Addendum 1 – McGrath EWP 2011-1a – Alaska – AG-0150-S-12-0002

1) FAR 52.236-6 Superintendence by the Contractor states in full text: “ “At all times during performance of this contract and until the work is completed and accepted, the Contractor shall directly superintend the work or assign and have on the worksite a competent superintendent who is satisfactory to the Contracting Officer and has authority to act for the Contractor.”

The definition of Superintendent shall be: “A person who has full authority as a signatory of the contractor and who has the ability to bind the contractor legally. A designated superintendent is required on the worksite at all times during construction activities. NRCS’ primary point of contact with the Contractor will be with the on-site superintendent; therefore the superintendent is expected to devote their full attention to administration of this project. For example, the superintendent shall not operate heavy equipment, act as a mechanic, or engage in other tasks which interfere with the required duties as superintendent and/or the ability of NRCS to establish and maintain complete and uninterrupted contact with the superintendent at any time. Conducting minor activities such as surveying or similar duties may be allowed if they do not interfere with NRCS’ ability to communicate with the superintendent whenever necessary during construction activities.”

2) Posted to FedBizOpps at the same time as this addendum are the results from material tests that were performed on rock from Noir Hill Quarry. The document is titled “Exhibit #1.pdf”. These results are for informational purposes only and are being provided in response to a request during the site showing. Contractors shall understand that this information does not constitute prior approval of the Noir Hill Quarry as a material source and the contract requirements for furnishing current quality control test data on all rock materials is still in full force and effect.

3) Construction Specification 61, Section 2. Materials, fifth paragraph. states “The analysis shall be performed at the work site on a test pile of representative rock.” Work site shall be defined as the “Staging Area” as shown on sheet 2 of the drawings.

4) An erosion feature on the riverbank in the project area has exposed old wood corduroy. NRCS makes no statement as to how extensive the corduroy may be. Contractors shall perform their own due diligence in determining the extent of the corduroy. The contractor shall take care when excavating the soil around the corduroy so as to not contaminate the soil intended for earthfill with organic or other debris from the corduroy. NRCS has indicated that suitable sources of earthfill will likely be very difficult and maybe impossible to find in the vicinity of McGrath and therefore it is imperative that any otherwise suitable excavated materials not be ruined by contamination.

5) At the site showing a question was asked about Material Specification 521, and in particular if NRCS would waive the requirement that aggregate from a limestone source be washed. In consideration of this question after the site showing, NRCS realized that this issue has already been addressed in Construction Spec 61, Section 8-b-(3) and Section 8-c-(3).

6) Contractor shall coordinate and schedule with the City of McGrath when working around the City water intake. Water supply shall be preserved during construction operations as needed by the City of McGrath.

7) Contractors shall be on notice that Noir Hill Quarry is not a required source of material for this contract nor has arrangement with the quarry owner been negotiated for use on this project. At the site showing NRCS informed Contractors that during the previous phase of bank stabilization work, that contractor found unexploded ordinance in the Noir Hill Quarry left behind from a previous operator in the quarry. NRCS does not indicate through this statement that there is, or is not, additional unexploded ordinance in the Noir Hill Quarry. This statement in intended to put the contractor on notice of a history of unexploded ordinance in the quarry in an effort to make safety our first priority throughout the course of this project. It is up to Contractors to perform their own due diligence and to assure themselves that the quarry is safe to operate if they choose Noir Hill Quarry as a source of material.

8) There was a request to post the permits that have been obtained by the City of McGrath for this project. These permits have been posted to FedBizOpps at the same time as this addendum. Contractors shall note that the DNR permit is still in draft form but shall be finalized and in effect by the date of contract award.

9) Bid Packages are due Thursday 02 August 2012 at the NRCS State Office in Davis California no later than 1:00 p.m. Pacific Time. The bid opening will take place in Room 215.

a. Due to the unique nature of the geographic distance of the bid opening from most of the participants, modifications felt necessary by the contractor during the final 72 hours may be submitted via e-mail. In the event that a modification is necessary, submit the adjusted bid schedule line item number only via e-mail to john.mcclure@ca.usda.gov. Please be sure to include the line item number, the adjusted price, the name of the contracting firm, and a phone number.
