RE: Limited Pre-Renovation Asbestos-Containing Material Inspection Services Commercial Structure 132, 136 Slusher Street; Stuart, Virginia 24171 Hurt & Proffitt Project: 20200421

Dear Mr. Simmons:

This letter and attachments represent Hurt & Proffitt’s (H&P) report for the above-referenced project as requested to obtain the proper permits for a planned renovation.

Asbestos Survey and Laboratory Procedures

The inspection was performed in compliance with Local, State and Federal regulations as required by the National Emission Standards for Hazardous Air Pollutants (NESHAPs). General sampling protocol was in accordance with both NESHAPs and the US EPA-Asbestos Hazard Emergency Response Act (AHERA) regulations and the State of Virginia.

Physical inspection and sample collection activities were performed through the designated renovation areas, within the interior of the structure(s), on March 9, 2020 by Hurt & Proffitt representative, Mr. Kenric K. Hundley (Virginia Asbestos Inspector: 3303001516). A copy of Mr. Trent’s Virginia Department of Professional and Occupational Regulation (VA DPOR) Asbestos Inspector License is enclosed for your review.

Suspect bulk samples were collected and logged on chain-of-custody forms as representative of suspect homogenous materials (based on material type, color, texture, etc.), from the functional spaces as they were determined by visual observations in the field.

Twelve (12) suspect asbestos samples, including triplicate sets were submitted for analysis via EPA Method No. 600/R-93/116 and 600/M4-82-020 (polarized light microscopy (PLM)). All samples were analyzed by SanAir Technologies Laboratory of Powhatan, Virginia, a NVLAP accredited laboratory licensed to perform asbestos bulk analysis within the State of Virginia.

The following materials were noted to be asbestos-containing:

• 12”x12” Beige Vinyl Composite Tile (VCT) Flooring and Black Mastic

• 9”x9” Beige Vinyl Composite Tile (VCT) Flooring and Black Mastic

Table I, on the following page, illustrates the sample identification, location and analytical results as received from the laboratory.

Notes: 1. (ABC) following sample identification denotes multiple samples collected of the same homogenous material.

2. Sample Analysis was performed under “Positive Stop” protocol, i.e. the laboratory analyzed multiple samples of similar materials and stopped analysis when asbestos was identified OR if no asbestos was identified, the triplicate samples were all analyzed.

3. Contractor will be responsible for field verification of quantities of the above referenced asbestos-containing materials (ACM).

Site drawings, which illustrate the approximate locations of the collected samples and locations of asbestos-containing materials, along with a copy of the laboratory report of analysis are enclosed for your review.

Requirements, Recommendations and Discussion

The State of Virginia requires a copy of this inspection report and any other substantiated evidence of the presence of asbestos-containing materials to be provided to them at the point of applying for a building renovation permit.

Local, state and federal law requires regulated asbestos-containing materials (RACM) to be removed prior to renovation. The definition of RACM as defined by the US EPA NESHAPs as follows:

"Regulated Asbestos-Containing Material" (RACM) is (a) friable asbestos material, (b) Category I non-friable ACM that has become friable, (c) Category I non-friable ACM that will be or has been subjected to sanding, grinding, cutting or abrading, or (d) Category II non-friable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations.

Hurt & Proffitt recommends the following material(s) be removed prior to commencement of renovation activities:

Cat. I Non-Friable 12”x12” Vinyl Composite Tile (VCT) Flooring and Associated Mastic Cat. I Non-Friable 9”x9” Vinyl Composite Tile (VCT) Flooring and Associated Mastic

Mr. Bryce M. Simmons, P.E.

RE: Limited Pre-Renovation Asbestos-Containing Material Inspection Services

Commercial Structure 132, 136 Slusher Street; Stuart, Virginia 24171

It is required that a Virginia Department of Professional and Occupational Regulation (VA DPOR) licensed asbestos abatement contractor perform the removal of each of the materials described within this report. It is not required that a twenty (20) day asbestos abatement notification be submitted to the Virginia Department of Labor and Industry (VA DOLI) and US EPA NESHAPs division prior to abatement;

however, both the Virginia DOLI and the US EPA NESHAPs division must be notified ten (10) days prior to the start of renovation of the structure.

It is required that the abatement process be monitored by a third-party asbestos abatement project monitoring firm, which will help maintain the integrity of the abatement process, solidify that the abatement process has been completed correctly, through final visual clearance inspection(s) and final air clearance sampling in compliance with NIOSH 7400 Phase Contrast Microscopy (PCM) methodologies or through the collection and analysis of Transmission Electron Microscopy (TEM). The third-party monitoring will reduce the liability for which the owner and/or contractor may incur if there should happen to be a violation determined by state and/or federal code enforcement personnel, i.e.: Virginia Department of Labor and Industry (VA DOLI), US EPA NESHAPs division.

Our recommendations and requirements are based on the guidelines presented by the United States Environmental Protection Agency (US EPA), United States Occupational Safety and Health Administration (US OSHA), and the State of Virginia. Any conditions discovered which deviate from the data contained in this report should be presented to us for our evaluation.

Qualifications of Asbestos Survey

Additional ACM/PACM may exist (undetected and/or inaccessible) in other portions the structure.

If additional suspect materials are found during either the abatement or demolition activities, all work on the site must stop and the newly discovered materials sampled by a Virginia licensed asbestos building inspector and evaluated for asbestos content.

This report summarizes our evaluation of the conditions associated with the project site as described within. The findings prepared by Hurt & Proffitt are based upon our observations in the field, within the laboratory and the analytical analysis of the samples collected at the time of the field inspection.

Closing

Thank you for allowing Hurt & Proffitt to provide you with our pre-renovation asbestos-containing material inspection services. Should you have any questions and/or concerns, please do not hesitate to contact the undersigned via email or by phone at 434.847.7796. It was a pleasure working with you on this project and I hope we can be of service to you in the future.

Sincerely, HURT & PROFFITT, INC

Disclaimer

The final report cannot be reproduced, except in full, without written authorization from SanAir.

Fibers smaller than 5 microns cannot be seen with this method due to scope limitations. The accuracy of the results is dependent upon the client’s sampling procedure and information provided to the laboratory by the client. SanAir assumes no responsibility for the sampling procedure and will provide evaluation reports based solely on the sample and information provided by the client. This report may not be used by the client to claim product endorsement by NVLAP or any other agency of the U.S. government. Samples are held for a period of 60 days.

For NY state samples, method EPA 600/M4-82-020 is performed.

Polarized- light microscopy is not consistently reliable in detecting asbestos in floor covering and similar non-friable organically bound materials. Quantitative transmission electron microscopy is currently the only method that can be used to determine if this material can be considered or treated as non-asbestos containing.
