COMBINED SYNOPSIS/SOLICITATION IAW FAR 12.603
SOLICITATION NUMBER: 12010920Q0066
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested based on the requirements outlined in this combined synopsis/solicitation.
A written solicitation will not be issued.
This solicitation is issued as a Request for Quotation (RFQ), for a mixed firm fixed price and time and materials labor hour contract. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-06. All responsible sources may submit a quote in response to this solicitation, which shall be considered. A contract may be awarded resulting from this solicitation to the responsible quoter whose quote conforms to the solicitation and is most advantageous to the Government.
The United States Forest Service (USFS) intends to award one contract for the acquisition of items listed below.
The Government intends to select one contractor; however, the Government reserves the right to award no contract at all, depending on the quality of the quotes and prices submitted.

Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP)
(a) Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract. The IPP website address is: https://www.ipp.gov
The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment.
Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email IPPCustomerSupport@fms.treas.gov or phone (866) 973-3131.
Invoicing for Mobilization Mobilization includes movement of all personnel, equipment, and materials to the project site (under location of work as stated within the Statement of Work/Specifications below) that are necessary to complete the work.
Invoices for mobilization will be paid at the contract price as stated in the Schedule of Supplies/Services.
When 5 percent of the original contract amount for other Items is earned through acceptance, then 50 percent of the Mobilization amount, or 5 percent of the original contract amount for other Items, whichever is less, will be paid.
When 10 percent of the original contract amount for other Items is earned through acceptance, then 100 percent of the Mobilization amount, or 10 percent of the original contract amount for other Items, whichever is less, will be paid.
Any remaining portion of the Mobilization amount will be paid after final acceptance and invoicing.

Description of Requirement:
Project Scope It is the intent of the Government to award a firm fixed price order for the base and possibly Option 1001 at the time of award. Due to the unknown nature of Option 1002 the Government reserves the right to exercise this option as a time and materials modification if the work is needed. The schedule for Option 1002 represents the estimated quantities and minimum labor categories required to perform the work. Contractors may add additional labor categories if needed.
Option 1002:
Quoter’s shall submit prices for item categories in Option 1002. Each price entered in the Schedule of Items, for an individual line item, constitutes the quoter’s proposed maximum total price for fully burdened rates for completion of one unit of measure. Option 1002 will be exercised as a not too exceed modification if needed. Other direct costs and items not originally priced in the Schedule of Items will be negotiated and set at the time Option 1002 is exercised. A Statement of Work (SOW) will be provided to the Contractor prior to the negotiation of the work with the Contractor prior to exercising Option 1002.
The work includes, but is not limited to, the following major items of work as shown on the plans and specified in the attached Forest Service Supplemental Specifications.
The following descriptions and general specifications are provided as an outline of major work items, and shall not be construed as an inclusive or complete listing of all items of work under this contract:
The intent of this contract is to:
• Remove the Corner Bay administrative facilities, structures, and debris, and associated above and below ground utilities.
• Remove debris and excess items at the nearby Corner Bay sort yard and marine access facility.
• Restore the Corner Bay administrative site to conditions reasonably similar to pre-developed conditions, including re-contouring and re-planting the site.
• Develop a site for a new Forest Service administrative camp.
• Excavate and remediate legacy contaminated soil, if discovered during performance of the work.
The Contractor shall furnish all labor, materials, equipment, tools, transportation, supplies, permits, testing, excavation, backfill, grading, and incidentals necessary to perform all work required to complete the project in accordance with the provisions of the contract.
Project Location The project is located on Chichagof Island adjacent to Corner Bay on the south shore of Tenakee Inlet. See attached zip file for maps.
GPS coordinates: 57°44'05.7"N 135°08'55.5"W. The legal description is R63E, T48S, Sec. 1, Copper River Meridian (Sitka C-4 quadrangle). The nearest community, Tenakee Springs, Alaska is approximately four miles north on the north shore of Tenakee Inlet. The nearest full service communities are Juneau, 45 miles northeast on the mainland and Sitka, 50 miles south on Baranof Island.
Access The Corner Bay administrative site is accessible by charter boat, floatplane, or helicopter. The Alaska Marine Highway System has historically made scheduled ferry sailings to Tenakee Springs. As of 7-13-20, the AMHS schedule does not currently list any sailings to Tenakee Springs. A drive-down salt water dock and marine access facility are within one half-mile of the administrative site, connected to the administrative site by Forest Service Roads 7551 and 75511.

Period of Performance Period of Performance shall be no later than May 15, 2021. Period of Performance includes delays for weather, locating and transporting supplies and materials, and final site cleanup.
Project Site Clean Up Project site cleanup includes the removal and proper disposal of all project trash, demolition debris, and residue off National Forest Land.
Pre-Proposal Tours There will not be a Pre-Proposal Tour for the project. Prospective quoters are encouraged to tour the site prior to submitting a quote. The Contractor acknowledges that they have taken the necessary steps to ascertain the nature and location of work, and have investigated and satisfied themselves as to the general and local conditions that can affect the work or its cost. Any failure of the contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from the responsibility of estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expenses to the government.
Pre-Proposal Conference Call There will be a Pre-Proposal conference call on August 4, 2020 at 10:00 a.m. Alaska Time.

Additional Requirements
A. Must be a licensed general contractor capable of completing heavy civil construction work.
B. Building permits are not required as this is a Federally-owned property and Federally-owned facilities.
C. Safety: Contractor shall submit a written Safety Plan within fourteen (14) calendar days after the Notice to
Proceed, but prior to any on-site activities. The Safety Plan shall address safety of the public and contractor personnel, and protection of improvements. The Safety Plan shall comply with and reference all applicable OSHA Construction and Workplace requirements and all applicable State of Alaska health mandates.
D. Comply with all National and Alaska Region Best Management Practices (BMPs) for facilities and site.
See Forest Service Supplemental Specifications for further information and instructions for accessing the BMPs.
E. Payment will be made only for those items listed on the Schedule of Items. All other work is incidental to those pay items.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

452.236-74 Control of Erosion, Sedimentation, and Pollution (Nov 1996)
(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).
(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.
(c) Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.
452.236-77 Emergency Response (Nov 1996)
(a) Contractor's Responsibility for Fire Fighting. (1) The Contractor, under the provisions of FAR clause 52.236-9, PROTECTION OF EXISTING VEGETATION, STRUCTURES, EQUIPMENT, UTILITIES, AND
IMPROVEMENTS, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work. (2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor's agents or employees.
(b) Contractor's Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.
(c) Contractor's Responsibility for Responding to Emergencies. When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to firefighting). An equitable adjustment for the temporary use of employees and equipment will be made under the CHANGES clause, FAR 52.243-4.
452.246-70 Inspection and Acceptance (Feb 1988)

f. Working in high-density brown bear habitat.
g. Any other type of experience that is similar in scope to the Corner Bay Facilities
Decommissioning project.
2) Past Performance:
Submit a list of relevant projects completed within the last five (5) years that are similar in scope and complexity to this one. Include at least two projects on which you performed successfully in similar environmentally sensitive areas and remote, wet conditions. For each project, submit the project name, location, description of the work, dollar value and name/phone/email of project owner representative.
3) Proposed Approach to Performing the Work:
Describe the firm’s planned approach to performing this work, including specific reference to the following:
1. How you will deliver equipment and materials/supplies to the job site including moving equipment and materials within the site.
2. How you will accomplish off site debris disposal.
3. Where your crew will stay, and how will they be housed and cared for.
4. Worker safety: Explain how you will protect workers, including from protecting them from bears, both in camp and at the project site.
5. Identify your Quality Control manager; provide information regarding their experience and qualifications.
6. Provide a preliminary schedule of work showing major project milestones and dates and ensuring completion within the required period of performance.
7. Describe your efforts to adaptively comply with current and future State of Alaska COVID-19
Health Mandates along with any other Federal, State or Local requirements. In other words, how do you intend to comply with existing requirements and maintain flexibility to comply with changes as they occur. Please submit a filled-in Schedule of Supplies/Services from Page 2 above. The Forest Service will evaluate quote prices for reasonableness in accordance with the Federal Acqusition Regulation (FAR) including the Base plus all Options. The Government will evaluate quotes for award purposes in accordance with FAR 52.217-5 Evaluation of Options (Jul 1990) below.
This information will be used by the Government for evaluation (see Evaluation of Quotes below).
52.212-3, Offeror Representations and Certifications – Commercial Items (Mar 2020) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision— “Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
‘Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation”, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C.
395(c).

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the
Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
“Sensitive technology”—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Veteran-owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.
“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women;
or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern—
(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
