About this file

This Addendum #1 is issued by Deming Public Schools for Invitation for Bid (IFB) 24-14 related to Dairy Products procurement. The document, dated March 28, 2025, provides supplemental information for potential bidders, specifically highlighting two key federal regulatory requirements that will apply to the dairy products contract. The addendum does not specify exact product quantities, delivery schedules, or contract duration, but provides contact information for procurement inquiries through Kimberly Cardoza, the Chief Procurement Officer, who can be reached at (575) 546-8841 or Procurement@demingps.org.

The addendum emphasizes two critical federal compliance requirements for bidders: the Byrd Anti-Lobbying Amendment and the "Buy American" provision of the Rural Electrification Act of 1936. For contracts exceeding $100,000, contractors must certify they have not used federal funds to influence government officials and must disclose any lobbying activities. Additionally, the "Buy American" provision encourages the use of manufactured articles, materials, and supplies produced in the United States or eligible countries, with consideration given to practicality and reasonable costs. Potential bidders are advised to carefully review these requirements before submitting their proposals for the dairy products contract.

Addendum #1

IFB 24-14 Dairy Products

Please note the following has been added as part of the IFB.

Code of Federal Regulations

I. Byrd Anti-Lobbying Amendment (31 U.S.C. 1352)—Contractors that apply or bid for an award exceeding $100,000 must file the required certification. Each tier certifies to the tier above that it will not and has not used Federal appropriated funds to pay any person or organization for influencing or attempting to influence an officer or employee of any agency, a member of Congress, officer or employee of Congress, or an employee of a member of Congress in connection with obtaining any Federal contract, grant or any other award covered by 31 U.S.C. 1352. Each tier must also disclose any lobbying with non-Federal funds that takes place in connection with obtaining any Federal award. Such disclosures are forwarded from tier to tier up to the non-Federal award.

II. The “Buy American” provision of the Rural Electrification Act of 1936 (RE Act) requires, to the extent practicable and the cost of which is not unreasonable, that RUS Borrowers use loan funds only for such manufactured articles, materials, and supplies as have been manufactured in the United States or in any eligible country, substantially all from articles, materials, or supplies mined, produced or manufactured, as the case may be, in the United States or any eligible country.
