About this file

This Addendum 02 is issued by the West Virginia Department of Environmental Protection Office of Oil and Gas for a federally funded Agency Request for Quote (ARFQ) solicitation DEP2600000013 for the construction, reclamation, and plugging of twenty (20) orphaned and abandoned wells in Wayne County, West Virginia, collectively known as the Federal E3 Multi-Well Plugging Package Group A. The solicitation requires permitting, well plugging, and well reclamation services across multiple wells identified by their API numbers. A mandatory pre-bid meeting was held on-site on August 27, 2025 at 9:00 a.m. Eastern time, with the technical questions deadline set for September 2, 2025 at 2:00 p.m. Eastern time. Bids must be submitted electronically through wvOASIS Vendor Self Service (VSS) by September 10, 2025 at 10:30 a.m., with all bids to be invoiced and shipped to the Environmental Protection Office of Oil & Gas at 601 57th Street SE, Charleston, West Virginia. The addendum primarily serves to publish vendor questions and responses and to incorporate current Federal Wage Determinations applicable to the project.

Addendum 02 incorporates Wayne County-specific Federal Wage Determinations (General Decision Number WV20250076, effective 06/06/2025) as required by 29 CFR 1.6(c)(3)(i) to ensure compliance with the Davis-Bacon Act. The contract is subject to Executive Order 14026, requiring contractors to pay all covered workers at least $17.75 per hour for 2025 (or applicable wage rates if higher), and Executive Order 13706, mandating one hour of paid sick leave for every 30 hours worked. Wage determinations specify rates for classifications including Power Equipment Operators, Ironworkers, Laborers, Painters, Cement Masons, Truck Drivers, and Carpenters, with rates ranging from approximately $21.44 to $41.95 per hour plus fringes. Key responses to vendor questions address Davis-Bacon applicability, reclamation requirements including seeding of access roads, stream crossing air bridge mandates, permit responsibilities including floodplain permits and DOH permits, and the requirement for MM-109 permits for all roads and entrances per DOH Oil and Gas policy. Contractors are responsible for obtaining all necessary permits and are liable for damages to property during project execution.

Note that those who perform construction-related work on-site, immediately before construction to support the construction crew, would be doing work physical/manual labor that must be covered under Davis-Bacon (ref. 88 FR 57526, effective 10/23/2023. In these cases, surveying is in support of plat generation (i.e., property boundaries) rather than engineered construction.

https://www.govinfo.gov/content/pkg/FR-2023-08-23/pdf/2023-17221.pdf).

Q2. Do all access roads need to be seeded in order to be considered properly reclaimed?

Answer: Yes, if they had grass prior to the project. The goal is to leave it as it was found, unless otherwise noted. A dirt path that is obviously being used by the landowner does not need to be re-seeded. Any ruts created during the project must be re-contoured.

Q3. If there are other wells along the same access road, can seeding and mulching be delayed until all wells along that road have been plugged.

Answer: Yes, but note that the well would not be released until its access road is reclaimed.

Q4. Do all stream crossings have to have an air bridge?

Answer: Yes, pursuant to our Authorization to Proceed (ATP) for this project granted by the Department of the Interior, all stream crossings must be accomplished with an air bridge. The agency is aware of one required air bridge that will require temporary supports due to the length of the span. The Agency will permit temporary supports to ensure safe crossing.

Q5. If culverts were recently installed along an access road, can we replace them with stronger ones that span a wider roadway?

Answer: Yes, this is considered to be a road upgrade.

Q6. What is required for the survey (i.e., plat)?

Answer: Reference: 35CSR4 §9.2, “Additional Requirements for Plats,“ e.g. permanent landmarks, physical location of well, size and scale, etc.

Q7. If it becomes necessary for the Contractor to remove the refuse from the wellsite at 47-099-02117, is the Contractor liable for any damages to those items?

Answer: Yes, in all cases of damage claims against the agency filed by surface owners, the Contractor is liable. That said, it is unclear if the owner of the refuse has a legal claim as a surface owner because they do not, in fact, own the surface tract where their refuse is located. We anticipate that the neighbor’s equipment will be moved from the well with API #47-099-02117, but if it is not, care should be taken not to damage it.

Q8. Will DEP provide a list of archaeology contractors?

Answer: No, the agency cannot be perceived as recommending one vendor over another. DEP has searched for such a contractor online and identified at least one in the state performing this kind of work.

Q9. Must we remove gas lines, e.g. the line visible between 47-099-02183 and 47-099-02232?

Answer: in regards to production lines that were or are connected to the well being plugged, if it's exposed, take it, but don't dig anything out.

Q10. At the wells with API # 47-099-02232 and 47-099-02183, does the culvert need to be improved where the access road meets the county road?

Answer: Yes.

Q11. Regarding the DOH permit, will there need to be a separate bond for each access?

Answer: This decision may only be made by DOH, but it is the Agency’s understanding that all permits can be covered by a blanket bond of $50,000.

Q12. Is the contractor responsible for obtaining a floodplain permit (building permit) from Wayne County for the air bridge in the FEMA floodplain/100-year floodplain for Hurricane Creek?

Answer: The Contractor is responsible for obtaining all applicable permits, including floodplain permits, where needed.

Q13. Are MM-109s required for all roads and entrances?

Answer: Pursuant to DOH’s Oil and Gas policy, MM-109 permits are required for ALL oil and gas projects.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the

Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses

(29CFR 5.5 (a) (1) (iii)).

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.

Union Rate Identifiers

A four-letter identifier beginning with characters other than

""SU"", ""UAVG"", ?SA?, or ?SC? denotes that a union rate was prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.

0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.

Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.

Union Average Rate Identifiers

The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:

UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.

The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.

A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.

Survey Rate Identifiers

The ""SU"" identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007

6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.

?SU? wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).

State Adopted Rate Identifiers

The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007

01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.

The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.

WAGE DETERMINATION APPEALS PROCESS
