About this file
This Addendum No. 2 document modifies the Request for Proposal No. PWG125-LANDD-5801 for Construction Materials Inspection and Testing Services issued by the San Bernardino County Department of Public Works. The addendum clarifies key proposal requirements and procedural details for this on-call contract opportunity. The original proposal deadline of January 9, 2026, has been extended to 4:00 PM on Friday, January 30, 2026, with submissions required via the ePro System. The document addresses six critical questions and answers covering indemnification provisions, personnel certification requirements, reference eligibility, financial documentation submission timelines, rate sheet formatting, and proposal organization requirements.
The addendum establishes that indemnification language will remain unchanged despite requests for revision to align with California Civil Code Section 2782.8, as the provisions have been reviewed and approved by County Counsel. Proposers must provide certification of the registered Professional Engineer overseeing materials services, with San Bernardino County employees eligible as references. Financial statements will not be required with initial proposals but may be requested during the award phase. All rate proposals must be submitted on the designated Attachment E form for consistency among proposers. Critically, any proposal must be accompanied by a signed Bidder's Certification acknowledging receipt of Addendum No. 2; proposals lacking this certification will not be accepted. The certification must be signed by the same person executing the proposal and submitted as part of the proposal package.

Questions and Answers:
1. Question: Will the Agency consider revising the indemnity provisions to align with insurability and
California Civil Code Section 2782.8, specifically to limit the consultant's indemnity obligation to damages arising from the consultant's negligence and to allocate defense costs proportionately based on comparative fault?
Answer: The indemnification provisions were reviewed and approved by County Counsel and are consistent with applicable California law. The Agency will not revise the indemnity language.
2. Question: Regarding the Attachment C form, are we to provide a copy of the certification of the registered PE overseeing materials services, or ALL of our proposed key personnel?
Answer: At a minimum, provide certification of the registered PE overseeing materials services.
3. Question: Are we permitted to list San Bernardino County employees as references?
Answer: Yes, San Bernardino County employees can be listed as references.
4. Question: Section 7 (Financials) states that proposers must be ready to provide Annual Reports for the previous two years if requested, and also states that proposers must include independently audited financial statements for the most recent completed fiscal year. Please clarify whether audited financial statements are required to be submitted with the proposal, or whether proposers are only required to be prepared to provide audited financial statements upon request.
Answer: Financial statements will not be required to be submitted with the proposal, any requests for financials will be during the awarding phase.
5. Question: Will the County allow us to submit our rate sheet in lieu of Attachment E?
Answer: Please submit rates on attachment E for consistency between proposers.
6. Question: The proposal format order varies from what is listed in Section B versus what is listed on
Attachment A. Which order is correct?
Answer: For completeness of the proposal, refer to both Attachment A and Section B. The order of these documents is not important.
