AB133F18RP0006 AMENDMENT 0003

The following is a list of questions that the Government has received in response to the RFP. Similar questions have been combined and answered in one response.

1. Pages 3-7. The pricing schedule indicates that quantities are estimated and are for evaluation purposes only and that the exact amounts will be determined at each individual task order. The number of sea days (10,100/year) is a significant determining factor in calculating a sea day price. Even a slight reduction in projected sea day volume can eliminate or severely decrease any profit a contractor might expect. A significant reduction could result in unprofitability. Is there a mechanism to adjust price should the number of days fall below what has been estimated in the RFP?

There is not a mechanism in which the price can be adjusted if the number of days falls below what has been estimated in the

RFP.

2. We understand that the number of sea days has been decreasing on an annual basis. What has been the actual number of sea days for the past five years and the proportion that are deep set days vs. shallow set days?

The number of sea days depends on the specific funding from year to year. As to the proportion of deep set vs. shallow set, again, this depends on the funding and the studies that are being performed. Other than this information, the

Government cannot provide any certain days/proportions.

3. The current CBA that is currently in place is the wage determination for the contract, but is set to expire on

January 31st 2018. It is a possibility that a new CBA will not be available prior to the deadline for submission of proposals for this RFP. As price proposals submitted for this RFP will be based on a wage determination that will likely change how this will be addressed post award when a new

CBA is in place?

In accordance with FAR 22.1008-2 (d)(2):

PAGE 3 OF 4 AB133F18RP0006A0003

If the contracting officer has timely received the collective bargaining agreement, the contracting officer may use the WDOL website to prepare a wage determination referencing the agreement and incorporate that wage determination, attached to a complete copy of the collective bargaining agreement, into the successor contract action. In using the WDOL process, it is not necessary to submit a copy of the collective bargaining agreement to the Department of Labor unless requested to do so.

Also see FAR 22.1002-3 (a):

Successor contractors performing on contracts in excess of

$2,500 for substantially the same services performed in the same locality must pay wages and fringe benefits (including accrued wages and benefits and prospective increases) at least equal to those contained in any bona fide collective bargaining agreement entered into under the predecessor contract. This requirement is self-executing and is not contingent upon incorporating a wage determination or the wage and fringe benefit terms of the predecessor contractor’s collective bargaining agreement in the successor contract.

4. Page 45, Section D I. B. States that “Work hours can be a minimum of eight (8) hours and can extend more than sixteen

(16) hours per day, most typically averaging eleven and a half

(11.5) hours per day.” It is our understanding that the current average hours worked may be higher than 11.5. Recent trends have vessels fishing closer to port than in the past, which makes for shorter trips and fewer steaming (non-fishing) days. As a result a higher proportion of sea days are actual fishing days as opposed to steaming days than in the past, meaning the observer tends to work more hours per day on average monitoring fishing activity. Is it possible that the

11.5 hours per day is an underestimate and that actual hours worked might exceed the average stated in the RFP?

The hours listed are an estimate and may vary. However, the range of a minimum of 8 and a maximum of 16 should be taken into consideration.

5. Page 48, Section D, III. C. Paragraph 4. “The government will reimburse the contractor for the gear storage facilities in Honolulu and American Samoa and associated utilities costs on an actual basis.” Is there a limit or acceptable range on the amount the government will reimburse the contractor for the gear storage facilities and associated utilities in

Honolulu and American Samoa? Is there a requirement to provide a price in the offer?

There is no requirement to provide a price, as this section is not fillable in the price schedule. There is no range on the price of the facilities, but all specifications on size of the facilities must be met. The Government will ensure the rates being proposed are fair and reasonable to the current market rates.

6. Page 51 Section D I. G. Paragraph 6. What documents are required to provide proof of observer employment by the contractor? Proof of employment is also reference on Page

62. Note: This requirement was removed in the last RFP (2013).

While evidence of proof of employment can vary, an employment verification letter is acceptable.

7. Could you share what the current ratio of observer experience

(wage levels) is, i.e. how many are at level 1 0-180 days of experience, how many are at level 2, level 3, etc?

The Government cannot provide this information.

File details come from the government source that posted it.
