1. The following examples are given to clarify payment for earthwork and grade work:

a. Example 1: 5000 cubic yards are excavated from the northern spoil area where the baseline and cross sections are provided, then transported ¾ of a mile by truck and spread on a barren refuse area that is 2 acres in size.

i. Payment would be made for:

5000 cubic yards for MINE SPOIL EXCAVATION 5000 cubic yards for COVER MATERIAL FOR REFUSE AREAS 5000 cubic yards for TRUCK HAULING YARDAGE SURCHARGE 2 acres for GRADEWORK MINE REFUSE/SPOIL Along with site prep and other revegetation items.

b. Example 2: 3000 cubic yards are excavated from a southern borrow area, then transported 1/4 of a mile by truck and spread on a barren refuse area that is 1 acre in size.

i. Payment would be made for:

3000 cubic yards for COVER MATERIAL FOR REFUSE AREAS 1 acre for GRADEWORK MINE REFUSE/SPOIL Along with site prep and other revegetation items.

c. Example 3: 4000 cubic yards are excavated from a central borrow area, then transported 1/3 of a mile by truck, crossing Henry Oats Road, and spread on a barren refuse area that is 1.5 acres in size.

i. Payment would be made for:

4000 cubic yards for COVER MATERIAL FOR REFUSE AREAS 4000 cubic yards for TRUCK HAULING YARDAGE SURCHARGE (because the yardage is transported across Henry Oats Road)

1.5 acres for GRADEWORK MINE REFUSE/SPOIL Along with site prep and other revegetation items.

d. Example 4: 6000 cubic yards are excavated from trenches in an area designated as GRADEWORK- FLIP AND COVER that is 2 acres in size. Refuse is buried in the trenches, and excavated material is used as cover material.

i. Payment would be made for:

2 acres for GRADEWORK-FLIP AND COVER Along with site prep and other revegetation items.

2. The contractor must use 811 services for locating all utilities. Buried gas lines are located within the project area. The contractor must contact the local gas company and obtain further directions for load limits on areas containing gas lines. The contractor should anticipate restrictions on weight and load limits, a requirement to use steel plates or swamp pads for crossings, and use of low ground pressure equipment to spread cover material. No additional payment will be made for meeting requirements placed by the gas company.

3. Tree clearing and grade work in the northern mine spoil area shall be delayed until November 30, 2026.

4. QUESTION: The contractor is responsible to provide fire suppression water – can this water be obtained from the ponds in the nearby Wildlife Management Area? The ponds would have to be within the 180-acre project footprint and would have to have a minimum pH of 6.0. The contractor can, on his own, secure other water sources oƯ site but must provide documentation and proof of landowner consent.

5. QUESTION: I noticed a travel trailer and lean-to covering that will make it impossible to have truck traƯic through that area – will this be removed prior to start of site work? No, the items mentioned will not be removed. Dust control is the responsibility of the contractor.

6. QUESTION: Will the bid due date be extended? An addendum was mentioned during the site walk, but nothing has been issued yet. The bid date will not be extended. Bids open on September 1, 2026.

7. QUESTION: During the site visit it was stated that no oƯ-site materials would be needed for the project but there are bid items for stone, yet no stone placement was discussed during the walk. Can you clarify? The comment regarding no oƯ-site materials was regarding borrow material and/or cover material. There are multiple items that must be brought in from oƯsite which include Class II channel lining, Agricultural limestone, Limestone Sand etc. Class II ditches shall be constructed as shown on the plans or as directed by the engineer during construction.

8. QUESTION: After the 5,000 gallons of water are treated to a pH of 6 or above - can this water then be discharged onsite? There is no reference to 5,000 gallons of water. Treated water can be discharged on-site.

9. QUESTION: Can we distribute/broadcast wood chips and associated vegetative debris on site as we clear brush, or does it have to be removed from the site? Woody material cleared during site preparation can be windrowed, burned or chipped and can be left on site.

10. QUESTION: There isn’t a line item for the cost of the bid bond and P&P bonds – should this cost be included in Mobilization? There is no line item/pay item for this. The contractor should break out the cost of the bonds over all the lines on the bid schedule.

11. QUESTION: Will a map be provided for clarification of flip and cover or Coarse Refuse Grade work? No, there is not suƯicient geotechnical data to make that determination. These areas will be delineated in the field as excavation pits are dug. If total acreages need to be modified, they will be adjusted by change order.

12. QUESTION: Will Bituminous Subgrade Repair be added as an additional line item? No, the contractor should refer to the AML Technical Specifications for Bituminous Repair and consider if materials will be hauled on Henry Oats Road from the South or from the North as he prepares his bid and whether his hauling patterns will damage subgrade.

13. QUESTION: Will Asphalt work category be included in the Davis Bacon Wages? The CONTRACTOR and all SUBCONTRACTORS are required to pay scale wages as defined in the contract documents. If all employment categories that may be used have not been listed and specified in the contract document, then the contractor must make his best determination of what the missing wage rate will be. Subsequently after the bid is awarded, the contractor must request the specific rate from the Department of Labor. AML will not issue change orders for additional compensation if the wage rate determined by DOL is higher than the rate the contractor used to develop his bid. If wage rates are not included for a specific category, AML suggests that the contractor assumes the highest operator or laborer wages that are listed when developing his bid.

14. The following color shade lidar image of the northern mine refuse area is provided as requested.
