About this file

This is an Addendum No. 1 to RFQ No. 10118884 issued by the California Department of Water Resources (DWR) on April 22, 2016 for Statewide Remote Sensing Crop Mapping services. The addendum modifies the original RFQ posted April 1, 2016 by removing language stating that all acquired images will be owned by DWR, and clarifies that contractors will obtain imagery from satellite or aerial photography, format as appropriate, maintain data, and deliver images as contract deliverables. The scope includes agricultural land use mapping and wetlands/managed wetlands, with potential for additional land uses to be added through contract amendments. At least one person per applicant must have either an engineering degree or engineering license, though a PE is not required.

The addendum addresses questions about image ownership and licensing, specifying that any rights existing at contract expiration for leased/licensed data shall transfer to DWR as allowed by law. Required software and licenses purchased by the contractor remain under contractor ownership unless otherwise specified. The document includes a Q&A section clarifying that terms are non-negotiable, only prime contractors need to sign certification sheets, and that while the primary focus is agricultural mapping, additional land uses could be added through amendments. A sign-in sheet from the pre-SOQ submittal conference was attached to the addendum.

RFQ No. 10118884

Statewide Remote Sensing Crop Mapping

ADDENDUM NO. 1

This Addendum addresses questions and changes to language in Exhibit A – Scope of Work, and Exhibit E – Additional Provisions, to the Request for Qualifications (RFQ) No.

10118884, as originally posted April 1, 2016. Changes being made to RFQ No. 10118884 are as follows:

Changes to Exhibit A – Scope of Work

Exhibit A, Scope of Work, DESCRIPTION, Paragraph 1, has been changed to remove the lined-out sentence below. The language not lined-out remains as a part of Exhibit A, Scope of Work.

1. Contractor will obtain imagery from either satellite or aerial photography, format as appropriate, maintain the data, and deliver the images as part of the contract deliverables. All the images acquired will be owned by DWR.

Changes to Exhibit E – Additional Provisions

Exhibit E, Additional Provisions, OWNERSHIP, STANDARDS, AND DATA LOCATIONS, has been changed to add the following underlined language below.

3. OWNERSHIP, STANDARDS, AND DATA LOCATIONS:

All data, application code, and or modeling schemes developed, purchased, or collected as part of this contract shall be solely owned by DWR and must be provided to DWR. Any right existing at the expiration of the contract for data leased or licensed shall be transferred to DWR to the extent provided by law. Any database, application, document repository, or web-site development or modifications must adhere to DWR Information Technology standards and protocols. Contractor shall adhere to defined DWR database standards unless approved formally by DWR to do otherwise. All web-sites, applications, document repository, and data must be hosted within the DWR Data Center or receive the formal approval of the Department’s Chief Information Officer to be hosted at another location. Any software, databases, applications, web-sites, or hardware that is to be implemented into the DWR production environment must first be reviewed and approved by the Division of Technology Services.

Any required software and software licenses purchased by the contractor shall remain under the ownership of the contractor unless otherwise specified as part of contract terms.

Addendum No. 1

The following questions were received from prospective Contractors. The questions are immediately followed by the Department’s responses.

The sign-in sheet from the conference is attached.

Q1: Are the terms and conditions in the RFQ negotiable?

A1: DWR does not negotiate any terms and conditions advertised in the RFQ.

Q2: Does the Potential Qualified Firms Certification Sheet need to be filled out by the submitting prime contractor, or by the prime contractor and all the subconsultants?

A2: Only the prime has to sign the Potential Qualified Firms Certification Sheet. The

Potential Qualified Firms Certification Sheet has to be executed by an authorized person who can bind the firm contractually.

Q3: What documentation related to degrees and /or certifications is required for the principal team members?

A3: This is an architectural and engineering contract. At least one person per applicant must have either an engineering degree or engineering license.

Q4: Does engineering or PE mean the science of engineering or just engineering?

A4: At least one person per applicant must have either an engineering degree or engineering license, but a PE is not required.

Q5: Do physics or chemistry degrees meet the Statement of Qualification (SOQ) requirements?

A5: At least one person per applicant (prime contractor or subcontractor) must have an engineering degree or California professional engineering license.

Q6: Could we get a copy of the sign-in sheet or list of attendees?

A6: Yes. See addendum 1 attachment.

Q7: Are you interested specifically in agricultural land use or will you be wanting to go further into identifying non-agricultural use?

A7: We are interested in agricultural land use, but we are also interested in wetlands, managed wetlands, as defined in the RFQ. If at any point DWR wants land use other than what is stated in the RFQ, it will be added on a case-by-case basis through a contract amendment.

Q8: How about forestry or fire mitigation?

A8: Not for forestry. All this will be defined when we do issue the task order that describes exactly what we want. If at any point DWR wants land use other than what is stated in the RFQ, it will be added on a case-by-case basis through a contract amendment.

Q9: The RFQ states that all acquired imagery becomes property of DWR. Is that possession? Is that the use of the imagery, or the imagery itself which excludes all of the use? If you acquire imagery that you can, that DWR cannot own, does that disqualify the imagery? Typically you buy the license to use as opposed to the imagery itself.

A9: Please see the changes to Exhibits A and E shown on page 1 of this addendum.
