About this file
This is a Notice of Sole Source Intent from the Department of Labor (DOL), Office of Assistant Secretary of Administration and Management (OASAM) for ProSystem FX Engagement licenses and support services. The sole source justification is based on CCH Incorporated being the only provider of this specific data analytics package, which is required by DOL's Office of the Chief Accountant (OCA) and Employee Benefits Security Administration (EBSA) for reviewing ERISA-covered plan audits.
The contract will be firm-fixed-price with performance beginning around January 1, 2025. The NAICS code is 513210 (Software Publishers) with a $47M size standard. Interested parties must submit capabilities statements by December 23, 2024 at 8:00 AM EDT, demonstrating clear evidence that competition would benefit the government without causing delays or prohibitive costs. The software is critical for reviewing CPA firms' audit workpapers submitted as "binder packages," as ProSystem and CaseWare are the primary applications used by firms performing ERISA plan audits.

NOTICE OF SOLE SOURCE INTENT
Reference No. ACQ-25-0036
The Department of Labor (DOL), Office of Assistant Secretary of Administration and Management (OASAM), intends to solicit and award a sole source contract in accordance with the authority of FAR 6.302-1(c)(1), full and open competition need not be provided when the supplies or services required by the agency are available from only one responsible source, and no other type of supplies or services will satisfy agency requirements.
The data analytics package is specific to the sole provider of this product:
CCH Incorporated 2700 Lake Cook Road Riverwoods, IL 60015-3867
The North American Industry Classification System (NAICS) code is 513210 – Software Publishers with a size standard of $47,000,000.
DOL The Office of the Chief Accountant (OCA), Employee Benefits Security Administration (EBSA) is responsible for the enforcement of Employee Retirement Income Security Act of 1974 (ERISA). This is a law which regulates the authenticity of employee benefits packages. The ProSystem FX Engagement license is one of two unique software licenses required to perform mission critical work. The ProSystem and Caseware applications are integral to the work of the Division of Accounting Services (DAS), OCA.
OCA assesses the quality of independent audits performed for ERISA-covered plans. Most CPA firms who perform these audits use the software applications ProSystem and CaseWare to prepare their workpapers. When OCA requests firms provide us with their audit work, firms that use these applications send us what’s referred to as a “binder package” which contains all relevant audit work. OCA uses the software applications to open and review the binder packages to perform enforcement work in their original format, which provides for the most efficient and effective review possible.
The Requirement Specifications is attached. This action will result in a firm fixed price contract. The period of performance will commence on or about 01 January 2025.
Responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not delay services.
The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement.
The Government will not be responsible for any costs incurred by responding to this notice.
Interested parties may express their interest and provide a capabilities statement NLT Monday December 23th, 2024 at 8:00 a.m. EDT.
