JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The Naval Facilities Engineering Command (NAVFAC) Washington.

2. Description of the Action Being Approved.

This Justification and Approval requests authorization to use other than full and open competition to award an extension modification to ADTEK ENGINEERS, INC., a small business concern, to extend the period of performance of A&E Contract N40080-15-D-0154 by six (6) months.

3. Description of Supplies/Services.

This contract is for Regional Civil and Structural A&E Services for projects generated by Field and Regional contracting activities within the NAVFAC Washington Area of Responsibility within the National Capital Region. The work may involve single or multi-story, high bay, masonry, concrete, steel, or wood and pre-engineered facilities. The facility types, may include, but are not limited to the following: child development care, general administrative spaces, dining, commissary & exchange, educational, sports & fitness, museums & memorials, training and instructional, wet labs, electronic laboratories and SCIF buildings and facilities. Anti-terrorism Force Protection (AT/FP) considerations are required for all projects, including familiarity with UFC - DoD Minimum Antiterrorism Standards for Buildings (most recent version), and demonstrated experience designing SCIF buildings, renovated buildings that incorporate progressive collapse design features, Intrusion Detection System and related features, and familiarity with Navy/DoD related criteria is required. Sustainable design systems, materials and components are required during the design and engineering work for projects.

Issued Task Orders will provide A&E civil and structural pre-award and post-award services that support Navy, Air Force and Marine Corps’ executive and tactical missions within the National Capital Region.

The total award amount during the extended period of performance is $0, and does not change the total contract value of $30,000,000. The contract has utilized and has a remaining capacity of . The Government will use the remaining capacity to execute FY20 and FY21 O&MN Funds.

The proposed Period of Performance is 18 May 2020 – 18 November 2020.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S. C 2304 (c) (2), Unusual and Compelling Urgency, as implemented by Federal Acquisitions Regulation (FAR) 6.302-2.

5. Rationale Justifying Use of Cited Statutory Authority.

The Regional A&E Civil and Structural Services contract, which was a competed procurement, provides A&E technical reports, investigation, studies and design services to NAVFAC Washington for a variety of planned construction projects slated for award using FY20 O&MN funds. The contract also provides critical Post-Award Construction A&E Services (PCAS) support as the Designer of Record (DOR) for on-going construction projects. The follow-on procurement has experienced significant delays in the slate/selection process. As a result, the need for a sole source bridge contract arose to avoid a possible lapse in providing A&E Civil and Structural services to NAVFAC Washington contracting sites for their programmed FY20 end-of-year awards; as well as PCAS services for construction projects currently underway. The services provided by this contract are slated for use on five (5) design projects in pre-award status, that are scheduled to be awarded by 30 September 2020. Loss of the use of this contract after 17 May 2020 will jeopardize the Government’s access and use of budgeted FY20 O&MN funds committed to pending A&E Task Orders in the estimated amount of . This is the amount of FY20 O&MN funds that the Government will lose from non-obligation of the projects that have yet to be awarded (listed below). Additionally, there are six (5) projects that are actively utilizing PCAS support from this vendor, and one PCAS action is in the process of being awarded. The loss of access to the DOR for PCAS support for these construction projects will cause design integrity issues for those projects. Lack of continued access to the DOR will cause costly delays to the construction schedule, while alternate means of addressing construction issues are established and implemented without the DOR’s input. Specifically, the loss of this contract’s service will negatively impact the following projects:

The new projects have critical Executive and tactical mission requirements that must be supported. Awarding a six-month bridge to the incumbent contractor before the approaching contract completion date makes this an urgent and compelling request for approval. Failure to extend the period of performance will cause the Government a significant loss of access to a minimum of in FY20 O&MN funds and will have daily financial impact to at least six ongoing construction projects.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

NAVFAC Washington posted the original solicitation for these services to FEDBIZOPS on 11 July 2013 as a competitive Small Business Set-Aside. The agency also synopsized and made available the follow-on contract that is currently in the pre-award process as a competitive small business set-aside. Due to the urgent and compelling nature of this extension action, the Agency did not synopsize this extension. Approval and award of this action by 17 May 2020 is necessary.

In accordance with FAR 5.202(a)(2), a synopsis is not required when the contract is made due to unusual and compelling urgency conditions and the Government would be seriously injured if it complied the requisite time periods.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the cost of services covered in this J &A to be fair and reasonable. Pricing remains the same during the extension period.

8. Actions to Remove Barriers to Future Competition.

NAVFAC Washington ensured the requirements for the follow-on contract were solicited using a competitive procurement as the acquisition strategy, and will take all reasonable measures to prevent the future use of bridge actions. NAVFAC Washington commenced the procurement process for the follow-on contract in June 2019, and is on track for award in November 2020.

That requirement contains performance specifications that supports competition for the same services, and has received good competition with the responses.
