About this file

This is Addendum No. 1 to Invitation to Bid No. RFP-92-27 for the Methane Emissions Reduction Program (MERP), issued by the Commonwealth of Kentucky Department for Facilities and Support Services, Division of Engineering and Contract Administration, in coordination with the Kentucky Energy and Environmental Cabinet and Kentucky Division of Oil and Gas. The addendum addresses the Magoffin and Lawrence Counties project (MERP_9) dated October 9, 2026, with RFP number 785-2700000100. The addendum specifies binding changes to specifications and/or drawings that bidders must incorporate into their proposals and resulting contracts. The document includes clarifications on environmental compliance requirements and documentation procedures necessary for well site plugging and abandoned tank facility closure activities within the project area.

The addendum provides critical responses to bidder inquiries regarding environmental compliance, specifically addressing concerns about protected species including the Eastern Hellbender, Monarch Butterfly, Snuffbox mussel, salamander mussel, and pink mucket. The Kentucky Division of Oil and Gas has determined that the project will not jeopardize the continued existence of these species, with containment measures in place to prevent contamination of groundwater and surface water during plugging operations. The addendum clarifies that the Abandoned Tank Facility Closure Affidavit is required only when an abandoned tank site is removed and reclaimed as part of the project package, whereas the Plugging Affidavit is required for each well site. These determinations are based on project area characteristics and habitat assessments that demonstrate minimal environmental impact risk.

Kentucky Energy and Environment Cabinet Addendum No. 1

QUESTION: RESPONSE:

1. Has a study been done for the following species: Eastern

Hellbender, Monarch Butterfly, Salamander Mussel? I did not see a study for these species in the letters from the DOI.

KDOG has determined this project will not jeopardize the continued existence of the Eastern Hellbender.

The action area for the project does not contain any streams that would provide quality habitat for hellbenders, and all fluids and waste generated during plugging will be contained in cemented pits to prevent contamination of groundwater or nearby surface water. KDOG has determined this project will not jeopardize the continued existence of the monarch butterfly. The project area is mostly forested and does not contain open, sunny plains/fields where milkweed is likely to grow, making it poor habitat for monarchs. When necessary, the division will recommend planting monarch habitat after project completion. Using IPaC determination keys, KDOG has reached a determination of “no effect” for the Snuffbox mussel, salamander mussel, and pink mucket. No streams will be affected by the plugging actions of this project. Under Section 7 of the ESA, if a federal action agency agency makes a no effect determination, no consultation with the Service is required (ESA §7).
