About this file
This document is Addendum No. 3 to Invitation for Bid (IFB) No. 04A4832 issued by the California Department of Transportation (Caltrans) on May 10, 2016, for Multiple-Provider On-Call Erosion Control and Water Pollution Control Services in North Counties. The addendum provides clarification on licensing requirements, specifically that a C-27 license can be used in lieu of a D-59 license for hydro-seeding areas of three acres or less, while a D-59 license is required for areas greater than three acres. It also clarifies that a Class A license can be used for C-12 and C-32 work, while a C-31 is required for traffic control work.
The addendum provides detailed information about erosion control maintenance requirements, establishing a standard 15-working-day maintenance period unless revised by the Task Order Manager. The work includes maintaining erosion control measures, inventorying deficiencies, caring for permanent erosion control work, and addressing issues like slide repairs and sediment removal. The document confirms that Good Faith Efforts (Attachment 10) must be submitted with the bid package on May 12, and states that the bid bond form will remain unchanged and the bid submittal deadline will not be extended.

Addendum No. 3
Invitation for Bid (IFB) No. 04A4832
Multiple-Provider On-Call Erosion Control and
Water Pollution Control (ECWPC) Services-North Counties
NOTICE TO ALL PROSPECTIVE BIDDERS
Addendum No. 3 is being issued for the above-referenced Invitation for Bid (IFB). Bids for this work shall be with the full understanding of this Addendum.
The purpose of Addendum No. 3 is to answer questions received and the Department’s response.
Question 1.
Can a C-27 license be used in lieu of a D-59 (Hydro-seed license?
a. While Hydro-seeding (D-59) license limits a contractor to only perform Hydro-seeding activities a
C-27 license does allow a contractor to perform Hydro-seeding activities. There are numerous contractors that perform Hydro-seeding activities for Caltrans that do not have a D-59 license
b. In fact we could not find a single DBE company with the work Code classification of C20, 21
(Hydro-seeding) that has a D-59 license (as they have C-27 license)
Answer:
Yes. Hydro-seeding for three (3) acres or less can be performed without a D-59 license. A D-59 license is required for hydro-seeding areas greater than 3 acres.
Question 2:
Can we bid this project as a Prime Contractor using our C61/D49 license?
a. This would be the same argument as above only that a Class A covers all work under a class C12, C31, &
C32; whereas the C12 license limits your scope of work to Earthwork and paving, the C31 license limits your scope to Traffic Control, and a C32 license limits your scope to the Parking and Highway
Improvement scope.
Yes, a Class A license can be used for C-12 and C-32 work. A C-31 is required for traffic control work.
IFB Number 04A4832
Question 3:
Question regarding Bid Item #9 Erosion Control Maintenance/Interval:
1. How long must the contractor maintain the specified area?
2. What specific products fall within this bid item?
3. What are the quantities of the specific products that fall within this bid item?
a. The specifics of this bid item remain a mystery. We are not sure which erosion control products we are maintaining, and the quantity of each. We have various erosion control measures that are indicated by the contract (e.g. gravel mulch, RSP, RECP, silt fencing, Construction entrances, fiber roll, hydro-seed, mulching). One may be able to see how it is difficult to put a price to maintenance of an unspecified product with an unspecified quantity. Maybe this is just maintaining fiber roll or silt fencing? If not there are some ideas below:
b. Option #1: Erosion Control Maintenance Day with 3 laborers with hand tools
c. Option #2: Erosion Control Maintenance Day with Hydro-seeding crew
d. Option #3: Erosion Control Maintenance day with equipment crew (for construction entrances, rip rap, gravel mulch, etc.)
Recommended Revisions in Exhibit A, Scope of Work, Section 10, Work Items:
GENERAL (ALL NEW)
The work items in this Section shall be installed and or implemented expeditiously to correct field deficiencies.
The Task Order Manager or his designee shall outline a scope of work in a Task Order utilizing work items outlined in this Section. The Contractor shall provide a bid for the installation of the work items (see Bid
Proposal) and a price per day interval for maintaining the corrective work. For bidding purposes, the maintenance period will be 15 working days unless revised by the Task Order Manager.
Section H, Erosion Control Maintenance/Interval has been revised to read as follows:
H. Erosion Control Maintenance/Interval
This work includes maintaining the erosion control measures outlined in this Section (10), as determined necessary by the Task Order Manager or designee including inventorying deficiencies and caring for permanent erosion control work including maintaining slide and slip-out repair work, re-application of materials, adjusting and repairing erosion control features, removal of sediment, trash and debris in a manner that provides sediment holding capacity and reduces runoff velocities in project areas as determined necessary by the Task Order
Manager or designee. Maintenance activities shall comply with Section 21, Erosion Control of the Standard
Specifications and these Special Provisions. Contractor shall complete maintain the permanent erosion control establishment maintenance work within (15) working days.
IFB Number 04A4832
Question 4:
On the bid bond form in the bid documents the text reads
"in accordance with the bid, and files two bonds with the obligee one to guarantee faithful performance (if specified in the contract) of the contract and the other to guarantee payment for labor and material as provided by law, then this obligation shall be null and void:"
By having this statement in the Bid Bond the Bonding Company has to guarantee it will provide these.
Can it be changed to “once a contract is signed then this obligation shall be null and void”?
Can you extend bid date to give contractors more time for the DBE requirement?
Bid Bond form will stay the same. Bid submittal will not be extended.
Question 5:
Could you please confirm if the Good Faith Efforts (Attachment 10) should be submitted on May 12 with the rest of the Submittal Package?
Yes.
NOTE: ALL OTHER TERMS AND CONDITIONS SET FORTH IN THE INVITATION FOR BID (IFB),
SHALL REMAIN IN FULL FORCE AND EFFECT.
Sincerely, Jean P. Mallare Contract Analyst
