About this file
This document is a Federal Acquisition Regulation (FAR) Clause 52.212-2 Evaluation for Commercial Products and Commercial Services, issued in November 2021 by the U.S. Army. The solicitation is a Lowest Price Technically Acceptable (LPTA) source selection under Simplified Acquisition Procedures, with the intent to award a single Firm Fixed Price Contract. Offerors must submit comprehensive documentation demonstrating their ability to fulfill requirements, including product data sheets and service descriptions, by the end of the solicitation date.
The evaluation will assess two primary factors: Technical and Price. The Technical Factor will be rated as either Acceptable or Unacceptable based on how clearly the documentation meets evaluation criteria. Price will be analyzed using FAR price analysis techniques to determine reasonableness. Quotes must be submitted in full for all listed items in the Price Schedule, and offerors are advised to provide their best initial terms since the government intends to award the contract without discussions. Documentation must be emailed to leslie.a.duron.civ@army.mil to be considered for award.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
(NOV 2021)
II. Addendum to FAR Clause 52.212-2 Evaluation – Commercial Products And Commercial Services
Evaluation Factors for Award
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
1. Basis for Contract Award. This is a Lowest Price Technically Acceptable source selection conducted in accordance with Federal Acquisition Regulation (FAR) 13, Simplified Acquisition Procedures, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS).
The Simplified Acquisition Procedure authorized under FAR Subpart 13.5 is applicable to this acquisition. Award will be made to a single offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose offer is technically acceptable, conforms to the solicitation requirements, and whose offer, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the lowest price.
2. Award for All of the Work. The Government intends to award one Firm Fixed Price Contract. Quotes received for less than the stated number of items listed in the Price Schedule will be considered ineligible for award. The Government intends to evaluate quotes and award a contract without discussions with offerors. Therefore, the offeror's initial quote should contain the offeror's best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
3. Evaluation Criteria. Technical evaluation. Quotes will be evaluated using documentation submitted by contractors that show their ability to fulfill the requirement and elaborate on what services the contractor is offering. The offer/quote should not simply rephrase or restate the Government's requirements but rather shall provide convincing rationale to address how the offeror intends to meet these requirements.
Evaluation criteria consist of factors. The quotes will be evaluated under two (2) evaluation factors:
Technical and Price.
4. Factor 1 – Technical. Please provide documentation (product data sheets, description of services you will provide, etc) of what services will be provided in the offer.
The documentation will receive one of the ratings defined below:
Table 1
Technical Factor Acceptable/Unacceptable Ratings Rating Description Acceptable Documentation clearly meets the requirements stated in the evaluation criteria.
Unacceptable Documentation does NOT clearly meet the requirements stated in the evaluation criteria.
Factor 2 – Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 13.106-3(a). Through these techniques the Government will determine whether prices are reasonable.
5. Notice of Award. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
