April 11, 2023

ADDENDUM #2

Shasta 975 Storage Tanks Improvements

ITB: 23-049-PW

This addendum modifies the bidding document(s) for work only to the extent indicated herein. All other areas not specifically mentioned or affected by this addendum shall remain in full force. This addendum shall be added as a part of the original bidding document and shall become part of the work required.

Description of Change(s)

1) Insert the following to Section 00700 Subsection C – Wages and Labor:

C.1 WAGE RATES ON PUBLIC WORKS: When the Contract price exceeds $50,000 or is part of a larger project exceeding $50,000, the Contractor shall comply fully with the provisions of ORS 279C.800 through 279C.870.Documents establishing those conditions, and any amendments, as determined by the Commissioner of the Bureau of Labor and Industries (BOLI), are included by reference as attachments to the Contract Documents. These documents may be accessed at http://www.boli.state.or.us/BOLI/WHD/PWR/pwr book.shtml

C.2 PAYROLL CERTIFICATION AND FEE REQUIREMENTS

C.2.1 In accordance with ORS 279C.845, the Contractor and every Subcontractor shall submit written certified statements with the Owner's Authorized Representative, on the form prescribed by the Commissioner of the Bureau of Labor and Industries, certifying the hourly rate of wage paid each worker that the Contractor or the Subcontractor has employed on the Project and further certifying that no worker employed on the Project has been paid less than the prevailing rate of wage or less than the minimum hourly rate of wage specified in the Contract, which certificate and statement shall be verified by the oath of the Contractor or the Subcontractor that the Contractor or Subcontractor has read such statement and certificate and knows the contents thereof and that the same is true to the Contractor or Subcontractor's knowledge. The certified statements shall set out accurately and completely the payroll records for the prior week including the name and address of each worker, the worker's correct classification, rate of pay, daily and weekly number of hours worked, deductions made and actual wages paid. Certified statements shall be submitted as follows:

a) For any Project ninety (90) Days or less from the date of award of the Contract to the date of completion of Work under the Contract, the statements shall be submitted once before the first payment and once before final payment is made.

b) For any Project exceeding ninety (90) Days from the date of award of the Contract to the date of completion of Work under the Contract, the statements shall be submitted once before the first payment is made, at 90-Day intervals thereafter, and once before final payment is made.

The Contractor and Subcontractors shall preserve the certified statements for a period of three (3) years from the date of completion of the Contract.

C.2.2 Pursuant to ORS 279C.825 and in accordance with administrative rules promulgated by the Commissioner of the Bureau of Labor and Industries, EWEB must pay a fee to the Bureau of Labor and Industries equaling 1/10 of one percent (1%) of the Contract price, however, the fee shall not be less than $250 nor more than $7,500, regardless of the Contract price. The fee shall be paid when entering into the Contract. The fee is payable to the Bureau of Labor and Industries and shall be mailed or otherwise delivered to the Bureau at the following address:

Bureau of Labor and Industries Wage and Hour Division Prevailing Wage Unit 800 NE Oregon Street, #32 Portland, Oregon 97232

Note: Effective January 1, 2008, the fee to BOLI equaling 1/10 of one percent (1%) of the Contract price shall be paid by the Public Agency (EWEB), not the contractor.

2) Questions and Answers:

Question: Is the concrete pad underlying the bolted steel floor the correct configuration?

Response: The concrete pad underlies the bolted steel floor per detail Y/C6.

Question: The ITB specified a modified C157 for shrinkage and we only run standard C157 for shrinkage testing. We don’t have any mixes with modified shrinkage data. Also, we need to know if the contractor needs air because air in shrinkage mixes make it more difficult to keep in spec.

Response: Standard C157 shrinkage data can be used for the Submittal provided item #2 below is met.

Question: The specs mention field shrinkage beams. Nobody in the area has a shrinkage room so all specimens would have to be transported to Salem or Portland for testing. There are a lot of things that can go wrong with them and with the third party.

Response: We have not encountered an issue on this with past reservoir projects. The modified ASTM C157 is used to ensure the shrinkage will likely meet the Specifications since 90% of the shrinkage occurs in the first 24 hours. Thus, if an issue is noticed immediately (24 hours later) the Contractor could modify construction activities accordingly. The standard ASTM C157 would not allow this knowledge for at least 7 days. We would allow the C157 standard testing provided work associated with the concrete is not performed until the first set of results are in. Ultimately the Contractor is responsible for ensuring the mix design and shrinkage limits are within the Specification limits at the end of the 28 day sample. Any work performed in this time frame would be at the Contractor’s own risk regardless of the test method.

Question: Looks like if air is needed, it will be 6% +/- 1% And we normally use +/- 1.5%.

Response: Per 03300.2.D.3.b. The maximum total volumetric air content shall be 6% plus or minus 1% and per 03300.2.D.3.c. the target range is between 3% and 6% volumetric air content. Thus, the air entrained when placed must be between 3% and an absolute max of 7% (6% + 1%).

Question: Can we can use 1L cement?

Response: Correct, Type II cement is specified. Without knowing the exact composition of the soils and groundwater of the site we use type II cement that is moderately sulfate resistant for structures such as retaining walls and foundations. We will accept the use of type 1 cement for thrust blocks and concrete collars but would require a separate submittal.

Question: Can slag be used?

Response: We will allow the use of fly ash and/or slag as long as the overall supplemental cementous materials (SCM) is within Specification limits.

Question: The specs state no more than 40% fine aggregate in our mix and we put whatever amount we need to make it perform correctly.

Response: Fine aggregate may exceed 40% by weight of combined aggregate weight if the maximum aggregate size is ½-inch. If larger course aggregates are used then the maximum is 40% as indicated in section 03300-2.B.4.b. PCC aggregate shall be in accordance with the 2021 Standard Specifications for Construction per section 03300.2.B.1. Contractor may refer to Section 02690 of the Oregon Standard Specifications for Construction and specifically the gradation tables including table 02690-5 “Gradation of Fine Aggregate” located on Page 1118.

Question: They say no more than 8% sand moisture, but we cannot control that in the winter or springtime.

Response: We have no objection with higher sand moisture content provided the moisture is included in the overall water content required for the mix design.

Question: Is DELVO required when the ambient temperature goes over 85 degrees?

Response: Correct. Delvo is used to retard setting time of concrete in hot weather conditions.

Question: The specs include a combined aggregate spec. We blend our aggregates how we need to and they will be close to the spec, can the blended aggregate be used?

Response: Section 03300.2.B.5.b. specifies that the Contractor may make minor adjustments to the gradation listed in Section 03300.2.B.5.a to produce the Specified concrete.
