About this file

This is a sole-source determination and justification document from the Oregon Military Department's Camp Rilea Installations Division, seeking approval to procure shoothouse safety upgrade materials and installation services from Action Target, Inc. The procurement involves upgrading an existing live-fire training facility constructed in 2007-2008 that uses Action Target's proprietary MATCH system, which requires updating due to changes in training ammunition types. The scope of work includes procurement and installation of approximately 1,000 rubber wall panels, drywall screws, breach door assemblies, and labor consisting of 3 technicians for 4 days, along with related shipping costs.

The total estimated contract value is $102,875.66, based on Action Target Inc. Quote #152838 dated August 1, 2025. The sole-source justification is based on compatibility requirements, as Action Target is the original equipment manufacturer and holds all copyrights and patents for the MATCH system components, making them the exclusive authorized provider of authentic replacement parts and factory-certified labor. The vendor has stated that any repairs, service, maintenance, or replacement parts not provided by Action Target cannot be supported and will void remaining warranties, with no other manufacturers authorized to supply compatible components. The procurement was approved by Adam Giblin, Designated Procurement Officer for the Oregon Military Department, on August 5, 2025.

Re: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275

Part A

1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)

2. Estimated Total Value of Contract: $102,875.66

Action Target Inc. Quote # 152838 dated 8/1/2025 is referenced.

3. Subject of Contract: Shoothouse Safety Upgrade at Camp Rilea - Compatible Materials and Installation by Action Target, Inc.

4. Background: This sole source justification applies to the purchase of:

The Oregon Military Department (OMD) is requesting approval for a sole source procurement to upgrade the existing shoothouse at Camp Rilea. This live-fire training facility was constructed in 2007–2008 using proprietary components manufactured by Action Target, Inc., specifically the MATCH system. Due to a change in the type of ammunition used in training, the facility must be upgraded to meet current safety standards and ensure ongoing Soldier readiness.

The scope of work includes the procurement and installation of approximately 1,000 rubber wall panels, drywall screws, breach door assemblies, and labor (3 Technicians for 4 Days), along with related shipping.

Action Target, Inc. is the original equipment manufacturer (OEM) and installer of the MATCH shoothouse system. They retain all copyrights and/or patents on the range system components and are the sole authorized provider of authentic replacement parts and factory-certified labor. According to the vendor's provided sole source letter:

“Any repairs, service, maintenance, or replacement parts not provided by Action Target cannot be supported by Action Target and will void any remaining warranty. No one else manufactures, supplies, or distributes parts for your Action Target system.”

To ensure compatibility with existing infrastructure, maintain safety standards, and protect the integrity of the range system, the use of non-OEM vendors or components is not feasible.

5. Findings:

A. Market Research Overall Finding.

Due to the proprietary nature of the Action Target MATCH shoothouse system and the intellectual property protections in place, no other vendors or service providers are authorized to manufacture, supply, or install compatible components. Market research confirmed that no alternate manufacturers meet the necessary technical, safety, or warranty requirements.

And

B. Findings of Fact pursuant to OAR 125-247-0275(2) must include, at a minimum, one of the following:

1. Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.

Action Target, Inc. is the original equipment manufacturer and the only source for compatible replacement parts and factory-authorized installation services for the MATCH system at Camp Rilea.

The proposed upgrade involves replacing wall panels, breach door assemblies, and other range components that must integrate with the existing infrastructure. These upgrades must maintain full compatibility to ensure safe operation, avoid system damage, and preserve any remaining warranty. No other vendor is capable of providing goods or services that meet these specifications.

2. Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data. Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.

Not Applicable

3. Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project. Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.

Not Applicable

4. Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of: unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.

Action Target is the sole provider of the materials and installation services required for this system. Its unique design, exclusive availability, and warranty limitations further support the conclusion that these supplies and services are available from only one source. Procuring from any other vendor would risk incompatibility, invalidate warranties, and create safety concerns.
