About this file

This is an Absence of Competition Memorandum documenting a contracting officer's justification for restricting competition on a simplified acquisition procedure purchase (Purchase Request #F6A6CE6155A003). The memorandum supports a single-source procurement decision for a front-mount ten-foot commercial-grade lawn mower, with the Toro brand specifically selected. The Roads and Grounds department requires this equipment to perform mowing operations around base trees and infrastructure while protecting equipment and structures from damage.

The contracting officer determined that only one responsible source was reasonably available based on the agency's established requirement and compatibility with existing equipment. The primary justification centers on operational efficiency and cost savings through shared parts compatibility with the Roads and Grounds shop's existing fleet of Toro mowers, thereby reducing maintenance expenses. The memorandum notes that while the brand is specified, multiple small businesses are capable of providing Toro brand mowers, thereby preserving some level of competition. The determination satisfies FAR 12.102(a) requirements for simplified acquisition procedures, and the contracting officer notes that a formal written justification under FAR 6.303 is not required for this acquisition category.

A.03.11.01 Absence of competition memorandum Ver.1 26 May 2017

ABSENCE OF COMPETITION MEMORANDUM

(SIMPLIFIED ACQUISITION PROCEDURES)

PURCHASE REQUEST#: F6A6CE6155A003

1. FAR RFO 12.102(a) states that contracting officers need to document the decision to restrict competition, including the use of brand-name descriptions without allowing for “equal” products for acquisitions valued at or below the simplified acquisition threshold (SAT), document the decision that only one source is available and the basis for the decision.

2. I determine only one source to be reasonably available based one of the following circumstances:

Only one responsible source and no other supplies or services will satisfy Agency requirements.

Unusual and compelling urgency

Industrial mobilization

International agreement

Authorized or required by statute

National security

Public interest

3. Requestor Justification: Roads and Grounds is in need of a front mount ten foot commercial grade lawn mower. This is a mandatory requirement in order to successfully mow around the base trees and infrastructure while preserving both equipment and various structures.

Currently, the Roads and Grounds shop maintains a small fleet of Toro brand mowers.

Purchasing the same brand allows for lower maintenance costs due to sharing of parts between mowers. Additionally, multiple small business are able to provide Toro Brand Mowers, which still allows for competition.

4. Note that this determination satisfies the requirements of FAR 12.102(a). The requirement to prepare a written justification IAW FAR 6.303 does not apply to purchases using simplified acquisition procedures.
