CITY OF PEACHTREE CITY
REQUEST FOR PROPOSALS
TO DEVELOP AN AMERICANS WITH DISABILITIES ACT (ADA) TRANSITION PLAN
INTRODUCTION
The City is seeking proposals from qualified consulting firms to provide services to develop an Americans with Disabilities Act (ADA) Transition Plan.
The plan will be geared to only City facilities (buildings) and Recreational Areas and equipment. City Staff is handling the street/sidewalk and path portions.
BACKGROUND
The City is a suburban area located in Fayette County, Georgia. It is part of Metro Atlanta; and lies approximately 31 miles south of the city limits. Peachtree City is a planned community consisting of 5 distinct villages and has 100 miles of multi-use paths which citizens use for both leisure and commuting.
The population currently sits at 38,000 residents and continues to increase as young families move into the area. Peachtree City is considered a “bedroom community” with many citizens commuting to Atlanta for work, however there are also several large international employers within the city itself. Opportunities for employment in Fayette County continue to increase as the film industry grows and large companies expand their presence in the city.
DEMOGRAPHIC DATA
The City has a large aging population, however, there is an increase of young families moving to the area.
The median age in the city is 44, with 18% of the population being over 65 years old. According to the most recent census, the population consists of 77% white, 6.9% black or African American, 7.7% Asian, 0.5% Native Hawaiian or Pacific Islander, and 8% Hispanic or Latino. 15.2% of the population speak a language other than English at home. The median household income is $103,000 per year, and there are 14,344 households with an average of 2.63 persons per household. The average home price is approximately $380,000. 59% of the population hold a bachelor’s degree or higher, and 98% of the population hold a high school diploma. 6.9% of the population under 65 has a disability.
PARK & RECREATION CONTEXT
The City Recreation Department has 4 athletic complexes, 3 community parks, 6 nature areas, and 25 neighborhood and other city parks. Parks and athletic fields combine to make up over 400 acres of the city.
70% of the population live within a 10-minute walk of a park.
See Appendix A for list of facilities with specific details regarding each facility.
Note: This City will also provide this information in GIS format for download.
CITY FACILITY CONTEXT
The City Building Maintenance Department has over 80 facilities that it is responsible for. These facilities range from small open pavilions, to medium sized restroom facilities, to a 31,000 square foot library. All of which vary in complexity. Not every facility is open to the public so some may not need to be assessed.
Please note some of these facilities may be duplicated on the Recreation Department list.
See Appendix B for list of facilities with specific details regarding each facility
Note: This City will also provide this information in GIS format for download.

GEORGIA SECURITY & IMMIGRATION COMPLIANCE ACT OF 2006
Federal Work Authorization Program (§ O.C.G.A. 13-10-91)
The City may not enter into a contract for the physical performance of services unless the contractor registers and participates in the federal work authorization program. “Physical performance of services” is defined as the building, altering, repairing, improving, or demolishing of any public structure or building or other public improvements of any kind to public property within Georgia, including the construction, reconstruction, or maintenance of all or part of a public road; or any other performance of labor for a public employer within Georgia under a contract or other bidding process”.
Although the Georgia law for private employers has a structured phase-in timeline in an attempt to ease private employers into compliance based upon their business size, only those companies registered with, authorized to use and currently using the federal work authorization program commonly known as E- Verify, or any subsequent replacement program, in accordance with the applicable provisions and deadlines established in § O.C.G.A. 13-10-91, shall be considered.
Before a bid for the physical performance of services is considered by the City, the bid must include a signed, notarized affidavit from the contractor attesting to the following:
(1) The affiant has registered with, is authorized to use, and uses the federal work authorization program.
(2) The user identification number and date of authorization for the affiant;
(3) The affiant will continue to use the federal work authorization program throughout the contract period; and
(4) The affiant will contract for the physical performance of services in satisfaction of such contract only with subcontractors who present an affidavit to the contractor with the same information as required in numbers 1-3 above.
If a contractor does not have any employees and does not intend to hire any employees, in lieu of the above affidavit the contractor may provide a copy of state-issued driver’s license or identification cared to the City for each independent contractor utilized in satisfaction of part or all of the contact with the City.
However, a driver’s license or identification card will be acceptable if it is issued by a state that verifies lawful immigration status. The Georgia Attorney General will provide a list of states that verify lawful immigration status and post this list on its website. The City must confirm that all of the copies of driver’s licenses and identification cards presented to it come from states that verify lawful immigration status.
State law requires that before a bid/proposal for the physical performance of services is considered by the City, the bid/proposal must include a signed, notarized affidavit from the contractor. Subcontractor affidavit(s) would be required only upon award. See Appendix D for Affidavits

ADA
The goal of the survey process is to plan how to make an existing facility more usable for people with disabilities. The Department of Justice (DOJ) recommends the development of an Implementa-tion Plan, specifying what improvements you will make to remove barriers and when each solution will be carried out: “…Such a plan…could serve as evidence of a good faith effort to comply….”
Technical Requirements
This checklist details some of the requirements found in the ADA Standards for Accessible Design (Standards). The ADA Accessibility Guidelines (ADAAG), when adopted by DOJ, became the Standards. The Standards are part of the Department of Justice Title III Regulations, 28 CFR Part 36 (Nondiscrimination on the basis of disability… Final Rule). Section 36.304 of this regu-lation, which covers barrier removal, should be reviewed before this survey is conducted.
However, keep in mind that full compliance with the Standards is required only for new construc-tion and alterations. The requirements are pre-sented here as a guide to help you determine what may be readily achievable barrier removal for ex-isting facilities. The Standards should be followed for all barrier removal unless doing so is not readily achievable. If complying with the Standards is not readily achievable, you may undertake a modification that does not fully com-ply, as long as it poses no health or safety risk.
In addition to the technical specifications, each item has a scoping provision, which can be found under Section 4.1 in the Standards. This section clarifies when access is required and what the exceptions may be.
Each state has its own regulations regarding accessibility. To ensure compliance with all codes, know your state and local codes and use the more stringent technical requirement for every modifi-cation you make; that is, the requirement that provides greater access for individuals with disabilities. The barrier removal requirement for existing facilities is new under the ADA and supersedes less stringent local or state codes.

Introduction Title III of the Americans with Disabilities Act requires public accommodations to provide goods and services to people with disabilities on an equal basis with the rest of the general public. The goal is to afford every individual the opportunity to benefit from our country’s businesses and services, and to afford our businesses and services the opportunity to benefit from the patronage of all Americans.
The regulations require that architectural and communication barriers that are structural must be removed in public areas of existing facilities when their removal is readily achievable—in other words, easily accomplished and able to be carried out without much difficulty or expense.
Public accommodations that must meet the barrier removal requirement include a broad range of establishments (both for-profit and nonprofit)—such as hotels, restaurants, theaters, museums, retail stores, private schools, banks, doctors’ offices, and other places that serve the public. People who own, lease, lease out, or operate places of public accommodation in existing buildings are responsible for complying with the barrier removal requirement.
The removal of barriers can often be achieved by making simple changes to the physical environment.
However, the regulations do not define exactly how much effort and expense are required for a facility to meet its obligation. This judgment must be made on a case-by-case basis, taking into consideration such factors as the size, type, and overall financial resources of the facility, and the nature and cost of the access improvements needed. These factors are described in more detail in the ADA regulations issued by the Department of Justice.
The process of determining what changes are readily achievable is not a one-time effort; access should be re-evaluated annually. Barrier removal that might be difficult to carry out now may be readily achievable later. Tax incentives are avail-able to help absorb costs over several years.
Purpose of This Checklist
This checklist will help you identify accessibility problems and solutions in existing facilities in order to meet your obligations under the ADA.
What This Checklist is Not
This checklist does not cover all of the requirements of the Standards; therefore, it is not for facilities undergoing new construction or alterations. In ad-dition, it does not attempt to illustrate all possible barriers or propose all possible barrier removal solutions. The Standards should be consulted for guidance in situations not covered here.
The Title III regulation covers more than barrier re-moval, but this checklist does not cover Title III’s requirements for nondiscriminatory policies and practices and for the provision of auxiliary commu-nication aids and services. The communication fea-tures covered are those that are structural in nature.
Priorities
This checklist is based on the four priorities recom-mended by the Title III regulations for planning readily achievable barrier removal projects:
Priority 1: Accessible approach and entrance Priority 2: Access to goods and services Priority 3: Access to rest rooms Priority 4: Any other measures necessary
Note that the references to ADAAG throughout the checklist refer to the Standards for Accessible Design.
How to Use This Checklist
✓ Get Organized: Establish a time frame for com-pleting the survey. Determine how many copies of the checklist you will need to survey the whole facility. Decide who will conduct the survey. It is strongly recommended that you invite two or three additional people, including people with various disabilities and accessibility expertise, to assist in identifying barriers, developing solutions for removing these barriers, and setting priorities for implementing improvements.
✓ Obtain Floor Plans: It is very helpful to have the building floor plans with you while you survey.
If plans are not available, use graph paper to sketch the layout of all interior and exterior spaces used by your organization. Make notes on the sketch or plan while you are surveying.
✓ Conduct the Survey: Bring copies of this check-list, a clipboard, a pencil or pen, and a flexible steel

With three people surveying, one person numbers key items on the floor plan to match with the field notes, taken by a second per-son, while the third takes measurements. Be sure to record all dimensions! As a reminder, questions that require a dimension to be measured and recorded are marked with the ruler symbol.
Think about each space from the perspective of people with physical, hearing, visual, and cognitive disabilities, noting areas that need improvement.
✓ Summarize Barriers and Solutions: List barriers found and ideas for their removal. Consider the solutions listed beside each question, and add your own ideas. Consult with building contractors and equipment suppliers to estimate the costs for mak-ing the proposed modifications.
✓ Make Decisions and Set Priorities: Review the summary with decision makers and advisors.
Decide which solutions will best eliminate barriers at a reasonable cost. Prioritize the items you decide upon and make a timeline for carrying them out.
Where the removal of barriers is not readily achiev-able, you must consider whether there are alterna-tive methods for providing access that are readily achievable.
✓ Maintain Documentation: Keep your survey, notes, summary, record of work completed, and plans for alternative methods on file.
✓ Make Changes: Implement changes as planned.
Always refer directly to the Standards and your state and local codes for complete technical require-ments before making any access improvement. Ref-erences to the applicable sections of the Standards are listed at the beginning of each group of ques-tions. If you need help understanding the federal, state, or local requirements, contact your Disability and Business Technical Assistance Center.
✓ Follow Up: Review your Implementation Plan each year to re-evaluate whether more improvements have become readily achievable.
