About this file
This is Addendum No. 2 issued by the Minnesota Office of State Procurement for the Fuel Program: Fixed and Spot Price for Metro Area solicitation (Web Registration No. 16429). The addendum extends the response due date from December 13, 2024 to December 16, 2024 at 3:00 PM Central Time for a contract to provide and distribute diesel and gasoline products to State agencies and CPV members in the Metropolitan Area.
The Fixed Price Program will be a true fixed price program with maximum prices remaining firm for the initial contract term. The Spot Price Program will be available on an as-needed basis with no quantity commitments, and pricing will be calculated using the formula: Total Delivered Cost = (Total Bid Constant + Daily Contract Average Price Minneapolis Terminal) * Total Gallons. The Total Bid Constant will be solicited in Phase 3. The addendum clarifies that no bid bond or performance bond is required, and contractors can submit additional language regarding fuel storage tank liability via Attachment B, with 100 points available in Phase 1 for acceptance of State's Terms and Conditions.

1. The Response Due Date has been extended to December 16, 2024, at 3:00 PM Central Time.
2. Below are the State’s responses to questions received for the above solicitation.
Question 1: Is the Fixed Price Program a true fixed price, or will it be an OPIS +/- differential?
Answer 1: The Fixed Price Program is a true fixed price. In the event of an award, prices awarded and listed in Exhibit D are maximum. These maximum prices shall remain firm for the initial term of the Contract.
Question 2: Is the Spot Price Program just a discretionary, prior-day quote?
Answer 2: Yes, the Spot Price Program will be available to customers on an as-needed basis. The Contractor will be responsible for supplying and delivering the desired fuel products as ordered by the customer. There will be no quantity commitments under the Spot Price Program.
Pricing under the Spot Price Program is calculated as follows: Total Delivered Cost = (Total Bid Constant + Daily Contract Average Price Minneapolis Terminal) * Total Gallons.
The Total Bid Constant will be solicited by the State in Phase 3.
Question 3: How long will Responders have to submit pricing in Phase 3?
Answer 3: Responders who are selected for Phase 3 will be notified and given a response due date and time when Phase 3 documents are distributed.
Question 4: Will there be another question period after Phase 3?
Answer 4: At this time, the State does not intend to include a question period during or following Phase 3. Responder questions may or may not be considered by the State.
Persons with a hearing or speech disability may contact us by dialing 711 or 1.800.627.3529.
Question 5: Can language regarding the condition, responsibility, and compliance of fuel storage tanks, including notification of issues and leakage, be added to the Contract, specifying that the contractor is not liable for any issues except those cause by its own negligence during delivery?
Answer 5: Responders can submit additional language to be considered by the State via Attachment B. The State reserves the right to reject, negotiate, or accept any exception(s) submitted via Attachment B. 100 points will be available in Phase 1 to the Acceptance of State’s Terms and Conditions.
Question 6: Is a bid bond or performance bond required for this RFP?
