About this file

The document provided is a Brand Name Determination from the Oregon State Police (OSP) justifying the use of a brand name specification for flat-panel X-ray equipment. OSP uses this equipment to obtain X-ray images of improvised explosive devices (IEDs) in fast-moving tactical environments. OSP has previously utilized the ADS FPX Nano with Integrated Display equipment and desires to continue using this brand to maintain operational continuity. The total estimated cost for this equipment is $35,000.

The related state and local contract opportunity is an RFQ for one (1) ADS, Inc. FPX Nano X-Ray Processor with Digital Display and Soft Case. The jurisdictions involved in this opportunity are Marion County and the City of Salem. The Brand Name Determination indicates that the use of a brand name specification is justified due to cost savings, as market research shows that at least one other brand of flat-panel X-ray equipment is more expensive, as well as the need for efficient utilization of existing supplies and to maintain operational continuity.

DETERMINATION

Brand Name Specification

PART A. Requesting Agency must complete items 1 through 9.

1. Agency Name: Oregon State Police

2. Date: 2/22/2022 3. Agency Number: 25700

4. Agency Contact Name: Matt Monaghan 5. Phone: 503-378-2276

6. Total Estimated Cost: $35,000

7. Brand Name to be Acquired: ADS, Inc.; FPX Nano with Integrated Display.

8. Background: The Oregon State Police uses Flat-Panel X-Ray equipment for obtaining x-ray images of improvised explosives devices (IEDs) (or suspected IEDs) in fast moving tactical environments involving explosive threats to human life and/or property. OSP has utilized the ADS FPX Nano with Integrated Display equipment in its operations and desires this brand to maintain operational continuity.

9. Findings that satisfy the required standards based on one or more of the following (a-d) pursuant to

OAR 125-247-0691(2).

Agency determines that:

(a) Use of a Brand Name Specification is unlikely to encourage favoritism in the awarding of Public Contracts or substantially diminish competition for Public Contracts because:

(b) Use of a Brand Name Specification will result in substantial cost savings to the contracting agency because:

Market research from previous solicitations shows that at least one other brand of flat-panel X-ray equipment is more expensive.

(c) There is only one manufacturer or seller of the product of the quality, performance or functionality required because:

(d) Efficient utilization of existing Supplies/Goods requires the acquisition of compatible Goods or Services because:
