About this file

This is Addendum 1 to an Invitation to Bid (ITB FFS 26 27 42) issued by the Florida Department of Agriculture and Consumer Services (FDACS) for Darley brand brush truck pumps. The addendum addresses three critical questions submitted by potential bidders prior to the October 8 bid deadline. The solicitation seeks competitive bids on Darley Model 1 AGE 21H pump products, with FDACS clarifying that bidders need not be authorized Darley dealers or distributors themselves; wholesalers and resellers may submit bids as prime vendors provided they supply the exact products and specifications required. No manufacturer or authorized-dealer letter is required with bids; bidders need only be registered and current with My Florida MarketPlace.

The Department will not accept requests for approved equivalent products under Section 3.4 of the original ITB and requires strict adherence to the specified Darley model. All other terms, conditions, and specifications from the original Invitation to Bid remain unchanged. Bidders with questions should contact the Procurement Officer at Bids@FDACS.gov or the Procurement Office at (850) 617-7180. Protests must be filed with the Department's Agency Clerk in accordance with Florida Statutes Section 120.57(3) and must include required bond or security within the prescribed timeframe.

Question Number

Question Answer

Please confirm whether the bidder itself is required to be an authorized Darley dealer/distributor, or whether a wholesaler/reseller may submit a bid as the prime vendor provided the exact products and specifications required by the ITB are supplied.

FFS does not have an issue with a wholesaler/reseller bidding on the specified pump provided it meets the exact specifications as stated.

Section 2.1 specifies the Darley Model 1½ AGE 21H. Will the Department consider requests for approved equivalents under Section 3.4, and if so, what documentation is required to establish equivalency?

FFS will not accept equivalents.

Is a manufacturer or authorized-dealer letter required with the bid? If so, is there a path for a newly authorized Darley dealer to qualify before the October 8 deadline?

No letter is required. Only that the bidder has registered/up-to-date with My Florida Market Place.

This Addendum is hereby incorporated into and made a part of the above noted Invitation to Bid.

All other terms, conditions, and specifications of this Invitation to Bid will remain the same. All questions regarding this Addendum should be submitted in writing to the Procurement Officer at Bids@FDACS.gov or contact the Procurement Office at (850) 617-7180.

Failure to file a protest within the time prescribed in Section 120.57(3), Florida Statutes, or failure to post the bond or other security required by law within the time allowed for filing a bond shall constitute a waiver of proceedings under Chapter 120, Florida Statutes. Protests must be filed with the Department’s Agency Clerk. Filings may be made physically at:
