About this file

This document is an addendum to an Invitation to Bid (ITB) issued by the Florida Department of Agriculture and Consumer Services (FDACS) for a Radio/Cellular GPS Fire Resource Tracking System. The addendum provides responses to questions received regarding the ITB, which seeks the outright purchase and delivery of this system to track the inventory of the Florida Forest Service firefighting equipment. The addendum clarifies that FDACS wants a fully functional system delivered by the awarded vendor, including the cellular connectivity, and that no additional terms or conditions will be considered outside of those specified in the ITB. The contract opportunity covers the state of Florida, including the jurisdictions of Leon County and Tampa City.

The addendum also states that if FDACS receives less than two responsive bids, they reserve the right to negotiate the best terms and conditions with the single responsive vendor. Furthermore, the addendum confirms that mobilization funds or a down payment will not be available, and that the purchase order terms and conditions outlined in the ITB will apply.

ADDENDUM 1

TO: VENDORS

FROM: CHANNCEN BELL, PROCUREMENT OFFICER

RE: INVITATION TO BID NO. ITB FFS 23 24 70

RADIO/CELLULAR GPS FIRE RESOURCE

TRACKING SYSTEM

This addendum is to provide answers to questions received in reference to this invitation to bid.

Question / Answer

1. With reference to the Vendor providing two years of dual SIM connectivity with major carriers, would FDACS consider purchasing cellular connectivity services separately and directly from the major carriers via the FL State Mobile Communication Services Contract No: DMS-19/20-006B?

No, we want a fully functional system delivered by the awarded vendor to include the cellular connectivity.

2. In the event that FDACS receives less than two (2) responsive bids, proposals, or replies for commodity or contractual services purchases, the Department reserves the right to negotiate the best terms and conditions with the single Responsive Vendor pursuant to 287.057 (6) F.S.

Are mobilization funds (a down payment) of some percentage of the contract amount available before delivery of commodities?

In the event the department receives one bid, terms and conditions from the single respondent may be negotiated in the best interest of the state.

3. The FDACS objects to and shall not consider any different or additional terms or conditions submitted by a Bidder, including any appearing in documents attached as part of a Bidder’s response. In submitting a response, a Bidder agrees that any additional or different terms or conditions, whether submitted by Bidder intentionally or inadvertently, shall have no force and effect and shall be grounds for rejecting a Bid. Bidder’s failure to agree to comply with FDACS’ terms and conditions, including those specifying information that must be submitted with a Bid, shall be grounds for rejecting a Bid.

Will there be an opportunity for the Recommended Awardee to request terms and conditions other than identified in 3.11 after the Recommend Award and before a Purchase or Contract is issued as a result of the ITB?

At this time, no other terms or conditions shall be introduced to the department. Any vendor that would like to bid on this advertisement, shall do so by acknowledging only the terms and conditions within the solicitation. The department’s intent is to issue a purchase order for the desired product and or services as specified in the solicitation.

The purchase order terms and conditions may be found in section 4.1 Purchase order terms and conditions.

4. More than one bid from an individual, firm, partnership, corporation or association, under the same or different names, will not be considered.

Reasonable grounds for believing that a bidder is interested in more than one bid for the same work will cause the rejection of all bids in which such bidders are believed to be interested. If there is reason to believe that collusion exists among the bidders, any or all bids will be rejected. No participants in such collusion will be considered in future bids for the same work. Falsifications of any entry made on the bidder's offer will be deemed a material irregularity and will be grounds for rejection.

Would a vendor and their dealer/distributor in another state be in violation of 3.24 above, if both submit bid responses?

No. However, if there is reason to believe that collusion exists among the vendors, any or all bids will be rejected.

This Addendum is hereby incorporated into and made a part of the above noted Invitation to Bid. All other terms, conditions and specifications of this Invitation to Bid will remain the same. For questions regarding this Addendum, please contact the Purchasing Office at email at Bids@FDACS.gov.
