shall be based on the remeasured acreage, and the government shall pay for the remeasurement.

C. After inspection of completed acreage, the Contracting Officer must calculate the pay rate.

1. The pay rate must be calculated by multiplying the number of acres times the contract unit price per acre when the quality of the thinning is equal or greater than 90 percent. If thinning quality is below 90 percent but not less than 80 percent a reduced payment will be made at a rate calculated by multiplying the number of acres times the actual thinning quality times the contract unit price.

No payment will be made if thinning quality is below 80 percent.

D. Payment shall be made on a completed unit basis only, unless otherwise approved in writing by the Contracting Officer.

SPECIAL CONTRACT REQUIREMENTS

PREWORK MEETING

Prior to commencement of work, the Contracting Officer shall arrange a meeting with the Contractor to discuss the contract terms and work performance requirements. Also at this meeting, such things as work progress schedule and fire prevention and suppression plans shall be developed and established in writing.

Delete 105.05 (a) and (b) and the last sentence of the second paragraph and substitute the following:

Materials produced or processed from Government lands in excess of the quantities required for performance of this contract are the property of the Government. The Government is not obligated to make reimbursement for the cost of producing these materials.

106 - Acceptance of Work 106.01_nat_us_03_29_2005

106.01 Conformity with Contract Requirements.

Delete Subsection 106.01 and substitute the following:

Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.

References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.

Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.

Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more strict.

Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.

When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.

The Government may inspect, sample, or test all work at any time before final acceptance of the project.

When the Government tests work, copies of test reports are furnished to the Contractor upon request.

Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.

Acceptable work conforming to the contract will be paid for at the contract unit bid price. Four methods of determining conformity and accepting work are described in Subsections 106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.

Remove and replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted, at no cost to the Government.

(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:

(1) Sampling method;

(2) Number of samples;

(3) Sample transport;

(4) Test procedures;

(5) Testing laboratories;

(6) Reporting;

(7) Estimated time and costs; and

(8) Validation process.

If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute. The CO will review the proposed resolution protocol and may modify it before final approval and execution.

The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol. If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.

(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:

(1) Have the work accepted at a reduced price; or

(2) Be given permission to perform corrective measures to bring the work into conformity.

The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.
