H. Questions and Answers:
Question 1 :
Solicitation section H.10 states that work items may be invoiced once they reach 25% completion and not more frequently than every 2 weeks thereafter. Solicitation section M.3 states that a progress payment clause will not be include in the solicitation or contract. Please clarify which section will apply to this procurement.
Answer 1 :
The clause at H10 (method of payment and invoicing instructions for ship repair ) is intended, in part, to provide guidance relative to payment for partial deliveries as prescribed in clause I.45 (FAR 52.232-1 Payments) which states in part:
The Government shall pay the Contractor, upon the submission of proper invoices or vouchers, the prices stipulated in this contract for supplies delivered and accepted or services rendered and accepted, less any deductions provided in this contract. Unless otherwise specified in this contract, payment shall be made on partial deliveries accepted by the
Government if—
(a) The amount due on the deliveries warrants it; or
(b) The Contractor requests it and the amount due on the deliveries is at least $1,000 or 50 percent of the total contract price. …
The provision at M.3 (FAR 52.232-15 Progress Payments Not Included) is intended to caution the bidders not to condition bids upon inclusion of a progress payment clause such as FAR 52.232-16 (Progress Payments) which is not included in the solicitation..
Payments made in accordance with FAR 52.232-16 (Progress Payments) are a form of contractor financing.
Payments for partial deliveries made in accordance with FAR 52.232-1(Payments) are not a form of contractor financing and are not considered to be progress payments with respect to provision M.3.
Question 2 :
Does the cost clause refer to vessel transit from Seattle to the bidders location?
Answer 2 : The cost clause is $15,000 per day from Kodiak to the bidder’s location.
Question 3 :
The bidder commented that the Period of Performance of 10-Oct to 10-Dec may not be realistic.
Answer 3 :
The period of performance for repairs to the NOAA Ship Fairweather is expected to commence on the date the Notice to Proceed (NTP) is issued to the Contractor, which is expected to be on or about Oct 10, 2012. Performance shall be completed by 10 Dec, 2012.
Question 4 :
Paragraph 4.10.4: Is there an asbestos, lead and PCB survey for the vessel? Is NOAA aware of any asbestos containing materials on the vessel other than what is specifically identified in the work item specifications (items 113 and 302 for example)?
http://www.eagle.org/eagleExternalPortalWEB/appmanager/absEagle/absEagleDesktop?_nfpb=true&_pageLabel=abs_eagle_portal_rules_guides_download_page&archived=archived&nodePath=%2FBEA+Repository%2FRules%26Guides%2FArchives%2F5_SteelVesselsUnder90M_Length http://www.eagle.org/eagleExternalPortalWEB/appmanager/absEagle/absEagleDesktop?_nfpb=true&_pageLabel=abs_eagle_portal_rules_guides_download_page&archived=archived&nodePath=%2FBEA+Repository%2FRules%26Guides%2FArchives%2F5_SteelVesselsUnder90M_Length http://www.eagle.org/eagleExternalPortalWEB/appmanager/absEagle/absEagleDesktop?_nfpb=true&_pageLabel=abs_eagle_portal_rules_guides_download_page&archived=archived&nodePath=%2FBEA+Repository%2FRules%26Guides%2FArchives%2F5_SteelVesselsUnder90M_Length

Are Not Called Out, Can It Be Assumed That The Crew Will Be Completing The Inspections Requirements To Be
Witnessed By The ABS Surveyor?
Answer 7 :
Yes
Question 8 : In regard to the wording in paragraph 4.1.8. It states "Open and clean watersides and firesides" etc., per the referenced manual Does this 'clean watersides' refer to acid washing for the removal of any internal water-scale, or is NOAA just concerned with removing soot from the coils free-gas spaces?
Unless the ship has had some type of feed water treatment problems, the chance of scale build-up are somewhat slim.
The best indication of scale in the water-sides would be a higher than normal feed water inlet pressure.
Please clarify the cleaning requirements for the boilers.
