About this file

This Addendum Number 1, issued by the New Hampshire Department of Natural and Cultural Resources, Division of Parks and Recreation, Bureau of Trails on July 31, 2026, provides clarifications to bidders regarding Project TB-2603, the Rail Removal and Salvage Project on the Berlin Branch Rail Corridor in Bethlehem, NH. The project encompasses the removal and salvage of approximately 2.25 miles of rail, rail components, ties, and railroad-related infrastructure beginning 650 feet north of Oxbow Drive and extending 2.14 miles east to a point west of Wing Road. The scope includes dismantling rail, joint bars, tie plates, and all railroad ties within the right-of-way, with particular clarification that an additional 0.11-mile segment (approximately 360 ties) where rails have already been removed must be included in the tie disposal scope. Bidders were required to submit questions by July 24, 2026, and this addendum represents the state's responses to those inquiries, which must be acknowledged in the proposal form to avoid disqualification.

The addendum clarifies several critical contract terms: Davis-Bacon prevailing wages do not apply to this project; no warranty period is applicable; and while no permits are anticipated as described, the contractor bears responsibility for obtaining any permits that prove necessary. The contractor must furnish all required 3'x3'x3' wooden crates for recovered joint bars, tie plates, and rail anchors, and must transport all salvaged materials to the NHDOT rail yard in Whitefield, New Hampshire. The project is funded through the National Recreational Trails Program and private donations, with an anticipated start date of November 10, 2026, and completion deadline of October 29, 2027. The contract is structured as a lump-sum arrangement with a $10,000 allowance for unanticipated modifications, and liquidated damages of $300 to $600 per working day apply for delays beyond the completion deadline.

CLARIFICATION TO BID QUESTIONS:

1. Please clarify if Davis Bacon / Prevailing Wages are applicable to this project.

2. Please clarify if there is a warranty period applicable to this contract.

1. RESPONSE: no, there is no warranty period applicable for this contract.

3. Please clarify if Contractor will be required to provide any permits for this project.

4. Please confirm the extent of ties ‘additional’ to the 11,300 TF of track removal required to be included in the project tie disposal scope. (This is assumed to be 2.25 miles less 2.14 miles = 0.11 miles [~360 ties]).

1. RESPONSE: correct, all ties within the ROW from Oxbow Road north to the end location for this project need to be removed. This includes the small segment (roughly 650’ or 0.11 mile) starting at Oxbow Road heading north where the rails have already been removed but ties are left in place.
