About this file

This is Addendum One to Request for Bid No. RFB-97-25 issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration for the Cool Springs Road Highwall (AML) Reclamation Project in Ohio County, Kentucky. The project encompasses abandoned mine land (AML) reclamation work involving site preparation, erosion control, vegetation establishment, and infrastructure improvements across 42 acres. The bid schedule includes 27 line items with quantities ranging from lump sum services (mobilization at $75,000, utility relocation at $10,000) to substantial earthwork of 585,000 cubic yards, materials such as 1,050 tons of agricultural limestone and 3,360 pounds of seed, and equipment rental for 50 hours of excavator service with hoe ram attachment. A site visit was conducted on October 4th to address bidder questions regarding project requirements and specifications.

Key project clarifications include that the highwall area qualifies as an unstable zone exempt from forest dwelling bat clearing restrictions, permitting clearing activities concurrent with work progress. Timber removal is restricted without written consent from the Kentucky Department of Fish and Wildlife Resources, which has not been secured; contractors must base bids on the assumption that no timber salvage value will be realized, though timber may be stockpiled on-site as an alternative to burning or windrowing. Windrow placement must comply with AML technical specifications, creating rolled piles not exceeding 10 feet in height with breaks greater than 20 feet for every 30 feet of material, with logs exceeding 8 inches in diameter stacked in parallel piles. Bidders must utilize the revised bid schedule and reference additional specifications and drawing addenda to be distributed by Lynn Imaging.

REQUEST FOR BID NO. RFB-97-25 Cool Springs Road Highwall - Addendum 1

At the site visit on October 4th, these items were discussed and/or these questions were asked or have been submitted by email.

1. The highwall area is considered an unstable area and thus exempt from clearing related to the forest dwelling bat restrictions and can be cleared as the work progresses.

2. Can timber be removed from the site instead of burning or windrowing the timber?

Timber is considered as material having a salvage value. The Kentucky Department of Fish and Wildlife Resources (KDFWR) has not waived their claim to the timber in the project limits. The contractor cannot harvest the timber without written consent of KDFWR. KY AML has not secured written consent to harvest the timber from KDFWR. Salvage value of materials is discussed in the General Provisions of the AML Technical Specification under Section 10 – Property Owner Consideration. The timber can be stockpiled on site instead of burning or windrowing, but the contractor shall base their bid on not being able to market any timber.

3. What are the requirements for windrowing or burning trees and brush? The contractor can choose windrowing or burning. Windrows will be placed near the exterior perimeter of the work areas. All work shall comply with the “Site Preparation” section of the Standard AML Technical Specifications which says.

4.2. Windrowing: Create rolled piles generally not exceeding 10 feet tall and with breaks of greater than 20 feet for every 30 feet of windrowed material. Stack logs >8 inches in diameter in parallel piles in lengths <20 feet. Cut small tree-tops and smaller trees into maximum <6 feet lengths and stack in separate parallel piles not to exceed 6 feet in height.

Place tree stumps in front of the windrow in an upright position. Do not leave this material in a manner that will create erosion problems or an aesthetically unpleasing feature.

4.3. Burning: Accomplish open burning in strict accordance with current Kentucky Division of Forestry rules and precautions and then only with the approval and under the direction of the ENGINEER. The ENGINEER'S permission to burn and/or his presence at the site shall not be construed as relieving the CONTRACTOR of any responsibility in the event damage occurs or a citizen's complaint arises. The COMMONWEALTH accepts no responsibility for damage or costs associated with burning operations. Before burning, obtain the consent of the landowner on which burning is to be performed, notify adjacent landowners, and use “reasonable precautions" to prevent the escape of fire to adjoining lands.

4. Stumps can be left in the bottom of the pits and on the highwall face, as necessary.

5. Can Hydroseeding/Hydro-mulching be used? Agricultural Limestone and Fertilizer shall be spread conventionally. During the months of April, May, September and October, Hydro-seeding and Hydro-mulch may be substituted at an equivalent cost for Bid Items 23-Seed, Item 24-Mulch-Straw & Hay, and Item 25-Crimping and shall meet additional AML Specifications for Hydro-seeding.

6. Water samples were taken recently in two of the pits in or partially in the project limits.

Pit at Station 10+50 …. Iron – 0 mg/l, pH-7.8, Sulfates +/- 175 mg/L.

Pit at Station 14+50 …. Iron – 0 mg/l, pH-7.7, Sulfates +/- 175 mg/L.

7. The Earthwork Bid Item for 585,000 CY is a Plan Quantity item. The intention is to pay for the Plan Quantity Volume unless significant revisions are made to the project as construction proceeds. A revised bid schedule further clarifies that the Earthwork Bid Item is Plan Quantity (P.Q.). It is the Contractors responsibility to construct the project to the grade lines shown in the plans and cross sections. The Contractor shall provide necessary surveying and grade staking to mark project limits for clearing and constructing the project according to the proposed grades. The project baseline will be fully marked by AML employees in the field prior to construction.

8. CAD files will not be available prior to the bid but can be made available to the low bidder after the Contract is awarded.

9. Will there be standard details and specs for bid items, #12 Vegetative Brush-Mat Ditch and #16 Valley-Wide Grade Control Structure? No technical drawing has been provided for #12 Vegetative Brush-Mat Ditch. It is described in the project description as “In lieu of some ECB ditches, ditches incorporated with tree brush will be utilized. These “vegetative brush-mat ditches” will utilize tops and cuttings of trees from the site preparation and incorporate that material as a vegetative mat. This material should be cut in varying lengths but generally no longer that 20 ft. The maximum diameter should be 4-5 inches. The brush material should cover about 20-25 % of the surface area of the ditch, with approximately 1/3 of the material buried up to 1 foot deep, 1/3 of the material on the surface and 1/3 of the material protruding above the ditch up to 1 foot height. Construction methods may vary, but it is anticipated, an excavator, a small dozer and/or a skid steer with grapple will be required to construct these ditches.”

For #16 Valley-Wide Grade Control Structure, a detailed drawing is provided on page 4 of the Drawings.

10. Does Buy American apply to this project? Yes, it does apply to this project.
