About this file
This document is an Addendum to the Invitation for Bid (IFB) #13-2024 for Stone issued by the Town of Front Royal, Virginia. The key changes in this Addendum include revisions to the award criteria, removing the term of contract language, and requiring bidders to acknowledge receipt of the Addendum.
The IFB solicits written quotes for firm pricing on various grades of stone for a one-year period once awarded. The Town reserves the right to award multiple contracts to the lowest responsive and responsible bidder(s) for each required good or service. Pricing will be evaluated based on the firm fixed unit price bid for each item, and the Town may negotiate with the apparent low bidder(s) if the bids exceed available funds.

TO THE CONTRACT DOCUMENTS FOR: IFB# 13-2024 STONE
PREPARED BY: MEGAN CLARK, ASSISTANT PURCHASING AGENT
The following revisions, additions, and clarifications are hereby made part of the Contract

REVISIONS
AD1-1
Specification Section 4.0 General Terms and Conditions: -REPLACE “Award of Contract or Contracts: Selection shall be made of two or more offerors deemed to be fully qualified and best suited among those submitting proposals on the basis of the evaluation factors included in the Request for
Proposals, including price, if stated in the Request for Proposals. Negotiations shall be conducted with the offerors so selected. Price shall be considered but need not be the sole determining factor. After negotiations have been conducted with each offeror selected, the agency shall select the offeror which, in its opinion, has made the best proposal, and shall award the contract to that offeror. The Town reserves the right to make multiple awards as a result of this solicitation. The Town may cancel this Request for Proposals or reject proposals at any time prior to an award and is not required to furnish a statement of the reasons why a particular proposal was not deemed to be the most advantageous (Code of Virginia, § 2.2-4359D). Should the Town determine in writing and in its sole discretion that only one offeror is fully qualified, or that one offeror is clearly more highly qualified than the others under consideration, a contract may be negotiated and awarded to that offeror. The award document will be a contract incorporating by reference all the requirements, terms and conditions of the solicitation and the contractor’s proposal as negotiated.” WITH
“AWARD CRITERIA
A. The Town reserves the right to accept or reject all or any part of the bids, waive minor technicalities, informalities, and award the contract to the lowest responsive and responsible bidder to best serve the interest of the Town. Further, the Town reserves the right to award multiple contracts for all the specified items(s) or service(s) to more than a single bidder. Multiple contracts may also be awarded to the lowest responsive and responsible bidder for each required good, service, or equipment. The unit price for each individual item on the Official Town Bid Form will be used to ascertain if multiple contract awards are in the best interest of the Town.
B. In order for the bids to be considered for award, all requested information on the Official
Town Bid Form must be provided (i.e. Delivery, Terms, Bidder Address/Phone No., Extended Price, Specifications met, Signature, Printed Name and Date). Bidders should review the Official Town Bid Forms before submission to insure there are no omissions or blanks.
C. A low bid will be determined by using the firm fixed UNIT price bid submitted for each item, as shown on the Official Town Bid Form, that completely satisfies the specifications, terms, and conditions of this invitation for bid. The firm fixed unit price offered shall be all inclusive, no additional costs will be allowed.
D. Unless canceled or rejected, a responsive bid from the lowest responsible bidder(s) shall be accepted as submitted, except that if the firm fixed price bids from the lowest responsive responsible bidders exceeds available funds, the Procurement Officer or designee may negotiate with the apparent low bidders to obtain a contract price within available funds.”
