About this file
This is a Memorandum to File documenting a determination for sole-source procurement under FAR Part 13 for a FAR Part 13 acquisition below the Simplified Acquisition Threshold.
The Defense Services Organization (DSO), Judge Advocate Division (JAD), requires conference facilities and audio-visual services for the DSO Worldwide Training event scheduled for September 13-18, 2026, in Phoenix, Arizona. The required services include one large conference room accommodating 150 people with crescent-style seating and three airwalls for subdivision, one 30-person classroom-style room, one 27-person classroom-style room with one airwall, and one 8-person boardroom. Audio-visual requirements include six projectors with stands, six projection screens, one podium, microphones (handheld and lavalier), remotes, cables, and adapters. The venue must provide dedicated on-site A/V technical support throughout the event, reliable internet and networking services, table and chair arrangement per provided layouts, ballroom partition staffing on a predetermined schedule, and daily janitorial services. The venue must have co-located lodging for 150 attendees or be within walking distance to the DoubleTree Suites by Hilton Phoenix and located within a 5-mile radius of Phoenix Sky Harbor International Airport. The determination identifies Folsom Hotel Corporation Inc. (DoubleTree) by Hilton Phoenix as the only responsible source based on "Other Reasons." The justification cites comprehensive market research confirming that alternative conference centers and hotels in the Phoenix area were either unavailable for the required dates or unable to support the necessary attendee count and co-located lodging requirement. The document states that failure to secure this specific venue would necessitate cancellation of the event, directly jeopardizing legal readiness and statutory compliance for Marines.

Determination that Only One Source is Reasonably Available (Including Brand Name) – FAR Part 13 Acquisitions under the SAT
V 1.6 (20 December 2023)
MEMORANDUM TO THE FILE
Subj: DETERMINATION THAT ONLY ONE SOURCE IS REASONABLY
AVAILABLE FOR A FAR PART 13 ACQUISITION UNDER THE SIMPLIFIED
ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
Defense Services Organization (DSO), Judge Advocate Division (JAD) has a requirement for a conference space with break out rooms, and audio/visual accommodations for the DSO Worldwide Training event to be held in Phoenix, Arizona.
The Conference Room and Audio-Visual Packages must include:
Meeting Spaces:

o Provide one conference room to seat 30 people in a classroom style (10 tables at 8’1”x24” each).

o Provide one boardroom to seat 8 people with a conference-style table and seating.
o Ensure all rooms are in reasonable proximity to each other, with adequate lighting, climate control, and accessibility.
Audio-Visual & Technical Support:
o Provide and set up six projectors (1ft8in x 2ft11in) with stands, six projector screens (9ft2in x 6ft1in), one podium, and all necessary microphones (handheld, lavalier, etc.), remotes, cables, and adapters.

Required Source: Folsom Hotel Corporation Inc. (DoubleTree) by Hilton Phoenix
THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING (select all that apply):
ONLY ONE RESPONSIBLE SOURCE (select all that apply):
__ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
__EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
__ OTHER REASONS. The DSO Worldwide Training requires a venue that can provide the specific conference facilities outlined in Paragraph II while also meeting several non-negotiable logistical requirements. The selected venue must be available for 13-18 September 202 , located within walking distance to the DoubleTree Suites by Hilton Phoenix, and situated in close proximity to Phoenix Sky Harbor International Airport. These geographical and logistical constraints are critical to ensure timely attendance, reduce transportation costs for the government, and maintain the schedule integrity of a complex, multi-day training event. The DoubleTree Suites By Hilton Phoenix is the only responsible source identified that is capable and available to meet all of these interdependent needs for the required period of performance.
Comprehensive market research confirmed the uniqueness of this venue. Other conference centers and hotels in the Phoenix area were contacted but were either unavailable for the required dates or could not support the necessary number of attendees and the co-located lodging requirement. As the training dates are fixed due to extensive coordination across the Marine Corps Enterprise, no other identified venue can satisfy the DSO's minimum needs. Failure to secure this specific venue would necessitate a cancellation of the event, as no viable alternative exists. This would directly jeopardize the legal readiness, statutory compliance, and quality of legal representation provided to Marines, making this sole source acquisition essential to the DSO's mission.
