About this file
This Addendum One document is issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, in conjunction with the Energy and Environment Cabinet's Department for Natural Resources, Division of Abandoned Mine Lands (DAML). The invitation to bid (RFB-176-26) is for the 23117 AMLBAML AML Project located in Pike County, Kentucky, addressing abandoned mine land reclamation and acid mine drainage abatement at the Scott Hopkins residence and surrounding properties. The project encompasses 8.6 acres with 4 acres of expected disturbance at the primary site and 2.2 acres with 1 acre of expected disturbance at an offsite waste area. The bid schedule includes 42 line items ranging from mobilization and utility relocation to portal closures, drainage control structures, revegetation, and road repairs, with quantities specified for each item including linear feet, tons, acres, cubic yards, and individual units. The official bid date has been moved to February 10, 2026, at 9:30 A.M. Eastern Time. Bidders must use the Revised Bid Schedule dated 1/28/2026. All work shall be completed within 180 calendar days from the effective date of contract award.
The bid schedule establishes unit prices with Allowable Price Limits (APL) for most line items, with several items priced as lump sum (mobilization at $30,000, utility relocation and landscape allowance at $1.00 each, and structure removal/replacement at $1.00 each). Pricing follows unit price, plan quantity, and lump sum methods of payment. Contractors must submit the AML Contractor/Subcontractor Information Form with their bid or face non-responsive status. Davis Bacon scale wages are required for all contractor and subcontractor employees. DAML is responsible for obtaining KYTC Encroachment Permits, KY DOW Water Permits, and USACE permits, while contractors bear responsibility for all other permits and fees necessary to begin the project. The project includes comprehensive erosion prevention and sediment control Best Management Practices (BMPs), with specific provisions for site access, clearing and grubbing, stream crossings, mine water testing and treatment, and post-construction maintenance for up to three years pending available funding. Property owners may require contractors to add them as additional insureds on general liability and automobile insurance policies, with any associated costs being incidental to mobilization.

23117AMLBAML AML PROJECT
PIKE COUNTY
The address is 1664 Frozen Creek, Racoon, KY 41557, the coordinates are 37.4842, -
82.4500. From Prestonsburg, merge onto KY-80E/US-460E toward Pikeville for 19.2 miles, then turn left onto 119N for 2 miles, take the right lane onto the 1426 /Burning Fork/ Zebulon/ Exit Ramp for 1.7 miles, turn right onto KY-1441N for 2.6 miles, then turn right onto Frozen Creek Road; Two story cedar home with concrete drive on the right. The waste area is located off of US-119. The coordinates are 37.5125, -82.4796.
Project limits include 8.6 acres, with an expected disturbance of 4 acres within project boundaries. Project limits for the offsite waste area includes 2.2 acres, with an expected disturbance of 1 acre.
The problem areas consist of multiple locations beginning with the Scott Hopkins residence. the house is situated approximately 3' feet from the toe of what appears to be an old coal refuse dump. Remnants of coal and slate are visible on the entire area and water is being emitted from the several locations throughout the property. Located to the left of the Hopkins' Residence is Nancy Fields residence. The property is being impacted from water drainage, a small slide and saturation. Visible mold and pooling water are present in the crawlspace of her home. Situated to the right of Mr. Hopkins, neighbors Todd & Alesha Arnett also suffer from water drainage which necessitates continuous ditch maintenance, unmanageable wet lawns, and erosion.
Constant water drainage is creating multiple adverse conditions on the Hopkins' residence as well as the surrounding neighbor’s properties. Wet and muddy conditions are immediately noticed on all three properties. The lawns are soft and wet to walk on and some pooling water was noticed behind the Hopkins' and Fields' residences. Wet conditions have created an environment for mold to develop under Ms. Fields' house in the crawlspace. Just above the Hopkins' driveway a previous slide had occurred which required the homeowner to hire a contractor to clean up. Water drainage from mine openings/mine bench located above is deposited into the Frozen Creek Branch water shed.
There is a significant amount of water that is draining from the mine bench causing problems (small slides, mold, drainage, etc.) the proposed plans is to control the water and get it into Frozen creek which is across the road. Access to the bench will be via the gravel driveway down the road from the residence, used to access another residence at the bench level. Several portals will receive closures, with 3 wildlife accessible closures and two non-wildlife closures of wet portals that will have the drainage captured into the installed subdrain. At this residence, there is drainage from behind the driveway from an old closed portal which is saturating the area and flowing along the driveway. Water has also caused a small slip on the hill adjacent to the drive. This material will be removed and a rock toe buttress installed to stabilize the hill above the road. Approximately 600LF of ditchline will be installed along this drive and up to the portal.
A minimum number of trees greater than 3” diameter will be cut. If required, AML will elect to make a payment to the Imperiled Bat Conservation Fund in accordance with a determination from USFWS. Within the stable area, a maximum total of 1.0 acres of trees will be disturbed for bench access and for the installation of the ditches. No trees will be disturbed at the waste area.
The strict implementation and enforcement of standard AML sediment and erosion control Best Management Practices (BMPs) will prevent significant amounts of sediments disturbed by project related activities from entering area streams to create indirect impacts to aquatic resources. All disturbed areas will be promptly revegetated at the end of construction using lime, fertilizer, residential or wildlife seed, and mulch, in accordance with AML standards and specifications.
Access to the site is via state and county roads, a residentially maintained driveway and yard, and a constructed access road. This project will include pre- and/or post- project maintenance and repair of existing previously constructed public county roads utilized during the construction of this project, which are administered by the county or local road authority. This construction activity will be conducted under the authority and supervision of the local public road authority and will consist of standard road construction practices appropriate to mitigate impacts to the local community from potential degraded road conditions in order to maintain public traffic safety

Revised 12/11/2024
COR & BID & BMP 1
23117AMLBAML RECLAMATION PROJECT
PIKE COUNTY, KENTUCKY
The address is 1664 Frozen Creek, Racoon, KY 41557, the coordinates are 37.4842, -82.4500. Project limits include 8.6 acres, with an expected disturbance of 4 acres within project boundaries. Project limits for the offsite waste area includes 2.2 acres, with an expected disturbance of 1 acre.
Drainage controls will be installed on the bench and at the house level. A small block wall will be installed behind one home to stabilize a small slide and handle drainage.
A. STANDARD DOCUMENTS
The AML Standard Details and Technical Specifications are posted on the Division’s website at https://eec.ky.gov/aml
Once on the web page, please click “Contractor Information” tab located on the right side. AML standard technical specification and detail are located under this tab. Contractors are strongly encouraged to review the complete AML website for additional information.
B. ALLOWABLE PRICE LIMIT
The lowest Allowable Price Limit (APL) is listed on the Bid Schedule as part of the bid documents. Unit
Price, Plan Quantity, and Lump Sum are all methods of payment. Significantly low or high values entered by the CONTRACTOR on the Bid Schedule may be considered an unbalanced bid and may have to be justified in writing if such bid is deemed the low responsive bid.
An example would be if a CONTRACTOR assumes there may not be a need for the entire design quantity for Roadway Stone and entered a $10 value for Roadway Stone when the cost at the quarry is significantly higher. Another example would be if the CONTRACTOR enters a value of $30 per linear foot for “SILT BARRIER - BALES & FENCE” to front load payments for work items used near the beginning of the project. The CONTRACTOR is also cautioned that other considerations for rejection may be enforced such as the low bid being higher than the budgeted dollar amount for this project.
C. CONTRACT LENGTH
All work shall be completed within one-hundred eighty (180) calendar days from the effective date of the
Award of Contract. Within the bounds of prudent project performance, it shall be the responsibility of the
CONTRACTOR to plan and implement construction sequences which follow the intent of these
CONTRACT DOCUMENTS, particularly as, reflected in the Drawings and Special Conditions and to protect any portion of the contract which may be completed before others.
https://eec.ky.gov/aml
COR & BID & BMP 2
D. CONTRACTOR’S INFORMATION SHEET
The AML CONTRACTOR/SUBCONTRACTOR INFORMATION FORM sheet must be filled out and submitted with the bid. Failure to submit the AML Contractor/Subcontractor Information Form sheet with the bid will be the basis for declaring the bid “Non-Responsive.”
E. SPECIAL CONDITIONS & PROJECT NOTES
- When applicable, AML is responsible for payment to the Imperiled Bat Conservation Fund
(IBCF). The CONTRACTOR will be responsible for adhering to the boundary for which payment was made and confirming with AML the acreage of trees removed.
- On occasion, a property owner may require a CONTRACTOR to add them on their General
Liability and/or Automobile Insurance as an “Additional Insured.” AML will inform the
CONTRACTOR when this requirement is being made by the property owner. In these cases, the
CONTRACTOR must submit to AML copies of their certificate of insurance documenting the
“Additional Insured” before they will be allowed to mobilize equipment and forces on to said properties. Any fees, rate increases, or other costs incurred by the CONTRACTOR for this requirement, if any, will be considered incidental to mobilization and as such no compensation will be made by AML. The “Additional Insured” must remain on the CONTRACTOR’s policy(s) for the full length of the contract.
F. DAVIS BACON SCALE WAGES
The CONTRACTOR and all SUBCONTRACTORS are required to pay scale wages as defined in the contract documents. If all employment categories that may be used have not been listed and specified in the contract document, then the contractor must make his best determination of what the missing wage rate will be. Subsequently after the bid is awarded, the contractor must request the specific rate from the
Department of Labor. AML will not issue change orders for additional compensation if the wage rate determined by DOL is higher than the rate the contractor used to develop his bid. If wage rates are not included for a specific category, AML suggests that the contractor assume the highest operator or laborer wages that are listed when developing his bid.
G. PERMITS & FEES – AML will be responsible for obtaining any permits that are checked below.
(Check all that apply)
☒KYTC Encroachment Permit
☒KY DOW Water Permits
☒USACE Permit
The CONTRACTOR is responsible for all other permits and/or fees necessary to begin the project. The
CONTRACTOR is advised that on occasion, other permits and/or fees may be required by federal, state, and local government(s). Other types of permits and/or fees are not the responsibility of AML and as such, these will be the complete and total responsibility of the CONTRACTOR to obtain. These must be
COR & BID & BMP 3
obtained before AML will allow mobilization of equipment and forces on to said properties. All costs associated with other permits or fees will be the responsibility of the CONTRACTOR. Please refer to
“General Provisions” in the AML Technical Specifications.
