About this file

This is Addendum No. 2 to Request for Proposal No. PWG126-LANDD-6444 issued by a California water district for environmental permitting services related to the Birch Creek Cutoff Walls Project, a water infrastructure initiative in Oak Glen. The RFP seeks consultant services for environmental compliance and regulatory permit preparation, with a contract period of maximum one year beginning October 2026 and ending August 31, 2027, though the actual project is estimated to begin in spring 2027. Key deliverables include preparation of draft and final permit applications, technical memoranda or studies as requested, and GIS data or maps. No pre-proposal job walk will be hosted. The consultant's obligation for permit-related tasks is limited to submission of complete applications to regulatory agencies; the firm is not required to extend services through permit issuance or respond to agency requests for additional information. Mitigation-related services are restricted to representing the District in discussions with regulatory agencies and do not include quantifying compensatory mitigation obligations, identifying mitigation sites, or preparing habitat mitigation and monitoring plans.

The District will provide existing cultural resources and biological resources reports dated December 16, 2025 and November 26, 2025, respectively, both of which comply with CEQA and NEPA requirements. The District will prepare required CEQA documentation in-house and has engaged the EPA for NEPA compliance as part of grant funding requirements. All regulatory agency filing fees, including CDFW Lake and Streambed Alteration Agreement fees, will be paid directly by the District rather than included in the consultant's fee proposal. No significant or sensitive cultural or biological resources were identified on-site. GIS shapefiles depicting project footprint, temporary construction easements, and staging areas will be provided; however, previous wetland delineations or permit files are not available. The evaluation criteria are weighted as follows: Qualifications and Experience (40 percent), Technical Review (40 percent), and References (20 percent), with price to be evaluated as a substantially weighted criterion in accordance with EPA requirements for the most qualified proposal. The District has not established an estimated budget range for consultant services. All proposers must obtain a Unique Entity Identifier (UEI) from SAM.gov prior to award.

6. Question: Section I.D states the Contract period will be for a maximum of one year beginning on

October 2026 and ending on August 31, 2027. Section V.A states the Project is estimated to begin in the spring of 2027. Task 4 is captioned "Obtain regulatory permits," and Section I.A describes the services as the preparation of permit applications leading to the receipt of state and federal regulatory permits, but the Task 4 deliverables are listed as Draft Permit Application(s), Final Permit Application(s), technical memos or studies as requested, and GIS data or maps as requested. Is the consultant's Task 4 obligation complete upon submission of complete applications to each agency, or does it extend through permit issuance, including responses to agency requests for additional information? If the latter, will the District extend the Contract term should agency processing extend past August 31, 2027?

Answer: No, once final permits are submitted, the task is completed. The consultant does NOT need to extend through to permit issuance.

7. Question: Section I.A describes the services as including the preparation of permit applications leading to the receipt of state and federal regulatory permits, including mitigation negotiations. No task in Section V lists mitigation as a deliverable. Please confirm the intended extent of mitigation negotiations.

Specifically, does this scope include quantifying compensatory mitigation obligations, identifying or evaluating mitigation sites or credit purchases, and preparing a habitat mitigation and monitoring plan, or is it limited to representing the District in discussions with the regulatory agencies during processing of the applications prepared under Task 4?

Answer: It is limited to representing the District in discussions with regulatory agencies.

8. Question: Under Task 4, are agency filing fees, including the CDFW Lake and Streambed Alteration Agreement fee, to be included in the consultant's fee proposal or paid directly by the District?

Answer: Regulatory Agency (i.e., CDFW, Regional Board) filing fees will be paid by the District directly.

9. Question: Section VII lists three scored categories, Qualifications and Experience at 40 percent, Technical Review at 40 percent, and References at 20 percent, with categories B and E marked RESERVED. These total 100 percent and no category addresses cost or price. At the same time, Attachment E, Fee Proposal Sheet(s), is a required submittal which under Section VI.A.5 must be uploaded separately from the proposal and clearly labeled. Please confirm how Attachment E will be used in the evaluation and award, and whether a Proposal can be found non-responsive or be downgraded on the basis of the fees proposed in it.

Answer: Generally, and consistent with 2 CRF 200.320(b)(2)(iii), price must be a selection factor in the evaluation or quotes. The reasonableness of cost/price proposals must be evaluated for the scope of services outlined in the RFP/RFQ and must be a substantially weighted criterion. This is to help ensure that recipients are receiving the most advantageous offer, with price and other factors considered, for the work proposed by each bidder. EPA recommends that the cost/price reasonableness criterion is weighted at least 25%, however this is a qualifications-based procurement. Attachment E- Fee Proposal Sheet(s) will be opened for the most qualified proposal and used for negotiation, as necessary.

10. Question: Is there an estimated budget range for consultant services?

Answer: The District does not have an estimated budget range for consultant services.

11. Question: Will agency permit fees be consultant-paid or District-paid?

Answer: Regulatory Agency (i.e., CDFW, Regional Board) fees will be paid by the District directly.

12. Question: Were there any significant findings in the biological technical reports such as special status plant or wildlife? If yes, have focused surveys been performed and would any avoidance, minimization, or monitoring of special status species be anticipated? Are there any significant findings in the cultural report and would any cultural avoidance, minimization, or monitoring be anticipated?

Answer: No significant or sensitive resources were found on-site either cultural or biological.

13. Question: Will CAD and GIS files be provided?

Answer: GIS shapefiles depicting project footprint, anticipated temporary construction easements, and staging areas will be provided.

16. Question: Is a hard-copy proposal required in addition to ePro submission?

Answer: No.

Per Section VI.A.6 Proposal Submission For proposals submitted via hard copy, the Proposer shall not include Attachment E, “Fee Proposal Sheet(s),” as part of Proposer’s initial proposal, but instead shall mail or submit in person Attachment E, in a separate sealed envelope, clearly labeled with the RFP Number and Title and the name of the Proposer clearly marked on the outside, to the address stated in Section 1, Paragraph B.
