About this file
This is Addendum #2 to an Invitation for Bids (IFB) issued by the Town of Dunstable for the restoration and painting of approximately 750 linear feet of historic wood fencing at Central Cemetery. The project scope includes repair, selective replacement, preparation, priming, and painting of the fence while preserving its historic design, materials, proportions, and appearance. Work is subject to review and acceptance by the Town and the Dunstable Cemetery Commission. Site visits are encouraged but not mandatory; inspections must be observational only and shall not disturb the fence or cemetery property. The bid was due October 21, 2026, with anticipated commencement no later than October 27, 2026, and a completion deadline of November 30, 2026. Questions from prospective bidders were required to be submitted in writing no later than October 14, 2026 at 5 PM to Jason Silva at jsilva@dunstable-ma.gov. All bidders must acknowledge receipt of this addendum and Addendum #1 using the provided Addenda Acknowledgment Form submitted with their bid response.
Bidders must submit a single all-inclusive lump-sum price for the complete base scope, with a bid deposit equal to 5% of the total bid amount (acceptable as a bid bond, certified check, or treasurer's/cashier's check payable to the Town of Dunstable). No unit price schedule is required. The project does not require DCAMM certification or performance bonds, but a payment bond equal to 50% of the actual contract price is required from the successful bidder upon contract execution. Insurance requirements include general liability ($1,000,000 per occurrence/$2,000,000 aggregate), automobile liability ($1,000,000 combined single limit), excess liability ($2,000,000), and workers' compensation per Massachusetts statutory requirements. The contractor must demonstrate at least three years of relevant experience in each trade to be self-performed, with approved subcontractors also meeting the three-year requirement. The warranty period is one year from the Town's written final acceptance, covering defective workmanship, loose or failed repairs, and coating failure, excluding damage from abuse or vandalism. Lead-remediation costs must be included in the base bid scope. Weekly progress invoices are permitted with retainage not exceeding 5% of approved periodic payments. All employees performing covered work must complete OSHA-approved training of at least ten hours before beginning work.

Addendum #2: Invitation for Bids - Central Cemetery Fence Restoration and Painting
This addendum modifies the original solicitation as described. The addendum may contain supplemental information, clarifications to the solicitation, or substantive changes to terms and conditions, unit pricing, or submittal dates and times. Those submitting a response to the solicitation are required to sign and acknowledge this addendum and include the form in the response. Failure to do so may result in rejection of the response.
Purpose: The Town of Dunstable is seeking a qualified contractor to repair, selectively replace, prepare, prime, and paint approximately 750 linear feet of historic wood fencing at Central Cemetery. The purpose of the work is to restore the fence to a sound condition while preserving its historic design, materials, proportions, and appearance. All work is subject to review and acceptance by the Town and the Dunstable Cemetery Commission.
Addendum to Specification: This Addendum provides responses to questions received from prospective bidders. This Addendum becomes part of the Invitation for Bids and contract documents.
Bidders should acknowledge receipt of this Addendum as required by the IFB.
Question 1: DCAMM certification Does this project require DCAMM certification?
Response: No. This project is a public works procurement under M.G.L. c. 30, §39M for restoration and painting of a cemetery fence. DCAMM certification is not required. All applicable licensing, training, experience, and other qualification requirements remain in effect.
Question 2: Prebid meeting and site visits Is a mandatory meeting required, and how may a bidder arrange a visit?
Response: No mandatory pre-bid meeting is required. As stated in Addendum 1, Central Cemetery is publicly accessible and bidders are encouraged to inspect the site. Inspections shall be observational only and shall not disturb the fence or cemetery property. Questions must be submitted in writing; only written addenda modify the bid documents.
Question 3: Bid security Is a bid bond required with the October 21 submission?
Response: A bid deposit equal to 5% of the total bid amount must accompany the bid. A bid bond is one permitted form; a certified check or treasurer’s/cashier’s check issued by a responsible bank or trust company is also acceptable, as clarified in Addendum 1. Checks shall be payable to the Town of Dunstable. The payment bond is separate and is required from the successful bidder with the signed contract.
Question 4: Completion date What is the required completion time?
Response: The stated completion date is November 30, 2026. The IFB anticipates commencement no later than October 27, 2026. Any extension requires mutual written agreement of the Town and
Contractor. The reference to November 30, 3026 is corrected to November 30, 2026. See Question 16 for the proposed clarification of award and commencement dates.
Question 5: Liquidated damages Are there liquidated damages?
Response: The IFB does not establish a liquidated damages amount or daily rate. No liquidated damages are specified for this project. The Town’s other contractual remedies for delay, default, defective work, and nonperformance remain applicable.
Question 6: Warranty What is the warranty period?
Response: The Contractor shall warrant labor and materials for one year from the Town’s written final acceptance. Coverage includes defective workmanship, loose or failed repairs, premature coating failure, peeling, blistering, and failure of replacement materials, excluding damage caused by abuse, vandalism, or conditions outside the Contractor’s control. Corrections shall be performed promptly and without additional cost to the Town. This final-acceptance starting date governs any inconsistent reference in the attached contract form.
Question 7: Subcontracting May the prime contractor perform coatings work and subcontract historic carpentry, and can approval be established before bidding?
Response: Yes, the Town will allow this arrangement subject to Town approval of the proposed subcontractor. Submit the subcontractor’s name, assigned scope, relevant experience, references, and applicable licenses or registrations. The prime contractor remains responsible for all contract work. No subcontracted work may begin without Town approval.
Question 8: Experience with subcontracted trades Must the prime contractor itself have three years of historic wood carpentry experience?
Response: The prime contractor must demonstrate at least three years of relevant experience in each trade it will self-perform. An approved carpentry subcontractor must demonstrate at least three years of relevant experience in its carpentry trade, including work demonstrating its ability to match the historic fence components. The prime contractor need not itself have three years of carpentry experience if that entire scope is assigned to an approved, qualified subcontractor. This clarification does not waive the three-year minimum confirmed in Addendum 1.
Question 9: Lead paint Has lead testing been performed, and may remediation be carried as an allowance or change order?
Response: No separate lead-remediation allowance is established. Bidders should include in their lump-sum bid all costs necessary to comply with the IFB’s environmental and safety requirements for potentially lead-containing materials, including worker and public protection, containment, collection, handling, and disposal. These requirements are part of the base scope and should not be carried as an allowance or change order. Conditions truly outside of the contract scope will be addressed, as needed, through prior written authorization and an approved change order.
Question 10: Lump sum and quantity adjustments Will a unit price schedule be issued, and how will overruns and underruns be paid?
Response: Submit one all-inclusive lump-sum price on the Price Quote Form for the complete base scope, including preparation and painting of approximately 750 linear feet and the estimated repairs and replacements listed in the IFB. No separate unit price schedule is required for bid submission. The references to “each unit price” and payment based on actual quantities in the Basis of Bid and Payment section are deleted. Material additions or deletions to the specified repair and replacement quantities shall be documented and priced by a mutually executed written change order before the affected work proceeds. No unauthorized additional work will be paid.
Question 11: Drawings and profiles Will the Town provide drawings, elevations, profiles, or photographs?
Response: The existing fence establishes the historic configuration to be matched. Bidders are able to inspect existing conditions in advance of the bid due date. The successful contractor will need to obtain final field measurements and submit samples, detailed photographs, or shop drawings for approval of each replacement component before fabrication or installation.
Question 12: Fence geometry and paint area
What are the fence height, boards per bay, picket spacing, and paintable surface area?
Response: The approximately 750 linear feet describes the fence length, not paintable surface area. The painting scope includes all exposed faces, edges, ends, joints, and accessible surfaces. The Town has not supplied a verified paintable-area calculation in the IFB.
Question 13: Restoration and replacement quantities Are the listed replacement quantities included within the 750 linear feet or additional to it?
Response: The listed replacement components describe repairs within the approximately 750-linear-foot fence restoration scope; they do not represent additional fence runs beyond that overall length. Multiple components may occur in the same fence bay. Approximately 50 pickets are also identified for replacement. The entire specified fence is to be prepared and painted, with selective replacement of approved deteriorated components. Quantities are estimates and replacement locations require Town approval.
Question 14: Joints and granite posts Are the approximately 40 failed joints wood-to-wood joints, with no work to granite posts?
Response: The scope calls for repair and secure refastening of approximately 40 loose or failed joints or unions above the granite posts. Granite posts must be protected and shall not be altered or damaged.
No restoration or replacement of the granite posts themselves is identified in the IFB.
Question 15: Gates Are gates excluded from the scope?
Response: Gates are included as part of the 750-linear-foot fence restoration scope.
Question 16: Award and weather limitations How are the sixty-day award period and October 27 commencement reconciled, and may completion be extended for coating temperatures?
Response: The sixty-day award provision is the outside period for award and does not require the Town to wait sixty days. The Town anticipates prompt award following the October 21 opening. October 27 is the anticipated commencement date, subject to execution of the contract, receipt of required bonds and insurance, and the Town’s written authorization to proceed. No work shall begin before those requirements are satisfied. If award or authorization occurs later, commencement and any necessary completion-date adjustment shall be established in writing. November 30, 2026 remains the intended completion date unless extended by mutual written agreement. Coatings shall not be applied outside manufacturer requirements for temperature, moisture, weather, drying, or recoating. Extension requests must be submitted promptly with supporting information and in accordance with the contract’s notice requirements; extensions are not automatic.
Question 17: Test section and paint selection What are the test-section size and location, review turnaround, and paint-selection timing?
Response: The Contractor shall obtain acceptance of the representative test section before full-scale work. The Town shall select or approve color and sheen before materials are ordered. Do not order coatings or proceed on an assumed approval. Turnaround and paint-selection timing will be expedient.
Question 18: Invoicing and retainage Does completion-only payment or weekly progress invoicing govern?
Response: Weekly progress invoices as provided in Section 5 of the contract form are permitted. Each invoice shall identify accepted work performed, the amount requested, and supporting certified payroll documentation. The completion-only payment sentence in the IFB is deleted. Progress payments, retainage, substantial completion, and final payment shall conform to M.G.L. c. 30, Section 39G, applicable to public works. The reference to Section 39K in Section 5(b) is replaced with Section 39G.
Performance retainage shall not exceed 5% of an approved periodic payment, and its reduction and release shall follow applicable law. Final payment is subject to completion, required documentation, and the applicable statutory procedures.
Question 19: Contract bonds and insurance Is the performance bond optional, what is the payment-bond basis, and what insurance limits apply?
Response: As clarified in Addendum 1, the required payment bond is 50% of the actual contract price, not 50% of the $60,000 estimate. Any contrary IFB reference is superseded. The contract form includes a requirement for a 100% performance bond followed by an “optional” drafting notation. A performance bond is not required for this project. Section 12 of the attached contract form is deleted. Insurance is specified in Section 6 of the attached contract form: general liability, $1,000,000 per occurrence and $2,000,000 aggregate, occurrence basis; automobile liability covering owned, hired, and non-owned autos, $1,000,000 combined single limit per accident; excess liability, $2,000,000 above underlying limits, no more restrictive than underlying coverage; workers’ compensation and employer’s liability as stated in the contract form under Massachusetts statutory requirements. Evidence of required insurance is due before work begins. Other Section 6 requirements remain applicable.
Question 20: OSHA documentation What OSHA documentation is due with the bid and at contract signing?
Response: Submit the signed OSHA Training Certification form with the bid. Each employee performing covered work must have completed the required OSHA-approved training of at least ten hours before beginning work. The selected contractor will need to provide documentation for its initially assigned workforce upon contract signing and shall furnish each employee’s completion documentation with the first certified payroll report on which that employee appears. The legal advertisement’s reference to OSHA certification with the bid means the signed bidder certification form, rather than individual completion cards for every worker.
Question 21: Questions and further addenda What is the deadline for questions and when will further addenda issue?
Response: Send written questions to Jason Silva at jsilva@dunstable-ma.gov no later than Wednesday, October 14, 2026 at 5 PM. Any further interpretation or change will be issued by written addendum on the Town’s website. Bidders are responsible for checking for and acknowledging every addendum. If a material clarification or change requires additional bidding time, the Town will announce a revised bid deadline by addendum.
Firms that intend to submit a proposal must include the Addenda Acknowledgement Form with their response and must acknowledge the receipt of Addendum #1.
The Addenda Acknowledgement Form is posted on the Town’s website, www.dunstable-ma.gov and is included with this addendum.
