NOTICE TO BIDDERS
NOTICE is hereby given the Board of Commissioners of St. Joseph County, Indiana will publicly open and read aloud bids on Tuesday, August 18, 2026, hour of six o’clock [6:00] p.m. [E.D.T.] in the County Council Chambers, Fourth Floor, County-City Building, South Bend, Indiana, as per Specifications on file, beginning July 31, 2026, on the County web-site available at https://www.sjcindiana.gov/Bids.aspx?CatID=18 for the following Project:
R&S 92601 S: ADAMS ACRES
The project entails concrete removal, aggregate, pipe removal and replacement, subgrade treatment, placing HMA courses, driveway approaches, and tree removal. Estimated Project Length = approx. 0.4 miles.
SAID bids must be accompanied with a Certified Check made payable to St. Joseph County or Bid Bond executed by the bidder and surety company in a sum of not less than ten percent [10%] of the total amount of the bid, together with a non-collusive affidavit as prescribed in Form 96, Revised 2013. Sealed bids must be filed in the office of the County Commissioners no later than 6:00 p.m. [EDT] on Tuesday, August 18, 2026, Room 722, County-City Building, South Bend, Indiana. The bidder awarded the contract will be required to furnish separate Payment, Performance, and Maintenance Bonds before commencing work. The Payment and Performance Bond shall each remain in effect throughout the entire construction period in an amount equal to the awarded Contract Amount.
The required Maintenance Bond shall remain in effect for a period of up to five years from the date of final acceptance in an amount of 10 percent [10%] of the awarded Contract Amount. The bidder’s attention is directed to the Affirmative Action Requirements and the Insurance Provisions of the Project.

SPECIAL PROVISIONS
R&S 92601-S: ADAMS ACRES
I PROJECT DESCRIPTION
The project entails pavement removal, placing HMA base and surface courses, tree removal, culvert replacement, ditch grading, on the following roads:
R&S 92601-S: Helena Drive from Ash Road to Dead End (0.27 MI), Adams Acres Court from Helena Drive to Dead End (0.09 MI), and Lamar Lane from Helena Drive to Dead
End (0.04 MI). Total Project Length is 0.4 MI
The Contractor will not be allowed to perform operations on more than one roadway at a time without prior written approval from the County. The County will send out a Punch-
List within ten working days following completion of the final road segment.
Total package mileage is subject to available funding and may be adjusted due to budget constraints. Partial bids will not be accepted.
II COUNTY SPECIFICATIONS
The COUNTY SPECIFICATIONS of St. Joseph County, Indiana adopted as amended, on March 18th, 1975 and revised August 17th, 1989 are to be used in this project, along with the current applicable Indiana Department of Transportation Standard
Specifications, including Recurring Special Provisions and/or Supplemental
Specifications dated 2026 and the current List of Approved or Pre-Qualified Materials.
III STARTING AND COMPLETION DATE
Upon issuance of the Notice to Proceed, the Contract Completion Date is November 6, 2026. Anticipated Start Date is September 8, 2026.
There will be no work performed on weekends or Federal Holidays without prior approval from St. Joseph County. All roads shall be in passable condition and free of construction activities by noon the Friday before any Federal Holidays that occur on a
Monday.
IV PLANS
The Contract plans consist of 39 plan sheets, applicable Standards to be used in conjunction with the STATE and COUNTY SPECIFICATIONS and these SPECIAL
PROVISIONS.
V PROJECT ENGINEER / SUPERVISOR
A. Prevailing Specification: 105
B. Additions:
1. The Project Engineer / Supervisor (PE/S) is the County's point of contact for the Contractor for this project. Coordinate all communication with the
County through the PE/S.
2. The PE/S has the authority to issue a stop work order in the event the
Contractor fails to meet project requirements or is not in compliance with the Contract. The PE/S will inform the contractor's onsite foreman, work must be stopped, noting the time and contacting the Contractor's assigned contact. Any work performed after the time noted, will be performed at no cost to the County.
3. A Preconstruction Meeting will be scheduled prior to the Notice to
Proceed. The Contractor shall provide the PE/S with the following at the meeting: a complete and accurate schedule, a list of contacts including foreman and subcontractors, emergency contact numbers, HMA mix designs and a copy of the Contractor’s Quality Control Plan for the project, Maintenance of Traffic plan, and proposed hauling routes that will be utilized.
4. Contractor required to provide weekly schedule updates a minimum of five (5) working days in advance of the work being performed. Failure to comply with this special provision will result in a $1,000 penalty for each week the Contractor fails to provide an accurate, updated schedule.
VI LIQUIDATED DAMAGES AND RETAINAGE
A. County Specifications & Prevailing Specifications: 108.08 & 108.09
1. Retainage - The County will retain five percent [5%] of each payment earned and five percent [5%] of all Change Order work.
2. The County will keep Liquidated Damages at a rate of $1,500.00 per day for each calendar day beyond the Calendar Completion Date.
3. In the event Liquidated Damages exceed the retainage withheld by the
County, the Contractor shall then be held in default and no additional monies will be paid to the Contractor except by written release of Surety underwriting the Performance Bond.
4. The Contractor shall have ten (10) working days from the date on the
Punchlist to complete the Punchlist items and remove all construction signage. If the Contractor fails to complete the Punchlist and remove all construction signage within the 10 days, the County will assess liquidated damages until complete.
VII INSURANCE
A. Prevailing Specifications: Attached County Insurance

B. Additions:
1. Bidder’s attention is drawn to the Insurance Provisions as set out in Page
I-1 through I-3 also attached.
2. Final Contract documents will not be processed for the successful bidder until all insurance policies or binders are received by the County. The completion date will not be extended for Contractor delays in submitting necessary paperwork.
3. No work shall commence until the Contractor submits all necessary paperwork including Schedule, Insurance, Contract, Payment, Performance Bond, and a five-year Maintenance Bond.
VIII BIDDING REQUIREMENTS AND CONDITIONS
A. Prevailing Specifications: 102
1. The Bidder will be required to be pre-qualified and follow the bidding requirements as set out in Section 102.01 of the 2026 INDOT
Specifications and as currently revised. Bidder shall submit a copy of
INDOT’s HMA Plant Certification certificate with the bid documents.
2. Upon award, the PE/S shall submit the Contract Documents to the
Contractor. Contract Documents include the Contract, Payment, Performance Bond and a five-year Maintenance Bond, with amounts equal to 100% and 10% of the awarded contract respectively. Refer to attached
Contract and Bond documents for more information.
3. Bidder’s attention is drawn to the attached “Bidder’s Checklist”. The
Bidder is required to return a fully executed “Bidder’s Checklist”, with their bid; the checklist is considered part of the required bid documents.
IX SUBLETTING OF CONTRACT
A. Prevailing Specifications: 108.01
B. Addition:
1. All Sub-Contractors shall be approved in writing prior to the commencement of work.
2. The Contractor shall perform with its own organization Contract work amounting to not less than fifty percent [50 %] of the total original contract price.
X WAGE RATES
A. Prevailing Specifications: None
1. Awarding agencies require that all Contractors and Sub-Contractors awarded Public Works Contracts file a schedule of wages to be paid on the
Project before any work is performed. This usually takes the form of a
Contractor or Sub-Contractor submitting a list of labor classifications and rates of pay to the awarding agency.
2. Successful bidder is required to submit Form 347, Weekly Payroll to the
County within 10 days of the applicable payroll date throughout the duration of the Contract.
XI UTILITIES
A. Prevailing Specifications: 105.06, 107.20
1. Coordination with various utilities regarding their facilities may be necessary and it shall be the Contractor’s responsibility to initiate and maintain this coordination.
2. It is the Contractor’s responsibility to coordinate with trash and recycling collection. Any damage caused by trash handlers will be replaced at no cost to the County.
XII PAYMENT
A. Prevailing Specifications: None
1. The quantities shown in the bid documents are believed to be sufficient to complete the specified work; however, they are approximate and are shown for the purpose of comparing bids. Payment to the Contractor will be made only for those quantities of work completed and accepted in accordance with the specifications. Major work changes made in the field must be submitted for approval on a field order form, prior to the commencement of work, or the PE/S must sign the Contractor’s daily work report on the day the work is performed. Minor Changes in Existing items must be reviewed by the PE/S in the field and documented in the daily report.
2. Payment for the various items of the contract shall be complete and final according to the PE/S. Payment for all materials, tools, equipment, overhead and profit for the item shall be completed on a progress pay estimate processed at a two (2)-week minimum basis. Payment shall be determined from weight tickets or shipping bills furnished by the
Contractor for each shipment of material to the project, and upon field measurements as agreed upon by the Contractor and the PE/S.
XIII PROTECTION AND RESTORATION OF ESTABLISHED VEGETATION
A. Prevailing Specification: 108.04, 201.02, 205, 621
1. If applicable, the Contractor shall prepare and file the Notice of Intent and
Erosion Control Plan as required by 327 IAC 5-5 [Rule 5].
2. The Contractor shall provide silt fences, straw bales, or other necessary items to prevent sediment from being washed off the project site, and any necessary protection at all culvert/pipe/drainage structure work. These environmental protection measures shall be incidental to the Contract work.
3. All Tree related work, including stump grinding, shall be completed for each road segment prior to the roadway operations. All cleanup work shall be completed within five (5) calendar days of all tree related work for each road.
XIV MOBILIZATION AND DEMOBILIZATION
A. Prevailing Specifications: 110
1. Mobilization and Demobilization shall be paid for as a lump sum. 50%
Payment will be made when the Contractor begins a section of roadway and 50% will be paid on the pay estimate after all Punch List Items have been corrected.
XV PREPARATION OF PAVEMENT
A. Prevailing Specifications: 105, 201, 203, 610, 611, 621, 720
1. The Contractor shall be responsible for the preparation of all work surfaces including, but not limited to clearing debris from the pavement edge, dirt, gravel, removing grass/weeds, removing cold patch on any remaining pavement after milling or prior to overlay, and tree limbs where required, etc. followed by sweeping, etc.
2. Included is all required work to close and prepare any gaps between the edge of pavement and existing asphalt or concrete drives as directed by the
PE/S. Voids, holes, or depressions deeper than one inch shall be tacked, filled and compacted with an HMA mixture prior to placing mainline asphalt. Payment for HMA used to fill voids, holes, or depressions will be per ton of the mixture placed. On roads that are being Mill/Filled, the
PE/S shall mark areas that need filled with pink paint behind the mill operation.
3. After preparation work is done and prior to paving, the Contractor and the
PE/S shall meet on-site to determine final widths and to resolve any problems or changes that might arise due to preparation work. Preparation shall be such that a smooth transition is obtained from newly paved areas to existing pavements. The Contractor shall perform any work necessary to provide a straight and constant width as identified in sub points 1 and 2.
4. The Contractor is responsible to ensure that each road, included for paving in this project is paved to maintain the existing drainage patterns unless otherwise directed. This involves placing asphalt material at all the road approaches according to the existing grade and slope of the existing pavement or gutter line. This will ensure the water continues to run-off or through an area as planned.
5. The Contractor shall be required to adjust all manhole castings, water valves, etc. to be level with final pavement grade.
6. The Contractor shall clean up and properly dispose of any excess materials and debris resulting from the work.
7. Preparation of Pavement is incidental to the Contract work, except where specific removal or adjustment items are provided in the bid proposal.
XVI HMA PAVEMENTS
A. Prevailing Specifications: ** APAI Guide for Local Governments, 402, 902, 904
1. This work shall consist of placing HMA mixtures as described herein and in the contract documents. The attached APAI Guide for Specifying
Asphalt Pavements for Local Governments shall be the governing specification for HMA pavements, except as noted herein this Special
Provision.
a. Reference 2026 INDOT Standard Specifications.
b. The maximum % Binder Replacement allowed in the Surface course shall be 25%.
c. Segregation, flushing or bleeding of HMA mixtures will not be allowed. Corrective action shall be taken to prevent continuation of these conditions. Segregated, flushing or bleeding HMA mixtures shall be removed and replaced if directed. All areas showing an excess or deficiency of binder shall be removed and replaced.
2. All HMA pavement mixtures shall use Petroleum Asphalt Cement and required aggregates for Type “B” mixtures as listed below:
a. HMA, Surface, 9.5 mm, PG 58S-28 (Final Liquid)
b. HMA, Base, 25.0mm, PG 58S-28 (Base Liquid)
3. The Contractor shall complete all paving operations, including finish rolling, by 7 pm or one (1) hour prior to sunset, whichever is earlier. Any work performed after this time will not be paid for.
4. All HMA mixtures will be paid for by the ton in place and all references to
904.01 additional payment for the use of Slag Aggregate are deleted.
Only CAPP aggregates shall be permitted in the asphalt courses.
5. Refer to Section XXIII for information specific to each roadway. Overrun of these quantities will neither be permitted, nor paid for unless approved in writing by the PE/S.
6. All HMA courses placed on roads without curb & gutter shall have a safety edge. Refer to Detail on sheet 3.
7. Final surface tolerance test method for pavement will be 16 foot or 10 foot rolling straight edge to the specified tolerance in accordance with Section
401.18.
8. The Contractor shall be required to submit mix designs and job mix formulas for approval, no later than the preconstruction meeting. All mix designs shall include the 0.45 Power Maximum Density Curve gradation graph. The Contractor is also required to submit their liquid supplier’s testing information to the PE/S. The Contractor may be required to provide a liquid sample to the County and test the material for the County upon request.
9. Contractor shall submit to the PE/S at the jobsite Daily certification/asphalt testing information from the first or second load and additional certificates as production thresholds are met. These thresholds are 600 tons for surface and 1000 tons for base courses. The Contractor shall include the following information on each Type D Certificate: truck number, time the sample was taken, and time the test was performed. All testing is to be performed on HMA delivered to this specific project only.
Completed Type D Certificates must then be submitted within 48 hours of placement for material to be considered for payment. If a completed Daily certification is not provided by the Contractor as specified above, all of the asphalt delivered to and placed prior to the receipt of a completed Daily certification, will not be paid for by the County, nor will the Contractor be granted a time extension if the Contractor chooses to stop work due to the lack of proper Certification.
XVII POLYMER MODIFIED PERMORMANCE BINDERS
A. Prevailing Specifications:
1. This special provision shall consist of furnishing a polymer modified performance grade binder for incorporation into the designated bituminous mixtures. The performance grade binder will be provided according to the requirements of the Standard Specifications, except where modified herein.
2. This special provision only applies when polymer modified performance grade (PG) binders are identified by the suffix "P" at the end of the grade, for example PG 58S-28. The designated binder grades are listed in the project's HMA Pavements Special Provision.
3. The Polymer modified asphalt shall be pre-blended by adding a polymer to a base asphalt supplied from one of the INDOT certified suppliers.
Direct in-line blending of polymer at the hot mix plant is allowed if the
Contractor is one of the INDOT approved suppliers. The modified asphalt binder shall be smooth, homogenous, and comply with the requirements shown in Table 1.
4. Only styrene-butadiene-styrene (SBS) shall be used as a polymer modifier.
5. Original samples of asphalt binder will be taken daily prior to incorporation into the mixture. The original samples shall be used for
Asphalt Binder Certification Verification. A referee sample will be taken and clearly marked with the date and the letter "R". Samples shall be tested at random. When a verification sample of a specific PG binder fails to meet the limits shown below, the contract unit price for the bituminous mixture containing the out of specification binder shall be decreased for the days of production represented by the sample. The amount of the decrease shall be determined by the price associated with the amount of liquid asphalt the mixture contained reduced by 25 percent. Price adjustments on asphalt binders are not cumulative. The general procedures for verification dispute resolutions, found in the contract documents, may be initiated by the Contractor.
6. Payment for this work shall be included in the price bid for the applicable bituminous items of work.
7. The Contractor shall supply the County with a letter certifying that the polymer meets the requirements of this special provision:

XVIII MATERIAL TESTING, HMA ASSURANCE
A. Prevailing Specifications: 402, 902, 904
1. The Contractor shall subcontract an Independent Testing Firm to perform, HMA sampling in the field, in accordance with ITM 580, binder content and gradation testing in accordance with ITM 571, and coarse angularity in accordance with 904/02(c). The Contractor will provide the PE/S with the contact information for the Testing Firm. The Contractors shall be responsible for scheduling all tests. Assumed frequency of testing is one test per 1,000 tons of each HMA mix. All written test results shall be sent to PE/S.
2. Gradation test results which are outside the composition limits will be considered and adjudicated as a failed material in accordance with the normal Department practice as listed in 105.03.
3. Asphalt test results which are more than ±0.5% from the JMF will be considered as a failed material and adjudicated in accordance with normal
Department practice as listed in 105.03.
4. All HMA testing shall be paid for under the item “Material Testing, HMA
Assurance”, on a per each test performed basis.
5. Contractor must provide passing test results in writing to the PE/S prior to beginning the next operation on the roadway. Failure to do so will result in the County withholding payment for the material placed and issuing a work stop order until the contractor provides the necessary paperwork.
The completion date will not be extended for any Project delays as a result of a work stop order.
XIX ASPHALT MATERIAL FOR TACK
A. Prevailing Specifications: 406, 408, 902
1. Tack coat emulsion shall consist of grade AE-T Bituminous Material. The existing surface shall be cleaned and swept prior to the application to permit adhesion of the bituminous materials. This material shall be applied immediately preceding the placement of each HMA layer at an application rate of 0.08 gal/yd 2. The tack coat shall be uniformly applied and evenly distributed over the entire roadway surface. Tack coat shall not be applied to a wet surface.
2. Asphalt Material for Tack will not be paid for separately, but the cost of this item shall be included in the cost of the other line items. The
Contractor shall provide the weigh back tickets to the PE/S within 48 hours of placement, failure to supply accurate weigh back tickets will result in partial or total loss of payment for the appropriate asphalt layer.
XX DRAINAGE STRUCTURES & CONCRETE WORK
A. Prevailing Specifications: 604, 605, 621, 715, 720, 725
1. All removal (including headwalls), materials, proper backfill, ditching to promote positive drainage, and landscape restoration required for the installation of culvert pipes shall be included in the unit cost of each line item. The Contractors shall include in the line items cost associated with ditching to create positive drainage, especially on corrugated metal pipes that are being replaced with reinforced concrete pipes.
2. All pipes are to be installed with pipe end sections that fit the specified size and sod at both, inlet and outlet, of each pipe. All costs associated with this are to be included in the cost of the pipe.
XXI LAWN RESTORATION
A. Prevailing Specifications: 621
B. Additions:
1. All disturbed lawn areas will be repaired using topsoil and sod as shown in plans and directed by the PE/S.
2. The Contractor shall locate any sprinkler systems within the construction area and take care not to damage the system. Any damage caused by construction shall be repaired at the Contractor’s expense.
XXII MAINTENANCE OF TRAFFIC
A. Prevailing Specifications: 104.04, 107.12, 107.18, 801, 900
1. Contractor shall notify Emergency Management at (574) 235-9234, and the PE/S at least 48 hours prior to any road closures and/or restrictions. All signage must be posted on site a minimum of 7 calendar days in advance of any construction starting and shall remain in place until authorization to remove has been given by St. Joseph County.
2. All traffic must be maintained. Access to all properties must be maintained at all times. At no time will any section be left in an impassable condition after working hours. Contractor shall keep the roadway passable and shall accommodate and facilitate access to homes for residents, emergency vehicles, mail delivery, garbage pick-up, school busses, etc. First Offense = forfeiture of MOT payment for that road.
Second Offense = forfeiture of 50% of MOT bid total. Third Offense =
100% forfeiture of MOT bid total.
3. The Contractor is responsible to provide the proper signage for construction. Payment for barricades, flaggers, barrels, and construction and detour signs shall be included in the line item, “Maintaining Traffic”.
4. All construction signs, control devices and barricades will be in accordance with the “Indiana Manual on Uniform Traffic Control
Devices”, dated 2011, and as currently revised.
5. Maintaining Traffic shall be paid for as a lump sum.
6. Contractor required to submit individual MOT plans a minimum of five
(5) working days prior to performing the work for approval for roads or intersections.

Materials
Asphalt Performance Grade (PG) binders for asphalt pavement shall be supplied by an INDOT approved supplier listed on INDOT’s Qualified Sources List for Performance-Graded Asphalt Binder Suppliers and shall meet the requirements of Section 902.01 (a). Aggregate materials used in asphalt mixtures shall be supplied by a source listed on INDOT’s Qualified Sources Lists for Certified Aggregate Producer as well as the qualified list for Dolomite Aggregates and Polish Resistant Aggregates when applicable. Aggregates shall meet the requirements of Section 904. The asphalt mixture design mix formula (DMF) shall be prepared by an INDOT Qualified Mix Design Laboratory. An Agency may request a DMF to be submitted for approval prior to paving.
The DMF shall be based on the mixture type, mixture size, and PG binder designation. In the construction season of 2025, Indiana’s base binder grade will change from PG 64-22 to PG 58-28. Along with this change, the asphalt binder designations and testing requirements will be in accordance with Multiple Stress Creep Recovery (MSCR) per AASHTO M332 and elastic response requirements per AASHTO R92.
These changes are encouraged prior to the 2025 construction season if the Contractor can do so. Any references to asphalt PG binders henceforth in this document will refer to the PG 58-28 MSCR binder specifications.

PLEASE NOTE: Many local and Community Crossing projects have ESAL counts below 3,000,000 and will be Type B mixtures. It is imperative to provide the correct mixture designation on the project plans and

The plant discharge temperature for any mixture shall not be more than 315°F whenever PG 58S-28 and PG 58H-28 binders are used. The temperature of each mixture at the time of spreading shall not be less than 245°F. No mixture shall be placed on a previously paved course that has not cooled to less than 175°F. Warm mix asphalt (WMA) mixtures may be produced by using a water-injection foaming device or additives as specified and according to the manufacturers’ recommendations.
INDOT specifications allow a maximum of 25.0% binder replacement from RAP (recycled asphalt pavement) and RAS (recycled asphalt shingles) combined for all asphalt mixtures.
Asphalt wedge and leveling shall consist of surface or intermediate mixtures.
CONSTRUCTION GUIDANCE
Subgrade, Subbase, Milling and Surface Preparation
Prior to asphalt mixture placement, subgrade should be checked for adequate compaction with no visible water or movement. Subgrade should be firm, dry and unyielding under the pressure of construction trucks. A proof roll is recommended to check for soft areas and verify uniform subgrade stability.
Crushed aggregate material for subbase shall be uniformly compacted, smooth and clean prior to mixture placement.
Milled surface shall have uniform milling pattern. Care should be taken to minimize scabbing which can cause future delamination. Milled surface shall be inspected for integrity and areas with visible distress and fatigue cracking should be patched or repaired where necessary. Milled surface shall be swept or vacuumed prior to mixture placement.
Verify that roadway is graded properly to direct water to proper drainage or containment areas and minimize water puddling on surface. Utility structures shall be adjusted to proper grade.
Surfaces on which an asphalt mixture course is placed shall be clean and free from debris and vegetation at the time of mixture placement.
Tack Coat
Tack coat shall be uniformly applied across the entire width of pavement to be overlaid. The asphalt material shall be uniformly applied across the entire width of pavement to be overlaid and shall cover a minimum of 95% of the surface. Areas of inadequate coverage that create streaking or areas of excessive coverage that create ponding shall be corrected to obtain an even distribution. Contact surfaces of curbing, gutters, manholes and other structures shall be tacked. Sufficient time should be given for the tack to break and set to minimize tracking from hauling and laydown equipment.
Asphalt Mixture Placement
Segregation of aggregate in the mat should be minimized. Transverse and longitudinal joints shall be properly constructed.

The finished mat should be smooth with no deviations greater than ¼ inch over 10 feet. A continuous slope/grade between paver passes should be maintained. Roadway should be crowned appropriately to ensure proper drainage.
Truck bodies should arrive at the site tarped and clean of debris. Qualified material from INDOT’s list of Anti-Adhesive Materials (no diesel fuel) shall be used to clean equipment and hand tools.
Compaction
Proper compaction is the most critical part of asphalt installation as it impacts service life directly by increasing resistance to rutting and cracking. The mat shall be compacted with rollers immediately after the mixture has been spread and finished. A rolling pattern should be established by Contractor to achieve density targets. Number of rollers, sizes and types may vary depending on mixture type and depth, speed of production and weather. Mixture temperatures of mat should be monitored to ensure proper compaction. Extra compaction effort in handwork areas inaccessible to rollers may be needed.
Rollers shall not cause undue displacement, cracking, or shoving. The rolling pattern should be adjusted if detrimental results are observed.
To avoid scuffing, the mat should cool to a minimum of 160o F prior to allowing traffic on the freshly paved surface. Additional cooling time may be needed on hot summer days.
Weather Limitations
Asphalt mixture courses less than 1” are to be placed when the ambient and surface temperatures are 60o F or above. Asphalt mixture courses equal to or greater than 1” but less than 2” are to be placed when the ambient and surface temperatures are 45o F or above. Asphalt mixture courses equal to or greater than 2” are to be placed when the ambient and surface temperatures are 32o F or above. Mixture shall not be placed on a frozen subgrade. However, asphalt mixture courses may be placed at lower temperatures provided the density of the asphalt mixture course is monitored by the Contractor and approved by the Agency and Inspector.
Asphalt Mixture Acceptance
Verify correct, specified asphalt mixtures are delivered to project site. Asphalt mixture courses shall be installed at the specified compacted lift thickness. It is recommended to request an INDOT Type D certification to verify mixture types. For unit price contracts, truck delivery tickets should be collected to document tonnage placed.
A Type D certification shall be supplied by Contractor and shall list test results for air voids and binder content for material supplied to the project. A Type D certification shall be submitted to the Inspector each day asphalt material is received.

OWNER AND CONTRACTOR PROTECTIVE LIABILITY INSURANCE
The Contractor shall, prior to commencing work and thereafter keep in force until terminated by the Board of Commissioners through the execution and Board approval of the Project
Completion Affidavit, furnish the County with a policy providing Owners’ and Contractors’
Protective Liability Insurance Coverage for Operations of Contractor. The County may accept an insurance binder, temporarily, pending receipt of the Certificate of Insurance policy.
The Insurer shall be a company holding a Certificate of Authority by the Indiana State Insurance
Commissioner to do business in the state. The named insured shall be St. Joseph County, Indiana, its members and employees, and the limits of coverage shall be in the amounts set out herein:
1. A limit of not less than $2,000,000.00 for all damages arising out of bodily injury or death in any occurrence.
2. A limit of not less than $1,000,000.00 for all damages arising out of injury to or destruction of property in any occurrence, and subject to the limit of occurrence, and aggregate of not less than $6,000,00.00 for all damages arising out of injury to or destruction of property during the policy period.
In addition to the limits specified herein, the policy shall also include the following endorsements to the Owners’ and Contractors’ Protective Liability Insurance:

4. Whenever used in this policy, the term “general supervision” shall include on-site inspection, field engineering, field testing, and activities incidental thereto.
Proof of renewal shall be furnished fifteen (15) days prior to the expiration of the policy, and if subject to cancellation, the policy shall provide for written notice from the insurance company to the St. Joseph County Board of Commissioners at thirty (30) days prior to the effective date of the cancellation. In the event of cancellation or expiration, all work on the contract shall be suspended except that necessary for traffic maintenance and the protection of life and property.
The County shall not permit the Contractor to resume work until the above coverage requirements are renewed and in full effect. No extension in the Contract completion time or additional payment will be allowed on account of this requirement and contract time charges will continue.
With respect to all operations he performs and for the duration of the Contract, the Contractor and Subcontractor shall carry Contractors’ Comprehensive General Liability Insurance providing

Revision 6/01 for a limit of not less than $2,000,000.00 for all damages arising out of bodily injury or death in any one occurrence. The policy shall also provide for a limit of not less than $1,000,000.00 for all damages arising out of injury to or destruction of property in any once occurrence and, subject to that limit per occurrence, and aggregate limit of not less than $1,000,000.00 for all damages arising out of injury to or destruction of property during the policy period. Such insurance shall include coverage for Premises-Operation, Contractor’s Protective Liability, Products-Completed Operations, and Blanket Contractual Liability.
COMPREHENSIVE AUTOMOBILE LIABILITY
The Contractor and Subcontractor shall carry for the duration of the Contract, Comprehensive
Business Automobile Liability Insurance providing for a limit of not less than $1,000,000.00 for all damages arising out of bodily injury or death for each person and a limit of not less than
$1,000,000.00 for all damages arising out of bodily injury or death in any one occurrence. The policy shall also provide for a limit of not less than $1,000,000.00 for all damages arising out of injury to or destruction of property in any one occurrence. Such insurance shall include coverage for all owned, non-owned, and hired vehicles.
WORKMAN’S COMPENSATION INSURANCE
The Contractor and Subcontractor shall also provide proof of a current Workman’s
Compensation Insurance policy prior to Contract awards.
HOLD HARMLESS PROVISIONS
The Contractor shall indemnify, defend, exculpate, and hold harmless St. Joseph County, Indiana, its officials and employees for any liability due to loss, damages, injuries, or other casualties of what so ever kind, or by whom so ever caused, to the person or property of anyone on or off the right-of-way arising out of or resulting from the performance of the Contract or from the installation, existence, use, maintenance, condition, repairs, alterations, or removal of any equipment or material, whether due in whole or in part to the negligent acts or omissions of the County, its officials, agents, or employees; on the Contractor, his agents or employees, or other persons engaged in the performance of the Contract or rising out of this Contract; or the joint negligence of any of them, including any claim arising out of the Workman’s
Compensation Act or any other law, ordinance, order, or decree.
The Contractor also agrees to pay all reasonable expenses and attorneys’ fees incurred by o imposed on the County in connection herewith in the event that the Contractor shall default under the provisions of this paragraph. As much of the money due the Contractor under and by virtue of his Contract as the County may consider necessary for such purpose may retained for

In case no money is due, the Contractors’ Surety may be held until such suit or suits, action or actions, claim or claims for injuries or damages as aforesaid shall have been settled and suitable evidence to the effect furnished to the County. Money due will not be withheld when the Contractor produces satisfactory evidence that he is protected adequately by public liability and not extend to the indemnification or exculpation against claims arising out of the preparation or approval of Plans, Specification, or Special Provisions unless furnished by the
Contractor.
It is specifically agreed between the parties executing the Contract that it is not intended by any of the provisions of any part of the Contract to create the public or any member thereof a third party beneficiary hereunder, or to authorize anyone not a party to the Contract to maintain a suit for personal injuries or property damage pursuant to the terms or provisions or the Contract.
