C.1 GENERAL DESCRIPTION

C.1.1 The Drug Enforcement Administration (DEA) is seeking a suppressed semi-automatic, AR10-pattern precision rifle system chambered in .308 Winchester or 7.62x51mm NATO.

C.1.2 The Contractor shall make available on contract the complete weapon system,1 as well as all individual parts for maintenance of the system.

C.2 SCOPE

C.2.1 This solicitation documents the DEA’s requirement for a suppressed precision rifle system chambered in .308 Winchester or 7.62x51mm NATO. The weapon system shall be a semi-automatic, AR10-pattern rifle.

C.2.2 Weapon system purchased as a result of this solicitation shall meet all requirements specified within the statement of work (Section C) and all evaluation standards documented within Section 6.

C.2.3 The test protocol and evaluation process outlined in Section 6 are specific for this solicitation and should not be considered the standard for any other DEA firearm requirements.

C.3 GENERAL REQUIREMENTS

C.3.1 The weapon system shall be a semi-automatic AR10-pattern rifle.

C.3.2 The weapon system shall be chambered in .308 Winchester or 7.62x51mm NATO.

C.3.3 The chamber of the firearm shall conform to all dimensional specifications established by the Sporting Arms and Ammunition Manufacturers Institute (SAAMI)2 or NATO.

C.3.4 The weapon systems, as well as any parts or components delivered under this contract shall be new and not previously used.

C.3.5 The Contractor must be the manufacturer of the firearm. Contractor may purchase components for the firearm from other sources; however, the Contractor must be the primary manufacturer of the firearm.

C.3.6 For weapon systems delivered as a result of this contract, the Contractor may not use or employ subcontractors without the prior approval of the CO or COR.

C.3.7 Contractor shall provide proof of liability insurance annually in the amount of at least $1,000,000.00.

SECTION C - STATEMENT OF SPECIFICATIONS

C.3.8 Contractor shall be capable of conducting continuous in-house quality control testing to ensure all performance characteristics of rifles are maintained in accordance with the required specifications.

C.3.9 Contractor shall possess the capability to conduct failure analysis on any rifle or system component returned by the Government which does not function as designed or that exhibits signs of an obvious anomaly.

C.3.10 Contractor shall not make any alterations to the rifle design or system components without prior notification to and written approval by the COR.

C.4 FIREARM SPECIFICATIONS

C.4.1 ACCURACY

C.4.1.1 Weapon systems shall have accuracy of 1.5 Minute of Angle (MOA) or better at 100 meters (m) with Federal 168 grain Gold Medal Match.3

C.4.1.2 Weapon systems shall have accuracy of 2.0 MOA or better at 100m with Federal 168 Tactical Bonded Tip (TT2).4

C.4.2 WEAPON SYSTEM REQUIREMENTS

C.4.2.1 Weapon system shall have a minimum functional reliability standard of no more than one (1) weapon-related malfunction in 1,000 rounds fired.5

C.4.2.2 Weapon system shall have an operational temperature range from -40° Fahrenheit (F) up to +140° F. The weapon system shall function reliably anywhere within this temperature range and meet all performance requirements without degradation or failure.

C.4.2.3 Weapon system shall function after exposure to sand.6

C.4.2.4 Weapon system shall be corrosion resistant and function after exposure to saltwater.7

C.4.2.5 Weapon system shall be drop safe. With the selector-lever in either the “SAFE” or “FIRE” position, the rifle shall be able to withstand impacts, including drops onto concrete from 60”, on any component of the weapon, and not fire. Following the impact, the weapon shall be able to safely fire all remaining rounds in the magazine.

C.4.2.6 Charging handle, external safety, magazine catch, and bolt catch shall be ambidextrous.

C.4.2.7 The external safety shall be a 90-degree throw.

C.4.2.8 The top of the upper receiver and handguard shall be equipped with an integral uninterrupted MIL-STD 1913 (Picatinny) accessory rail.

C.4.2.9 The rifle shall be available in black, Flat Dark Earth (or similar), and Ranger Green (or similar).

C.4.2.10 Exposed parts of the weapon system shall be a matte, non- reflective finish.

C.4.2.11 The finish of the weapon system must be durable and resistant to corrosion.

C.4.2.12 Exterior parts of the weapon system shall be devoid of gouges, sharp edges or rough areas which could snag on equipment, clothing, or cause injury or discomfort to a shooter.

C.4.2.13 The rifle shall include ambidextrous sling quick detach (QD) connection points on the buttstock and handguard to accommodate the attachment of a sling to the rifle for left and right-handed shooters.

C.4.3 PHYSICAL SPECIFICATIONS

C.4.3.1 The weight of the bare rifle8 shall be no greater than 12.0 pounds.

C.4.3.2 The overall length of the rifle, unsuppressed and with a collapsed buttstock, shall be no greater than 38.0 inches, as measured from the buttplate/recoil pad of the buttstock to crown.

C.4.3.3 The length of pull shall be no less than 11.0 inches and no more than 16.0 inches, with a minimum of five (5) adjustment increments. The length of pull shall be measured from the buttplate/recoil pad of the buttstock to the front face of the trigger.

C.4.4 BARREL

C.4.4.1 Barrel shall be no less than 16 inches (in.) and no greater than 18 in. (+/- 0.125”) in length, as measured from the muzzle crown to the bolt face with the bolt in battery and locked.

C.4.4.2 While not specified, the twist rate must be sufficient to accurately fire the service ammunition currently in use within the DEA.9

C.4.4.2 The muzzle end of the barrel must have a 5/8 – 24 thread pitch to accommodate a variety of muzzle devices.

C.4.4.3 The barrel shall have a matte, non-reflective finish.

C.4.5 TRIGGER

C.4.5.1 Overall trigger pull weight shall be no less than 4.00 pounds and no more than 6.00 pounds.10

A compatible suppressor shall be supplied with each rifle.

The suppressor, when installed on the rifle, shall not add more than 8.0 inches to the overall length of the rifle.

The suppressor shall weigh 24.0 ounces or less.

The suppressor shall not be comprised of titanium.

The minimum decibel (dB) reduction with the suppressor attached must be 10 dB.11

The diameter of the suppressor, at its widest point, shall be no more than

1.75 in.

The suppressor shall have an embossed serial number.

When comparing the point of impact for the weapon system suppressed to the point of impact when unsuppressed, the shift in the mean point of impact shall be less than or equal to 2 MOA at 100 meters.12

Suppressor repeatability: The shift of the point of impact location when the suppressor is removed and then reinstalled on the rifle shall be less than or equal to 1 MOA at 100 meters.13

Contractor shall supply use and care instructions for the suppressor.

Instructions shall include a manufacturer recommended maintenance schedule and detailed cleaning and maintenance procedures for the suppressor.

The suppressor shall secure to the rifle’s muzzle device with a quick detach (QD) mechanism.

Contractor shall make available on contract a suppressor alignment rod and may be included for testing

If a proprietary muzzle device installation tool is required, Contractor shall make it available on contract.

If the muzzle device is timed during installation, Contractor shall make a timing shim kit and wheel available on contract.

C.4.6.15 If the shooter / user requires a specialized tool to remove the suppressor for routine cleaning, that tool shall be included with each suppressor delivered under this contract.

C.4.6.16 Weapon system shall include a suppressor cover, which aids in the reduction of mirage when viewed through an optic. Suppressor cover shall also offer protection to the shooter’s hand from burns when installing or removing the suppressor.

Weapon system shall be supplied with four (4) magazines. Two (2) of the magazines shall have a capacity of 20 rounds. Two (2) of the magazines shall have a capacity of 10 rounds.

Contractor shall make the magazines identified in C.4.7.1 available on contract.

Magazines must positively lock in the magazine well.

Magazines shall release and fall free from the magazine well when magazine catch is completely depressed regardless of the number of cartridges contained within the magazine and regardless of the position of the bolt carrier (e.g., in battery or locked to the rear).14

Magazines shall withstand drops from distances up to and including 48”, onto hard surfaces, and still function within the weapon system.15 The requirement for durability from drops includes drops of empty magazines and magazines loaded with any number of cartridges up to and including magazines loaded to full capacity.

The edges around the entrance of the magazine well must be beveled and devoid of sharp edges.

The magazine catch / release must be located on the lower receiver near the junction of the trigger guard and the magazine well.

The magazine catch must be ambidextrous.

No part of the magazine catch may pass through the trigger guard.

The magazine catch must be designed and positioned to reduce the likelihood of inadvertent release of the magazine during handling and/or firing.

C.4.8 FORE RAIL

C.4.8.1 The fore rail (referred to as “handguard”) shall have a MIL-STD 1913 accessory rail on the entirety of the top (12 o’clock position). The MIL-STD 1913 accessory rail shall be integral to the handguard. The height of the MIL

STD 1913 rail on the fore rail shall match the height of the MIL-STD 1913 rail on the top of the upper receiver.

C.4.8.2 Both sides of the handguard (3 and 9 o’clock positions) shall have Modular Lock (“M-LOK”) designs for the entire length of the handguard.

C.4.8.3 The bottom of the handguard (6 o’clock position) shall have M-LOK or ARCA integrated. If the bottom of the handguard is not ARCA integrated, the Contractor shall include an M-LOK ARCA rail section with the weapon system.

C.4.9 PARTS INTERCHANGEABILITY AND FINISH

C.4.9.1 Rifle parts and components shall be 100% interchangeable between rifles of the same type.16 Interchangeable components shall include the bolt carrier group (BCG), upper receiver, and lower receiver.

C.4.9.2 Individual parts and components delivered under this contract shall be free of defects and ready for installation on existing rifles immediately upon delivery. Gunsmiths shall not be required to machine or custom fit parts or components.

C.4.9.3 Internal surfaces shall be void of rough surfaces at critical points of movement and polished or coated as necessary to provide minimal friction and wear to promote functional reliability.

C.4.9.4 If applicable, parts shall meet all industry and mil-spec standards for firearm parts durability. When applicable, parts shall be coated, anodized, or otherwise surface treated to enhance durability.

C.4.9.5 Parts shall be resistant to corrosion. This may be accomplished using non-corrosive materials or surface coatings that prevent corrosion.

C.4.10 CLEANING KITS

C.4.10.1 A cleaning kit shall be included with every weapon system delivered under this contract and available for separate purchase on the contract. The cleaning kit may be a commercially available kit or a custom kit for the weapon system. The kit shall include, at a minimum, the following:

• One (1) nylon-coated bore rod.

• One (1) bore guide.

• Chamber and bore metal wire brush.

• Brass jag for bore patches.

• Dual-end nylon bristle utility brush.

• Any other items the Contractor deems necessary for the proper field cleaning of the weapon system.

• Suppressor cleaning kit (if manufacturer specified).

C.4.11 CARRY CASE

16 100% parts interchangeability excludes barrel and matched bolt if they are a custom-fit “matched-pair.”

C.4.11.1 Contractor shall make available on contract two (2) optional weapon cases; a hard-shell transport case and a soft-sided or discreet carry case.

C.4.11.2 Optional hard-shell transport case shall carry the rifle in a secure and element-protective manner while allowing for reasonable access to the weapon.

C.4.11.3 Optional hard-shell transport case shall be rectangular in shape and not conform to the shape of the rifle. Hard-shell transport case shall be sufficiently sized to fit the optional soft-sided case.

C.4.11.4 Optional hard-shell transport case shall have least three (3) closing latches [preference for five (5) closing latches].

C.4.11.5 Optional hard-shell transport case shall have the ability to lock. This may be accomplished with integral holes which accept a medium security lock or padlock.

C.4.11.6 Optional hard-shell transport case may store the rifle fully assembled or with a separated upper and lower. If the weapon is stored in the case separated, the optic and suppressor must remain attached to the upper.

C.4.11.7 Optional soft-sided carry case shall be designed to allow for quick access to the weapon.

C.4.11.8 Optional soft-sided carry case shall be rectangular in shape and not conform to the shape of the weapon.

C.4.11.9 Optional soft-sided carry case shall be constructed of #1000 denier abrasion and water-resistant nylon or comparable material. It shall have heavy-duty zippers, #9 YKK or similar. It shall be padded to provide protection to the weapon system. It shall have a padded and detachable shoulder strap.

C.4.11.10 Optional soft-sided carry case shall be tan in color (or similar) and have no external markings, logos or insignia that would identify the carry case as a weapons bag.

C.4.11.11 Optional soft-sided carry case shall have at least two (2) compartments: one compartment shall hold the rifle securely fastened while being carried, the second compartment shall be large enough to hold additional equipment including extra ammunition, magazines, and a cleaning kit.

C.4.11.12 Optional soft-sided carry case shall have at least four (4) interior pouches with flaps that will hold rifle magazines securely in place.

C.5 ARMORER COURSE AND TOOLS

C.5.1 Contractor shall be capable of providing Armorer Courses. Those Armorer Courses should include a basic and advanced versions, available for class sizes up to twenty

(20) individuals.17

17 DEA requires one (1) Armorer Course be performed at the DEA Academy in Quantico, Virginia within 30 days of contract award.

C.5.2 Contractor shall make Armorer Courses available on the contract.

C.5.3 Any armorer’s tools proprietary to the weapon system (rifle or suppressor) shall be available on contract.

C.5.4 Any proprietary inspection tools shall be available on contract.

C.6 AUTHORIZED BUYERS

C.6.1 Authorized buyers include DOJ agency components, including but not limited to DEA, FBI, and US Marshals. Other agencies may seek permission to utilize the contract on a case-by-case basis. Interested parties shall contact the Contracting Officer (CO) and Contracting Officer Representative (COR) for authorization.

C.6.2 Periodic adjustments may be made to the authorized buyer list throughout the life of the contract.

C.7 REPORTS

C.7.1 Contractor shall provide quarterly reports to the Contracting Officer within thirty

(30) calendar days of the end of the quarter [Jan-Mar/Apr-Jun/Jul-Sep/Oct-Dec] during which supplies were ordered. The report shall include:

a) Contract Number

b) Period of Performance (ex: Base Year/Qtr. 1)

c) List of orders “ACCEPTED” during quarter for each authorized buyer (include delivery order number & dollar value of order).

d) Total dollar value of all accepted orders during the quarter (combined quarterly figure).

e) Total dollar value of usage to date (current quarterly figure combined with previous quarters) under the contract.

f) Include contract ceiling on each quarterly report.

C.7.2 It is preferred that this information be provided using Microsoft Excel.

C.7.3 If the quarterly report is not provided within thirty (30) calendar days of the end of quarter as required, a written explanation as to why the report is tardy shall be provided with the quarterly report.

C.8 QUALITY CONTROL PLAN

C.8.1 Contractor shall be capable of conducting in-house Quality Control (QC) testing to ensure that all weapon systems delivered under this contract meet all of the requirements outlined herein.

C.8.2 Contractor shall provide specific information on Quality Control measures applied to all rifles acquired under this contract. Any revisions must be forwarded to the COR within five (5) calendar days of the effective date.

C.8.3 Rifles which fail any portion of Contractor’s Quality Control testing must be rejected and not shipped.

C.9 MEDIA STATEMENTS

C.9.1 All press statements and releases related to the contract must receive advance written approval by the Contracting Officer.

SECTION D - PACKAGING AND MARKING

D.1 PACKAGING AND MARKING

D.1.1 Packaging and packing for all items delivered under this contract shall be in accordance with commercial practice and adequate to ensure acceptance by common carrier and safe arrival at destination. The Contractor shall place the delivery order number on or adjacent to the exterior shipping label.

D.1.2 For any parts delivered under this contract, the parts shall be properly labeled such that the part numbers, descriptions, and lot numbers (when applicable) are clearly identifiable.

SECTION E – INSPECTION AND ACCEPTANCE

E.1 QUALITY ASSURANCE

E.1.1 Weapon systems and parts delivered under this contract shall have passed in-house Quality Assurance (QA) inspections.

E.1.2 Contractor shall ensure that the quality of the products delivered is maintained throughout the life of the contract. Quality of the products delivered will be monitored by the COR and/or technical personnel.

E.1.3 The Government reserves the right to inspect and/or test any parts delivered under this contract.

E.1.4 Any weapons, parts or components that fail the Government’s inspection and/or testing, for any reason, will be returned to the Contractor, at no cost to the Government, and replaced with equal weapons, parts or components.

E.1.5 Contractor shall provide a point of contact for contract administrative matters.

E.1.6 Contractor shall provide a technical point of contact (TPOC) for technical matters pertaining to parts supplied under this contract.

E.1.7 For any parts returned, the Contractor shall provide replacement parts that meet the contract requirements within ten (10) business days.

E.1.8 Failure to maintain the standards established at the time of award is detrimental to the Government. Should a pattern of failure emerge, this shall constitute grounds for the initiation of termination proceedings.

E.2 WARRANTIES

E.2.1 Contractor shall warranty all weapon systems and parts delivered to be free of defects in materials and workmanship. There shall be no anomalies or defects in manufacturing that could cause a compromise in functional reliability (i.e., failure to fire) or create a safety hazard for the shooter.

E.2.2 The warranty period shall begin when the weapon system is inspected and accepted at the Government installation, not on the date of manufacture or the date of delivery.

Date of inspection and acceptance will be determined by the CO, COR, or designated technical personnel.

E.2.3 Contractor shall provide standard warranty for a period of no less than 12 months from the date of acceptance.

E.2.4 Contractor shall offer an extended warranty period available as an optional contract item. Contractor shall specify what is covered in the extended warranty.

E.2.5 Minimum 12-month warranty shall include the replacement of any broken or excessively worn parts. The warranty shall include all individual parts, up to the full replacement of rifles.

E.2.6 During the warranty period, the Government shall have the option to return any inoperable weapon(s) to the Contractor for repair and/or replacement. The manufacturer shall repair the inoperable weapon back to factory specifications and return the weapon to the end user within sixty (60) days.

E.2.7 Contractor shall provide clear, written instructions to each ordering entity regarding warranty provisions and replacement procedures.

E.2.8 Warranty claims shall be remedied at no expense to the government. Contractor will be responsible for related shipping costs.

E.2.9 Contractor shall work with the CO and/or COR to establish a written procedure for warranty exchanges.

E.2.10 Contractor shall notify the CO and COR immediately of any recall notices, warranty replacements, safety notices, or other issues regarding the weapon system. In the event of a recall notice, warranty replacements, safety notices, or other issue, the Contractor shall provide the DEA with a written plan of action for remediation.

SECTION F – DELIVERIES AND PERFORMANCE

F.1 PERIOD OF PERFORMANCE

F.1.1 The anticipated period of performance shall be a twelve (12) month base period, to begin on the date of award, with four (4) possible one-year option periods.

F.2 DELIVERY SCHEDULE

F.2.1 Contractor shall deliver weapon systems and parts within 90 days after receipt of order. In the event of a delay, see F.3.1.

F.2.2 Contractor is to deliver the entire quantity of weapon systems or parts; however, partial shipments may be accepted with prior approval from the CO or COR.

F.2.3 Emergency orders, identified as such by the DEA CO or COR, must receive priority fulfillment over all other orders under this contract, otherwise all orders must be prioritized in the order they are received.

F.3 NOTICE TO THE GOVERNMENT OF DELAYS

F.3.1 In the event the Contractor encounters difficulty in meeting delivery schedules or completion dates, or if the Contractor has knowledge of a situation that may delay the timely performance of this contract, the Contractor shall notify the CO and COR in writing within five (5) business days. Contractor shall provide the COR with (1) a detailed justification for the delay and (2) a realistic time for delivery.

F.4 PLACE OF DELIVERY / F.O.B. DESTINATION

F.4.1 Weapon systems and parts delivered under this contract are expected to be shipped primarily to the following locations:

(a) DEA Firearms Training, Quantico, Virginia

(b) FBI Defensive Systems Unit, Redstone Arsenal, Alabama

(c) USMS Training Academy, Glynco, Georgia

The government anticipates most orders to be shipped to the above-noted locations.

However, as outlined in Section C.6, other Government agencies may be permitted to buy off the contract. The Contractor should anticipate that some orders may be shipped to other locations than those listed above. The government reserves the right to request shipments to other locations within CONUS, as well as Hawaii, Alaska, Puerto Rico, and U.S. Virgin Islands. Shipping address will be noted at the time of order.

F.4.2 Delivery of Replacement Parts shall be F.O.B. Destination.

(a) The term "F.O.B. Destination," as used in this clause, means--

(1) Free of expense to the Government, on board the carrier's conveyance, at a specified delivery point where the consignee's facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and

(2) Supplies shall be delivered to the destination consignee's wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or "constructive placement" as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including "piggyback") is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor

Freight Classification for "heavy or bulky freight." When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarder for less than carload shipments, the Contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.

(b) The Contractor shall;

(1) Pack and mark the shipment to comply with contract specifications; or in the absence of specifications, prepare the shipment in conformance with carrier requirements.

(2) Prepare and distribute commercial bills of lading;

(3) Deliver the shipment in good order and condition to the point of delivery specified in the contract;

(4) Be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract;

(5) Furnish a delivery schedule and designate the mode of delivering carrier;

and

(6) Pay and bear all charges to the specified point of delivery.

Appendix A: Definitions

Caliber- (Firearms), the diameter of the bore measured from land to land, usually expressed in hundredths of an inch. The caliber for this rifle shall conform to the .308 Winchester (T), with the possibility of a depot-level or offeror facility barrel swap to 6.5mm Creedmoor (O).

Magazine-The device for storing cartridges in a repeating firearm for loading into the chamber. It has a spring and follower to feed those cartridges into the chamber of a firearm. The magazine shall be detachable from the firearm.

Magazine Well- The area in the interior of the receiver in which the magazine is inserted.

Muzzle brake- A device at or in the muzzle end of a barrel that uses the emerging gas behind the projectile to reduce recoil.

Bevell (magazine well)- The removal of sharp edges at the entrance of the magazine well to facilitate magazine insertion.

Flare (magazine well)- The expansion or shaping of the receiver at the entrance of the magazine well to facilitate insertion of the magazine.

Semiautomatic- A repeating firearm requiring a separate pull of the trigger for each shot fired, and which uses the energy of discharge to perform a portion of the operating or firing cycle (usually the loading portion).

Suppressor/Silencer- The term “Firearm Silencer” or “Firearm Muffler” means any device for silencing, muffling, or diminishing the report of a portable firearm, including any combination of parts, designed or redesigned, and intended for the use in assembling or fabricating a firearm silencer or firearm muffler, any part intended only for use in such assembly or fabrication.

Special Tools/Tooling- Special tooling means jigs, dies, fixtures, molds, patterns, taps, gauges, and all components of these items including foundations and similar improvements necessary for installing special tooling, and which are of such a specialized nature that without substantial modification or alteration their use is limited to the development or production of particular supplies or parts thereof or to the performance of particular services. Special tooling does not include material, special test equipment, real property, equipment, machine tools, or similar capital items (FAR 2.101).

Trigger - That part of a firearm mechanism which is moved manually to cause the firearm to discharge.

Trigger Movement- The amount of trigger travel measured from the front center of the trigger at rest to the point at which the sear is released.

Trigger Reach- The distance measured from the front center of the trigger in a straight line nearest to the point at the rear of grip or back strap.

Trigger weight- The amount of force which must be applied to the trigger of a firearm to cause sear release. It is measured with hanging weights or an appropriate scale touching the trigger at a point where the trigger finger would normally rest, and with the force applied approximately parallel to the bore axis.

Length of pull- The measurement from the trigger face to the rear face of the butt-pad or butt-plate.

Hammer - A component part of the firing mechanism which gives impulse to the firing pin or primer.

Sear – A part which retains the hammer or striker in the cocked position until the trigger is pulled.

Accessory Rail- Standard rail integration system using MIL-STD-1913 or STANAG 4694 "NATO Accessory Rail", both terms may be considered interchangeable for this SOW.

ARCA swiss rail- Dovetail-type flat rail used for attaching auxiliary equipment such as bipods or tripods.

M-Lok- Modular Lock rail interface system patented by MagPul Industries, used to attach auxiliary equipment and rail sections.

Objective- An attribute that is applicable when a higher level of performance delivers significant increased operational effect, or decreased operational risk. The objective value is the desired operational goal that is achievable. Statements marked with (O) reflect the objective attribute desired.

Threshold- Reflects the minimum performance required to achieve the required operational effect, while being achievable through the current state of technology at an affordable life-cycle cost. Performance below the threshold value is not operationally effective or suitable or may not provide an improvement over current capability. Statements marked with (T) reflect the threshold performance attribute acceptable.

Malfunction- is a mechanical failure, or parts failure (for example, a broken extractor, or ejector, or a weak magazine spring, or wide magazine feed lips).

Stoppage- is an interruption of the cycle of operations caused by mechanical or operator malfunction (a “stove-piped” cartridge, or a failure to properly seat a magazine).

SECTION 3.0 – CONTRACT ADMINISTRATION

(a) Pursuant to FAR subpart 42.15, the Government will assess the Contractor’s performance under this contract. Performance assessment information may be used by the Government for decision-making on exercise of options, source selection, and other purposes, and will be made available to other federal agencies for similar purposes.

(b) Performance will be assessed in the following areas from the Statement of Work:

(1) Quality of product or service

(2) Schedule

(3) Cost Control

(4) Business Relations

(5) Management of key personnel

(6) Other appropriate areas.

(c) For contracts that include the clause at 52.219-9, Small Business Subcontracting Plan, performance assessments will consider performance against, and efforts to achieve, small business subcontracting goals set forth in the small business subcontracting plan.

(d) For any contract with a performance period exceeding 18 months, inclusive of all options, the Government will perform interim performance assessments annually and a final performance assessment upon completion of the contract.

(e) The Government will prepare contractor performance assessment reports electronically using the Contractor Performance Assessment Reporting System (CPARS). Additional information on CPARS may be found at www.cpars.gov.

(f) The Contractor will be provided access to CPARS to review performance assessments. The Contractor shall designate a CPARS point-of-contact for each contract subject to performance assessment reporting. Upon setup of a contract in CPARS, the Contractor’s CPARS point-of- contact will receive a system-generated e-mail with information and instructions for using CPARS. Prior to finalizing any contractor performance assessment, the Contractor shall be given 14 calendar days to review the report and submit comments, rebutting statements, or additional information. Disagreements between the Contractor and the Government performance assessment official will be https://www.acquisition.gov/content/part-42-contract-administration-and-audit-services#i1074222 http://www.cpars.gov/ resolved by a Government Reviewing Official, whose decision on the matter will be final.

(g) The Government will also report in the Federal Awardee Performance and Integrity Information System (FAPIIS) module of CPARS information related to:

(1) A Contracting Officer’s final determination that a contractor has submitted defective cost or pricing data.

(2) Any subsequent change to a final determination concerning defective cost or pricing data pursuant to 15.407-1(d);

(3) Any issuance of a final termination for default or cause notice; or

(4) Any subsequent withdrawal or a conversion of a termination for default to a termination for convenience.

3.2 DEA-2852.242-71 INVOICE REQUIREMENTS (MAY 2012)

(h) The Contractor shall submit scanned or electronic images of invoice(s) to the following e-mail addresses:

(1) Process Coordinator: lnvoice.lnspections@usdoj.gov

(2) Contract Specialist: Alycia Spears; Alycia.spears@dea.gov

(3) Contracting Officer’s Representative: Paul.m.lennan; paul.m.lennan@dea.gov

(i) The date of record for invoice receipt is established on the day of receipt of the e-mail if it arrives before the end of standard business hours (5 p.m. local), or the next business day if the invoice arrives outside of normal business hours. Scanned documents with original signatures in .pdf or other graphic formats attached to the e-mail are acceptable.

Digital/electronic signatures and certificates cannot be processed by DEA and will be returned.

(j) In addition to the items specified in FAR 32.905(b), a proper invoice shall also include the following minimum additional information and/or attached documentation:

(1) Total/cumulative charges for the billing period for each Contract Line Item Number (CLIN);

(2) Dates upon which items/services were delivered; and

(3) The Contractor’s Taxpayer Identification Number (TIN).

(k) Invoices will be rejected if they are illegible or otherwise mailto:lnvoice.lnspections@usdoj.gov unreadable, or if they do not contain the required information or signatures.

3.3 DEA-2852.242-72 FINAL INVOICE AND RELEASE OF

RESIDUAL FUNDS (MAY 2012)

(l) The Contractor shall submit a copy of the final invoice to the Contracting Officer at the address listed in clause DEA-2852.242-71, Invoice Requirements. The final invoice must be marked “Informational Copy – Final Invoice.”

(m) By submission of the final invoice and upon receipt of final payment, the

(n) Contractor releases the Government from any and all claims arising under, or by virtue of, this contract.

Accordingly, the Government shall not be liable for the payment of any future invoices that may be submitted under the above referenced order.

(o) If residual funds on the contract total $100 or less after payment of the final invoice, the Government will automatically deobligate the residual funds without further communication with the vendor.

(p) If funds greater than $100 remain on this order after payment of the final invoice, the Government will issue a bilateral modification to deobligate the residual funds. The contractor will have up to 30 calendar days after issuance of the modification to sign and return it.

The contractor’s signature on the modification shall constitute a release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically exempted from the operation of the release. If the contractor fails to sign the modification or assert a claim within the stated period, the Government will deobligate the residual balance and proceed with close-out of the contract.
