1. Page GP 35 says: “The contractor shall procure at his own expense such permits, licenses, insurance and governmental approval as may be necessary in order to comply with Federal, State and local laws, ordinances and regulation in performance of the work.” Please provide a list of all permits, licenses and government approvals required for this project. State-required permits already obtained by MTA will be added to Appendix E of the Contract Specifications in addendum #4. It is the Contractor’s responsibility to identify and obtain permits from local jurisdictions.
2. In the Insurance Requirements - Pages IR 1 through 4 indicate the OCOP will not apply to this project and that the contractor will be responsible of all insurance cost with the exception of Railroad Protect if required. On page SP-4 In the Summary of Work, article 1.8 says “MDOT MTA has chosen to provide Workers' Compensation, General Liability, Excess Liability, Builders Risk, Pollution Liability and Railroad Protective coverage on behalf of contractors and subcontractors working on this project. Please advise the insurance status for this project?
This is an OCIP eligible project. IR 1-4 has been removed.
3. If this is not an OCIP project, do we still need to complete and turn in the AON Form-3 or an Insurance Cost Worksheet?
Please complete as instructed.
4. Page NTC 7 of 9 says “The bidder with his own forces shall perform not less than fifty percent (50%) of the work at the project site.” Page SP-10 says “Execute on the site, with its own organization, work equivalent to at least seventy five percent (75%) of the total amount of the Contract price.” Please advise. Use 50% per the General Provisions. The specification will be revised to show 50% in addendum #4.
5. Page SP-168 list the “Qualification of Procedure Specification – Test Welds:” This qualification testing will cost more than all the field welds on this project. If our weld crews are already MTA certified and currently performing welds for the MTA, can this specification be waived? Yes, if the qualification documents are submitted and approved by MTA CMD.
6. Page SP-211 says “Existing timber ties removed from the tracks and collected from areas adjacent to the tracks shall become the property of the Contractor and shall be removed from the railroad right-of-way and be disposed of at an approved disposal site as specified herein and in accordance with Section 02 24 00, Environmental Assessment.” Please confirm that we are only responsible for the old ties that we generate from our work. If we are responsible to pick up and dispose of existing old ties scattered along the right of way, please provide an exact quantity and a unit price item added to the bid sheet. Contractor is responsible for removing only those ties generated by his work.
7. Please confirm if the MTA Environmental Manager is going to continue to direct & sole-source all tie and timber disposal to Zwicky Processing and Recycling in Fleetwood, PA?; despite the submission of [by the contractor] and approval [by MTA Engineering] of other disposal sites that are qualified to accept creosote ties and timbers. There is no sole-source crosstie disposal location specified in this contract. Contractor may dispose of old crossties at an approved disposal site in accordance with Specification Section 34 11 33.17, Section 3.3, of the Contract Specifications.
8. Will subcontractors not working on the rail be required MTA RWP training before performing their portion of work? Contractors and subcontractors working on any portion of the right-of-way within 25 feet of the track are required to have RWP certification from either the CSXT or Norfolk Southern RWP training programs which is not offered by MTA. Contractor subcontractors only delivering materials to the site are exempt.
9. When asked to furnish contingent timber crossties (21 EA) what happens if additional ties are required? If the 21 EA are not all utilized, will they become the property of the Administration? In accordance with Specification Section 34 11 33.17, Paragraph 3.2 A., contingent timber crossties shall only be furnished and installed at the direction of the Engineer. Per Paragraph 4.1 B, they will only be paid for complete, in place and accepted.
10. For Item No. 016 Remove and Replace Selected Timber Grade Crossing Panels, per the drawing the Engineer will decide which panels will be changed out. Can the Engineer decide prior to bid in order to procure what will actually be required? The timber crossing panels to be replaced at Railroad Avenue and Brierley Mill Road grade crossings have been marked and identified with orange paint by the Engineer.
11. How will the rubber rail seal shown in drawings be paid for? Per Specification Section 32 12 16.15, Paragraph 4.1 B., they are included in the per square yard unit price of the crossing.
12. For all Furnish Contingent Items, if not utilized will they be paid in full and turned over to the Administration? No. Only items installed complete, in place and accepted items will be paid for.

15. What is the manufacture and specification for the Timber Panels we are to replace and do you have a drawing of the Panels? No drawings or manufacturer information is available. These are industry standard items. The contractor will be required to verify the dimensions of the timber panels at Railroad Avenue and Brierley Mill Road.

21. Does work sequence B need to be completed before C and then C completed before D and so on? No. Crossings may be done in any order.
22. If a work sequence such as C has two crossings referenced, can both crossings be shut down at the same time. Only if approved by MDOT MTA, MDOT SHA, and local jurisdictions, and if MOT Detour plans do not conflict. See General Requirements on Drawing No. G-06.
23. Are there any drawings or proposed details of the at-grade crossings included in the bid documents? There weren’t any in the Invitation to Bid document. Interested parties must sign a non-disclosure agreement with MTA in order to obtain copies of the Contract Drawings.
24. “Upon review of the SMC Vendor Quote itemized description for paving, we noticed that item Number 029 – for the 2” hot mix asphalt overlay and item Number 032A, Sub hot mix asphalt grade crossing, were presented in square yards instead of tons. This is not the typical unit of measure for asphalt, as asphalt is usually bid by the ton. Do you know if this was an error? Please let us know if it is or is not correct.” The item is correct in square yards as shown.

B. The presence or absence of the Engineer or his inspectors will not relieve the Contractor from the requirements of the Contract.
C. Upon failure of the Contractor to comply with any of the requirements of the Contract Drawings, Specifications, or other Contract Documents, the Engineer may stop any operation of the Contractor affected by such failure until the failure is corrected. Time lost during such work stoppage will be

T- 1926-0150 ADDENDUM NO. 4 SP - 9
regarded as Contract time for which no extension will be granted and no increase in cost to the Contactor caused by the stoppage shall be subject to claim against the Administration.
D. The authorized representatives of public and private utilities, and other agencies, have the right to inspect their facilities, communicating through the Engineer as follows:
1. Inspection or supervision of work by utility forces and utility’s contractors.
2. Inspection of work by MDOT MTA Contractors on, or adjacent to, utility facilities.
3. Access to the site of construction and the right to inspect all project works by the U.S. Government.
E. In the event that the Contractor’s work endangers utility property or facilities, the utility’s representative shall immediately inform the Engineer of the impending hazard. When time does not permit this action, the utility representative is authorized to stop such work until the Engineer is present, or until safety of the utility property is ensured. Any such stop order is to be delivered to the Contractor’s representative in writing (any handwritten note with date, time and inspector’s signature is acceptable), and the Contactor shall report in writing and explain the stop order to the Engineer at the earliest opportunity.
F. Highway and roadway facilities, which may be affected, are considered for the purpose herein as utility facilities.
G. The Engineer is not authorized to render final decisions under SECTION
5.15 “Disputes” of the General Provisions, nor can they render a final determination concerning the existence of a differing site condition under SECTION 4.05 “Differing Site Conditions” of the General Provisions.
1.2 CONTRACTOR REPRESENTATIVES:
A. Designate in Writing within five days after receiving the Notice to
Proceed (NTP) of each Contract, the name, official mailing address, email address, and telephone number of the Contractor's representative having complete authority to represent and to act for the Contractor. The representative shall be authorized to receive and execute instructions from the Engineer. The Contractor’s representative shall supervise and direct the construction. Such representative will not be required to be on the site of work at all times but shall be available when required by either the Engineer or requirements of work.
B. If the performance of the Contractor’s authorized representative is not satisfactory to the Engineer, the Contractor shall replace them within ten days following notification with a person determined to be satisfactory.
CONTRACT TERMS AND CONDITIONS 01 13 00 - 3
T- 1926-0150 ADDENDUM NO. 4 SP - 10
C. No separate payment will be made for the Contractor’s authorized representative. The cost shall be incidental to the various pay items included in or added to the Contract.
1.3 WORK TO BE PERFORMED BY THE CONTRACTOR’S STAFF:
A. Execute on the site, with its own organization, work equivalent to at least seventy fivefifty percent (7550%) of the total amount of the Contract price. The cost of work performed by skilled and unskilled labor carried on the Contractor’s own payroll, together with the cost of materials installed, maybe included in the above percentages.
B. If, during the progress of the work thereunder, the Contractor requests a reduction in such percentages and the Engineer determines that it would be to the MDOT MTA’s advantage, the percentage of the work required to be performed by the Contractor may be reduced provided written approval of such reduction is obtained by the Contractor from the Engineer or their designated representative prior to the beginning of work on a Contract.
1.4 SUBCONTRACTS
A. The divisions or sections of the Specifications are not intended to control the Contractor in dividing the work among subcontractors, or to limit the work performed by trade.
B. Do not enter into subcontracts totaling in amount more than the percentage of the total contract price permissible under Paragraph 1. 3 above, “Work to be Performed by the Contractor’s Staff”, without written permission from the Engineer.
C. Before entering into any subcontracts, submit a written statement to the Engineer or their designated representative giving the name and address of the proposed subcontractor, the portion of the work and material that they are to perform and finish, and any other information tending to prove that the proposed subcontractor has the necessary facilities, skill, integrity, past experience, and financial resources to perform the work in accordance with the terms and conditions of the Contract.
D. If the Engineer or their designated representative finds that the proposed subcontractor is qualified, they will notify the Contractor within ten days.
If the determination is to the contrary, however, the Engineer or their representative will, within ten days, notify the Contractor who may thereupon submit the name of another proposed subcontractor unless they decide to do the work themselves.
E. The Engineer’s approval of the subcontractor shall not relieve the Contractor of any of their responsibilities, duties, and liabilities thereunder. The Contractor shall be solely responsible to the MDOT MTA for the acts or defaults of their subcontractors and of such subcontractors’ officers, agents, and employees of the Contractor to the extent of their subcontractor. Assume responsibility for the coordination of the work of the trades, subcontractors and material.
CONTRACT TERMS AND CONDITIONS 01 13 00 - 4
T- 1926-0150 ADDENDUM NO. 4 SP - 11
F. No subcontractor shall be permitted to perform work at the site until the subcontractor is in compliance with the provisions of “Indemnities and Insurance” of the Contract Specifications and has furnished satisfactory evidence of insurance as required.
G. Promptly, upon request, file with the Engineer a conformed copy of the subcontract, with the price and terms of payment deleted.
1.5 PAYMENT
A. This is an indefinite quantity Contract for supplies and services for the period specified.
B. Submit for each Contract, a monthly Progress Payment Request for the services actually performed during the period for the pay items and bid prices contained in the Unit Price Schedule.
C. Progress payment equal to the value of the work performed may be made monthly on estimates approved by the Engineer as set forth in this Article.
Upon payment therefore, title to the property shall rest in the MDOT MTA. Notify the MDOT MTA when all work is complete. Final payment will be made after final acceptance.
D. No progress payments will be processed for Mobilization until the Contract Quality Control (CQC) Plan and the Safety Plan have been submitted and approved by the MDOT MTA.
E. NO change shall be made to the Contract that shall cause an increase in the price or of the time required for the performance of any part of the work under this Contract, except as made by the MDOT MTA.
F. Orders issued during the effective period of this Contract and not completed within the administration respecting those orders shall be governed by the terms and unit bid prices of the Contract to the same extent as if completed during the effective period of the Contact.
1.6 LIMITATION OF FUNDS:
A. It is estimated that the total cost to the MDOT MTA for the performance of this Contract will not exceed the Total Estimated Price set forth in the Unit Price Schedule, and the Contractor agrees to use their best efforts to perform the work specified in the Unit Price Schedule and all obligations under this Contract within the Total Estimated Price.
B. If at any time the Contractor has reason to believe that the costs that it expects to incur in the performance of the Contract in the next succeeding thirty (30) days, when added to all other payments and prices previously accrued, will exceed eighty-five (85%) of the Total Estimated Price set forth in the Unit Price Schedule, notify the Engineer to that effect, giving their revised estimate of the total price with the supporting reasons and documentation.
