About this file
This document is Addendum No. 1 to Request for Proposal (RFP) No. RFP-781 issued by the Commonwealth of Kentucky Department for Facilities and Support Services Division of Engineering and Contract Administration for a Land Surveyor to conduct a survey of the Ataya Property located in Leslie, Knox, and Bell Counties. The RFP seeks to acquire a conservation easement on the property, which is currently owned by The Nature Conservancy. The survey is required to establish the boundaries and existing conditions of the property prior to the easement acquisition. The target closing date for the conservation easement is October 2023, and the current grant supporting the acquisition has a deadline of September 30, 2024, although the grant can be amended or extended as needed.
The addendum provides responses to several questions submitted by potential proposers, including clarification on the existing GIS data, the composition of the property tract, applicable survey standards, the nature of the conservation easement, and the lack of any prior environmental studies or hazardous conditions assessments. The Department of Fish and Wildlife has confirmed that no mineral rights will be transferred as part of this transaction, only surface-based rights.

Addendum No. One (1)
PROPOSER SHALL CONFORM TO THE FOLLOWING CHANGES AS SAME SHALL BECOME BINDING UPON THE
CONTRACT TO BE ISSUED IN RESPONSE TO THIS REQUEST FOR PROPOSAL.
Item 1. Questions and Answers:
• What is the basis of the shape file that exists and is shown on the exhibits to the RFP? GIS files via TNC (The Nature Conservancy)
• Is the larger Property Tract a compilation of multiple tracts?
Yes
• The RFP states this work shall be subject to the KY Minimum Standards for Boundary Surveys. Is that correct?
Yes
• The solicitation states the KFDWR is “acquiring access rights”. Does that mean the property will transfer ownership?
No, TNC will remain owner and KDFWR will purchase Conservation Easement
• If the above is correct, will this be a “Fee Simple” transaction? Will any prior mineral rights be considered if evident or found through research?
No, purchasing Conservation Easement and mineral rights will not transfer, only consent
• Are we to assume that prior rights to the property will need to be delineated so that transference can be made possible?
No mineral rights transferring only surface based rights are to be defined via RFP and eventual contract
• Have any prior studies/investigations been conducted for the presence of hazardous conditions?
Not by KDFWR
• Does Fish and Wildlife have an idea of Timeframe for the project, i. e one year, within this fiscal year, etc.?
Target closing is October 2023
• Is there a funding date in the future that will drive the ultimate completion date?
Current grant supporting this Conservation Easement Acquisition is Sep 30, 2024 however that grant can be amended/extended to meet timetable as needed
