About this file

This document is Addendum No. 2 to DEP Solicitation No. 2024023 issued by the Florida Department of Environmental Protection for Waste Tire Abatement Services for the Hartman Waste Tire Site. The addendum contains responses to questions from prospective vendors and modifies the Scope of Work. The project involves the removal and transportation of approximately 750 tons of waste tires and tire material from the 5.22-acre Hartman Waste Tire Site to the Putnam County Central Landfill. Work must begin within 10 business days of contract execution and conclude by December 15, 2024. The contractor must be a registered Waste Tire Collector and is responsible for providing all necessary equipment, clearing vegetation, and transporting the materials to the landfill. The Department will pay the landfill tipping fees and provide oversight during the project.

The addendum clarifies that the contractor is not responsible for the landfill tipping fees and that there are no size restrictions on trees that can be cleared. It also specifies the required documentation the contractor must submit weekly, including daily logs, weigh tickets, and progress photos. Payment will be made monthly based on the submitted documentation, and the project will be considered complete once the Department confirms all materials have been removed from the site.

1.

Section 4.3 Page 20-21

Is the contractor responsible for the tipping fee at Putnam County Lanfill?

No. The Department will pay the tipping fees by Purchase Order.

2.

Are the tires to be taken to a set tire disposal place or we the vendor need to dispose of them on our own?

In accordance with Section 4.1 – Scope of Work, all waste tires, waste tire material, land clearing debris, and other waste that must be removed to complete work shall be taken to the Putnam County Central Landfill.

3.

Are there any charges or fees to the contractor to haul the tires to the disposal site (landfill) No. The landfill fees will be covered by the Department by Purchase Order. The Contractor will be responsible for obtaining a Waste Tire Collector Registration Decal if they do not already have one. The fee is $35.00 per vehicle and $15.00 for a replacement. Note that hauling Off the Road (OTR) tires does not require a Decal since they are unregulated. Registered Waste Tire Collectors shall adhere to Rule 62-711.520, F.A.C.

4.

We are aware of the specification requiring the off haul of the tires to Putnam County Landfill, but we were curious whether or not DEP would consider a bid alternate of recycling all of the tires on the site 100%, and re-using them to vendors as TDF (Tire Derived Fuel). Atlantic Can would like the DEP to consider this alternate as a cost savings measure for the existing tire stockpile at the Hartman Site.

No. The Department will not consider a bid alternate and will continue as planned in accordance with the Section 4.1 - Scope of Work (SOW).

Solicitation Page Number Question / Answer

5.

How many tons per day can we deliver to Putnam County Landfill?

Contractors are responsible for contacting Putnam County Central Landfill regarding any restrictions/regulations they may have in place.

6.

Is there a limit to the size of the tree we can take down to get into areas of the property with our equipment?

Tree clearing is not regulated by Department Rules, and Flagler County has confirmed that any tree clearing will be exempt from regulation. Therefore, there are no size restrictions.

7.

Will we need to sheer the larger tires down before transporting them to Putnam County Landfill?

No.

In accordance with Section 2.6, Addenda/Amendments to the RFP, the Department hereby formally amends the Solicitation. The amendments are indicated in blue with strikethrough for deletions and underlines for additions.

4.1 Scope of Work

The Contractor shall provide Waste Tire Abatement and transportation of approximately 750 tons of waste tires and waste tire material from the Hartman Waste Tire Site to the Putnam County Central Landfill. This material is composed of approximately 530 tons of tires across two main piles, approximately 165 tons of tires scattered around the 5.22-acre property, and up to 55 tons of tire material comprising a dismantled section of a tire wall running along the south side of the site. The dismantled portion of the wall to be removed will be clearly delineated by the Department before the start of work. This site will require clearing of vegetation to maneuver and remove the tire material. The vegetation is dense in parts of the site and the necessary clearing efforts may be extensive. There are two points of access to the site. If entering through the front gate of the site, clearing of moderately dense vegetation will be required. If entering from the south side of the site, less clearing may be necessary, but a crossing that spans a two-foot ditch will need to be installed. If the site becomes wet, mobility may be an issue. The Contractor shall be aware that there may be wildlife inside the tire piles and operate accordingly. The Contractor shall also be aware that there will likely be moderate to heavy mosquito activity and should prepare accordingly.

There are a number of empty, used and rusty petroleum product drums on site. These are outside the Scope and shall not be removed unless authorized by the Department.

Any work not authorized in the Scope and Contract, or by the Department in writing, shall be performed at the Contractor’s sole expense.

4.2 Project Time Window

Work will begin no more than ten (10) business days after the Contract is executed. Work will conclude on or before December 15, 2024.

Addendum No. 2 Page 3 of 5

4.3 Contractor Responsibilities

1. Contractor shall be a registered Waste Tire Collector and adhere to the requirements of Rule 62-711.520

F.A.C. for the transportation of regulated Waste Tires as defined in Rule 62-701.200, F.A.C. Transportation of oversized OTR tires do not require a Waste Tire Collector Registration Decal.

2. Contractor shall begin work within ten (10) business days of notification according to “Department’s Responsibilities”, and work shall not continue past the end date specified, unless an extension is authorized by the Department by email.

3. Contractor is responsible for physically accessing the site.

4. Contractor shall maintain physical access for personnel and equipment into and on the site in all conditions, including inclement weather.

5. Contractor shall exercise safe and efficient means of performing work as outlined in the Scope. This includes protecting themselves from mosquitos, wildlife that might be found in tires and tire piles, and other hazards with the proper Personal Protective Equipment (PPE).

6. Contractor is responsible for either providing their own mosquito abatement method or working with the local mosquito control personnel.

7. If using mosquito repellant, the Contractor is required to use DEET only. This is because certain species of mosquito are resistant to other common repellant substances. DEET is the sole substance to be used for mosquito repellant for this reason.

8. It is the sole responsibility of the Contractor to clear and remove any vegetation necessary to maneuver on the site and to remove the tire material. The Contractor shall provide the equipment and personnel necessary to mechanically and physically clear vegetation and remove tires. Clearing methods shall not include fire or chemical treatment of the vegetation.

9. Contractor is responsible for providing all equipment necessary to complete the work in this Scope.

10. Contractor is responsible for transporting any yard trash/vegetative debris, resulting from the clearing activities, to the Putnam County Central Landfill.

11. No security will be provided by the Department.

12. Contractor shall work with the Department, who shall notify the property owners in advance of the dates during which the work will be completed.

13. Contractor shall sort tires with rims and tires without rims to be sent in separate trucks.

14. When loading a truck with oversized Off the Road (OTR) tires, the Contractor shall dedicate that truck to the oversized OTR tires exclusively for that particular load.

15. Contractor shall remove as much dirt and debris as possible from the tires, and dewater the tires, prior to loading.

16. Contractor shall separate cleared vegetation, waste tires and waste tire material, and any other waste that must be cleared to complete the work and put these into separate trucks.

17. Contractor shall adhere to applicable county and local ordinances when performing the required work as outlined.

18. Contractor shall restore the site’s land to its original or a substantially similar contour after all solid waste to be removed has been removed.

19. If any materials other than what has already been described in this Scope of Work (SOW), site report, and/or pictures are discovered, the Department shall be notified immediately. While waiting for the Department’s determination on the discovered materials, the Contractor is not authorized to clean up those materials.

Any unauthorized cleanup on discovered materials not found in the SOW, site report, and/or pictures is at the Contractor’s sole expense.

20. If additional waste tires and/or waste tire materials are discovered, beyond what is outlined in this SOW, the Contractor shall notify the Department immediately. In the meantime, the Contractor is not permitted to

Addendum No. 2 Page 4 of 5 remove the discovered tire materials until the Department provides approval for management of the additional tire material via email.

21. Contractor shall submit documentation described in the “Deliverables” section weekly.

22. When the work is deemed complete by the Department site inspection. The Contractor shall submit an itemized invoice packet to the Department containing all weekly packets sent to the Department during the course of the cleanup within thirty (30) business days of the date the Letter of Completion is received.

a. Deliverables. The Contractor shall provide the following deliverables:

Contractor shall remove all materials specified in the SOW and transport the materials to the Putnam County Central Landfill within the specified timeframe.

Contractor shall submit the following documentation, in electronic format, to the Department on a weekly basis:

1. Daily log of personnel present and hours worked.

2. Daily log of trucks sent to the Putnam County Central Landfill and their contents (i.e., tires with rims, yard trash, etc.).

3. Weigh tickets from the Putnam County Central Landfill for each truck. The weigh ticket should describe the contents of the truck, as well as the weight of the contents in tons. The Department will use weigh tickets to verify receipt of waste by the Putnam County Central Landfill. Payment will not be made for trucks that don’t receive weigh tickets.

4. Pictures documenting progress.

5. A summary of the work completed each week, including notation of unexpected circumstances and conditions

(such as discovery of solid waste materials that are not tires or vegetative waste, unusually heavy rainfall, etc.).

Weigh tickets must contain the following information:

• Driver signature

• Date load picked up

• Date weigh ticket generated

• Vehicle Identification Number (VIN)

• Water Assurance Compliance System (WACS) Waste Tire Collector Registration ID on decal when transporting regulated Waste Tires as defined in Rule 62-701.200, F.A.C.

• Expiration date of Waste Tire Collector Registration Decal

The Contractor may invoice no more frequently than monthly. The invoice must include documentation that supports the amount of the invoice.

The project will be complete when the Department confirms that all materials specified in the Scope are cleared from the site and transported to the Putnam County Central Landfill.

4.4 Department’s Responsibilities

1. The Department will give notice in writing ten (10) business days prior to the start date of the project that work is authorized to begin.

2. The Department will provide oversight randomly during working hours.

3. The Department will arrive at the cleanup location within two (2) business days of the Contractor’s notice of completion. The Department will inspect the site to ensure that all waste tires and waste tire material are indeed removed from the site. The Department will notify the Contractor to submit the final invoice after inspection and approval of work.

4. The Department will pay tipping fees.

5. The Department will cover landfill fees.

Addendum No. 2 Page 5 of 5

4.5 Enforcement

Noncompliance with the terms and conditions of the SOW will result in:

1. Delayed payment until a satisfactory record of the specified documentation has been submitted along with the invoice according to this SOW.

2. Nonpayment for work that does not meet the Terms and Conditions in the Contract.
