Statement of Work (SOW) Naval Special Warfare Command

P9290 Gas Analysis IDIQ

1. BACKGROUND

1.1 Naval Special Warfare Command (NAVSPECWARCOM) and its Echelon III and

IV commands and other NAVSEA representatives require off-gas testing and sampling services in support of its Deep Submergence Systems (DSS) and Divers Life Support Systems (DLSS) programs; these requirements are in accordance with NAVSEA standards for manned submersibles. The requirement to conduct off gas tests and off gas sampling analysis of non-metallic components may only be conducted at NAVSEA accepted laboratories.

2. OBJECTIVES

2.1 Establish an Indefinite Delivery Indefinite Quantity (IDIQ) services contract to support the on-demand need for non-metallic off gas test and sampling analysis.

The Contractor’s facility acceptance and testing procedures shall be in accordance with the standards contained in NAVSEA SS800-AG-MAN-010 to support on demand off gas test and analysis.

2.2 The number of articles that require analysis depends upon numerous modernizations, obsolescence part replacements, and routine replacement parts efforts in the NAVSPECWARCOM undersea mobility assets. This IDIQ will optimize efficiency through task order control of work orders.

3. SCOPE

3.1 This SOW defines the tasks that shall be performed as part of an IDIQ for NAVSPECWARCOM. The Contractor shall provide the personnel, management, and materials required for the performance of laboratory gas analysis to support NAVSPECWARCOM undersea mobility systems in accordance with NAVSEASYSCOM (NAVSEA) requirements for such samples.

4. REQUIREMENTS

4.1 The Contractor shall provide a testing facility that has been accepted in accordance with the procedures contained in SS800-AG-MAN-010/P9290. The “Acceptance” status of the Contractor’s facility shall be maintained throughout the period of performance.

4.2 The Contractor shall perform gas analysis IAW SS800-AG-MAN-010/P9290 Appendix F and any other governing regulations as defined at the task order level.

4.3 Testing under this contract shall include the following. Reference Attachment 01 –

Gas Analysis ELIN Price List for pricing info.

4.3.1 Samples Taken at Government Test Chamber. The Government and Contractor shall coordinate the delivery of the sample. The Government may utilize Government Furnished Property (GFP) sample bottles or the Contractor’s Sampling Bottle, and/or Sorbent Tubes to obtain a gas sample then submit to the Contractor for analysis as defined at the task order level. Contractor shall conduct Normal Gas Analysis and report assay results within 15 calendar days of assay receipt. Chamber and Sorbent Tube sample analysis.

4.3.2 Expedited Analysis and Report within three Business Days. The

Government and Contractor shall coordinate the delivery of the sample to provide the Contractor three concurrent business days to complete the analysis. The purpose of the expedited sample should be limited to mission essential needs or times when an initial sample is required to verify a test chamber’s cleanliness; thereby reducing the idle time between validating a test chamber’s cleanliness and testing an article for gas analysis. 4.3.3 Normal Gas Analysis and report – Solids - Samples taken at Contractor’s Test Chamber. The Government and Contractor shall coordinate the delivery of the sample to provide the Contractor 15 business days to complete the analysis.

4.3.4 Expedited Analysis and report within 3 business days – Solids - Samples taken at Contractor’s Test Chamber. The Government and Contractor shall coordinate the delivery of the sample to provide the Contractor three concurrent business days to complete the analysis. The purpose of the expedited sample should be limited to mission essential needs or times when an initial sample is required to verify a test chamber’s cleanliness;

thereby reducing the idle time between validating a test chamber’s cleanliness and testing an article for gas analysis.

4.3.5 The Contractor shall provide verified clean sampling rigs and bottles for

Government use in collecting air samples. The Contractor shall provide documentation that rig is verified clean and ship in a suitable manner for protection. The Government will have up to 30 days to take the air sample and return it to the Contractor for follow on analysis.

4.3.6 The Contractor shall provide sorbent tubes for local atmospheric testing upon Government request. The Government shall provide its own sampling pump, and record the results of the colorimetric (sorbent) tube sampling by recording the values and taking photos of the tubes upon completion of the testing..

4.3.7 The Contractor will use their own Chamber (required for Solids Samples at Contractor Facility - small chamber) for testing of solids delivered to their facility.

4.3.8 The Contractor will use the Large Chamber, provide as Government Furnished Equipment (GFE), to Sample Off-Gas Testing of Solids Samples at Contractor Facility. Includes cleaning and QC of the chamber, sample preparation/curing, chambering, off-gas collection and analysis of off-gas per the protocol.

4.4 Participate in a Post-Award Conference.

4.4.1 This meeting shall provide an introduction between the Contractor personnel and Government personnel who will be involved with the contract. The meeting shall provide the opportunity to discuss technical, management and security issues. The Post Award Conference will aid both the Government and Contractor in achieving a clear and mutual understanding of all requirements and identify and resolve any potential issues. The Contractor shall be prepared to discuss any items requiring clarification and gather information as necessary to support each deliverable.

6. CONTRACTOR MANPOWER REPORTING

6.1 The Contractor shall report ALL sampling invoices (including subcontractor labor hours) required for performance of services provided under this contract for Naval Special Warfare Command via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: http://www.SAM.gov. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk at help desk at:

7. CONTRACTOR TRAVEL

7.1 Contractor travel is not authorized for the performance of this contract.

8. SECURITY

8.1 The Contractor shall establish appropriate administrative, technical, and physical safeguards to protect any and all nonpublic Government data to ensure the confidentiality, integrity, and availability of Government data.

8.2 MARKINGs: The Contractor shall refrain from using “Naval Special Warfare Command” (NSWC), reference to any NSWC personnel by title or position within NSWC, or this contract in any of its publications, websites, materials, media or advertising media.

9. SAFETY

9.1 The Government is responsible for proper shipment of pressurized cylinders when shipping to the Contractor for analysis. 9.2 The Contractor shall ensure all materials and components are properly labeled and marked for shipment.

9.3 Nothing in the SOW, nor any Government action or failure to act in performance of the contract shall relieve the contractor of its responsibility for the safety of the contractor's personnel and property, the Government's personnel and property.

Furthermore, nothing in this PSW shall relieve the contractor of its responsibility for complying with applicable Federal, State, and Local laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.

10. GOVERNMENT FURNISHED PROPERTY/EQUIPMENT/INFORMATION

(GFP/GFE/GFI)

10.1 The Government is responsible for all shipping costs for items shipped to the Contractor’s testing facilities. The Government is also responsible for the cost of return shipping of Government Furnished Equipment that was submitted for testing at the Contractor’s facility. The Government shall coordinate delivery and receipt of these items with the Contractor.

10.2 The Government is providing, Government Furnished Equipment (GFE), a test chamber. Please see Attachment 01 – Large Test Chamber drawing.

11. QUALITY CONTROL

11.1 The Contractor shall implement and maintain a Quality Control Plan (QCP) to ensure work performed conforms to the scope of work and meets the requirements under this SOW. The QCP shall, at a minimum provide a method for performing inspections; identifying, correcting and preventing problems/defective service;

addressing customer complaints, and improving the quality of services over the life of the contract.

12 QUALITY ASSURANCE

12.1 The Government reserves the right to perform inspections and surveillance to evaluate the Contractor’s compliance to the contract terms and performance of the requirements in the SOW. The Government will make every effort to ensure that the surveillance methods used are conducted in an objective, fair, and consistent manner.

12.2 Contract Discrepancy Report (CDR). In the event of unsatisfactory Contractor performance, the Contracting Officer will issue a CDR that will explain the circumstances and findings concerning the incomplete or unsatisfactory service.

The Contractor shall acknowledge receipt of the CDR and respond in writing as to how he/she shall correct the unacceptable performance and avoid a recurrence. The Government will review the Contractor's corrective action response to determine acceptability and will use any completed CDR as part of an overall evaluation of Contractor performance when determining present or future contractual actions.

13. APPLICABLE DOCUMENTS

13.1 The Contractor shall perform all services in accordance with the following governing documents:

14. PLACE OF PERFORMANCE

14.1 The primary place of performance shall be the Contractor’s facility.

15. PERIOD OF PERFORMANCE

15.1 Performance shall be for a period of five years, five years, six months, if the option at Federal Acquisition Regulation (FAR) 52.217-8 is exercised.

15.2 IDIQ contract shall be established with five, one year ordering periods and one, six-month option period.

16. COVID-19 CONSIDERATIONS

16.1 Contractor shall comply with all guidance relating to the prevention of COVID-

19. This includes but is not limited to Presidential Executive Orders, CDC, DOD, USSOCOM, DoN, local, and federal installation guidelines. Contractor personnel may be subject to quarantine/isolation periods at certain locations and shall comply with any federal, state, or local, including federal installation (command specific) requirements.

16.1.1 Presidential Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors as implemented by 252.223-7999 Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors (Deviation 2021-O0009) is included in this contract.

16.1.2 Force Health Protection Guidance (Supplement 23), current Revision, Department of Defense Guidance for Coronavirus Disease 2019 Vaccination Attestation, Screening Testing, and Vaccination Verification is applicable to this contract.

16.2 In accordance with 252.223-7999, Contractor shall comply with all guidance published by the Safer Federal Workforce Task Force. The Safer Federal Workforce Task Force guidance also provides that contractors must also comply with agency COVID-19 workplace safety requirements while in Federal workplaces.

16.2.1 In addition to a DD3150, Contractor and/or contractor employees must be prepared to present documentation of proof of vaccination status as defined by the Safer Federal Workforce Task Force as a condition of physical access to DOD buildings and DOD leased spaces in non-DoD buildings in which official DOD business takes place. Access to the installation/space and/or Government badging procedures may require both a DD3150 and documentation of proof of vaccination status prior to granting access or issuance of a badge.

16.3 In accordance with guidance from the Safer Federal Workforce Task Force, the Contractor shall ensure compliance with the requirements related to the validation and the showing or provision of proper vaccination documentation. Summary level statistics, i.e. number and percent of employees vaccinated, number and percent requesting and/or granted a legally mandated exception) shall be readily available upon request only by a warranted contracting officer or the designated COR. Status reports are due to the Government within 7 days of contract modification and weekly thereafter by close of business each Monday until otherwise directed by the contracting officer. The Contractor shall use the template attached (and any subsequent Government-provided) format for reporting purposes. Reports shall be submitted in the file type (i.e., .xls) provided by the Government. Contractors shall not forward any of the underlying documentation to the Government unless that documentation is specifically requested by a warranted contracting officer or the designated COR.

16.3.1 In accordance with the Safer Federal Workforce Task Force guidance, the Contractor is responsible for considering, and dispositioning, any requests for a legally mandated accommodation regardless of the covered contractor employee’s place of performance. The Contractor shall notify the Government of Contractor employee(s) with pending requests for a legally mandated exception to the vaccine mandate.

16.4 In accordance with Force Health Protection Guidance (Supplement 23), current Revision, Department of Defense Guidance for Coronavirus Disease 2019 Vaccination Attestation, Screening Testing, and Vaccination Verification, the Contractor shall ensure compliance with vaccination requirements.

16.4.1 Implementing Attachment 2 (Requirements for DoD Contractor Personnel, Official Onsite Visitors, and Others Seeking Access to Facilities): The Contractor shall require employees to complete the attestation process and submit a signed DD3150 to their employer. The Contractor shall retain these forms and make available upon request by a warranted contracting officer or contracting officer's representative.
