ADDENDUM NO. 3

NOTICE TO RESPONDENTS In accordance with the Request for Proposals (the “RFP”) issued by the University of Massachusetts Building Authority (the “Authority”) on August 25, 2023 for the Request for Proposals for Sports and Entertainment Organizations to Operate LeLacheur Park, The University of Massachusetts Lowell, the Authority is issuing this Addendum No. 3, which includes modifications to the RFP. Except as specifically modified by the information contained in this Addendum No. 3, the RFP remains unchanged.

Revisions to RFP:

Response to Questions:

1. What is the current allowable capacity for guests in the stadium?

a. The current approved occupancy of the facility is approximately 750 spectator seats.

2. What work needs to be completed and what permits or licenses need to be secured to launch a summer season with full stadium capacity?

a. There are a total of 4,797 seats and additional standing room capacity of 233 people.

Aside from the outdoor seating, there are several enclosed spaces. Reestablishing the full spectator seating occupancy will be dependent on completion of improvements to emergency power, concourse concrete, emergency egress hardware, dugout chairlifts, and grandstand structural repairs as determined by the ongoing structural analysis.

b. Contractors will be required to permit construction and repair efforts in accordance with state and local codes and an annual Certificate of Inspection will be required for occupancy. Liquor license will also be required.

3. Who will secure and own the liquor license associated with stadium food & beverage operations?

UMass Lowell and UMBA intend to work with the selected Proposer to secure the liquor license.

4. Section 2(a) mentions a pledge of $3,000,000 from the University over the next five years allocated toward stadium repairs and improvements. This section of the RFP mentions that the funds will be direct toward the categories of code compliance, deferred maintenance, safety and security, and repairs to the outfield wall. Can you please expand on that to describe the specific repair work or plans for work that is anticipated to be done in preparation for a 2024 summer baseball season?

a. The campus has engaged Gale Associates to study and design improvements to the structure supporting the grandstand, concourse concrete, an emergency generator, the replacement and padding of the outfield wall, a physical barrier system to discourage access under the cantilevered Riverwalk behind the outfield wall, emergency egress security hardware, and facility roofs. There is also a need to replace the 2 chairlifts at dugouts.

b. Design efforts are currently in progress for the following projects. As design is in progress, we do not yet have confirmation of budget or schedules required for each item.

• Roof Replacement of (4) Upper Concourse buildings

• Painting

• Outfield Wall – Wall panel replacement; Padding: replace existing & new at

Outfield Wall

• Upper Concourse – Spalled Concrete Repairs

• RiverWalk Security – enclose/secure the underside of the RiverWalk

• Emergency Power System Upgrades (Em Gen, ATS, switchgear)

c. It is anticipated that the full scope outlined above will exceed $3 million, once designs are developed sufficiently for estimating purposes, so some prioritization will be required. The implementation of the prioritized scope will be scheduled over the next few years in coordination with schedules for baseball games and other facility uses, lead times for equipment, and availability of funding. The successful proposer will be consulted as part of the prioritization process.

5. Section 2(b)(7) mentions that Respondents must submit an operating plan covering all costs of the facility in support of occupancy. Can you please provide estimates for the costs of utilities, taxes, insurance, and field maintenance on a monthly or annual basis?

a. Below are the estimated operating expenses for FY23. As a State entity the University is exempt from taxes and is self-insured.

- $60,000 Field maintenance for the pre-season and spring season

- $40,000 Field maintenance for the summer and fall season

- $70,000 Building maintenance (MEP systems, carpentry, roof, painting, etc.)

(estimated @$3/SF)
