A. BASIS FOR AWARD
This acquisition is a full and open, competitive procurement utilizing Lowest Price Technically
Acceptable (LPTA) best value continuum source selection procedures in accordance with FAR
15.101-2.
A single award will be made to the Offeror who provides a technically acceptable proposal with the lowest evaluated price.
Proposed prices will be evaluated but not scored or otherwise combined with the other aspects of the proposal evaluation.
B. FACTORS TO BE EVALUATED
Factor 1: Price
Factor 2: Technical
Factor 3: Past Performance
C. EVALUATION APPROACH
All proposals will be evaluated by the Source Selection Team (SST). In order for any offeror to be considered for award, the proposal must receive an “Acceptable” rating in every non-price factor. The two non-price factors are Technical and Past Performance.
Factor 1: Price
Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. An award will be made to the lowest priced, technically acceptable proposal. The lowest price will be determined by adding up all line items. Offerors shall complete and submit the Schedule of Prices with its proposal and include a price for each line item. Failure to submit a price for any of the required line items on the Schedule of Prices will render the Offeror’s proposal as ineligible for award. Offerors will be allowed one proposal submission.
The Source Selection Evaluation Board will evaluate each Offeror’s price and verify that unbalanced pricing is not present. The Contracting Officer will evaluate each Offeror’s price in accordance with FAR 15.404-1 to determine price reasonableness. Price reasonableness will be determined by comparing all proposed prices, the Independent Government Estimate, and pricing of previous work that is equivalent or similar to the requirement.
b5ctejep Text Box THE GOVERNMENT RESERVES THE RIGHT TO AWARD OPTION A AND/OR OPTION B AT ANY TIME WITHIN 90 DAYS AFTER AWARD OF THE BASE BID
IF OPTION A IS AWARDED, THE CONTRACT WILL BE EXTENDED 90 CALENDAR DAYS.
IF OPTION B IS AWARDED, THE CONTRACT WILL NOT BE EXTENDED.
The otherwise technically acceptable lowest priced Offeror may be required to confirm/validate their offered price. Certified cost and pricing data are not currently required; however, the
Government reserves the right to request such data prior to award.
Factor 2: Technical
The Government will evaluate the Technical Proposal on an Acceptable/Unacceptable basis.
This factor identifies the minimum requirements that are imperative to successful contract performance.
The Source Selection Team will evaluate the Offeror’s proposal against the factors listed below to determine whether the technical proposal is Acceptable or Unacceptable. To be considered acceptable, all factors under the technical proposal must receive an acceptable rating. The adjectival rating depicts whether or not the offeror’s proposal meets the Technical Proposal factor requirements.
Table C-1
Technical Proposal
Acceptable/Unacceptable Ratings
Rating Description
ACCEPTABLE Proposal meets the minimum requirements of the solicitation and is rated Acceptable for Subfactors 2.1 and 2.2.
UNACCEPTABLE Proposal does not meet the minimum requirements of the solicitation or is rated Unacceptable for either Subfactors 2.1 or 2.2.
Subfactor 2.1: Schedule
Technical Subfactor 2.1 evaluates the Offeror’s proposed schedule for the for the project, including the Offeror’s proposed sequence of work and awareness of critical activities. The Government will evaluate the Offeror’s proposed schedule to determine understanding of and compliance with the Government’s requirements.
Minimum requirements for this factor include a preliminary bar chart schedule showing the below critical activities at a minimum, for each site as applicable, as outlined in Specification
Section 01 14 00, WORK RESTRICTIONS. The Offeror may include activities in addition to those listed below if helpful to explain their proposed sequence of work, duration of activities, or other important information.
Activities to show in a preliminary bar chart schedule:
a. Survey of existing lock components
b. Sheet pile weld repair and painting of the transition wall
c. Lead paint abatement on the transition wall
d. Construction of new handrail and its concrete foundation behind the existing transition wall
e. Handrail replacement on the upstream guide wall.
f. Upstream guide wall traveling kevel assembly fabrication and installation
g. Saw cutting and removal of upstream guide wall checkpost
h. Upstream guide wall checkpost fabrication and installation
i. Vertical concrete joint repairs on the upstream guide wall
j. Electrical demolition and installation of temporary power
k. Installation of electrical conduit, cable, and pull boxes
The Government will evaluate the schedule based on demonstration of all activities listed above being complete by the end of the lock closure period.
The Government will evaluate Subfactor 2.1: Schedule on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-2. Offerors rated “Unacceptable” will not be eligible for award.
Table C-2. Subfactor 2.1: Schedule Evaluation Ratings
Rating Description
ACCEPTABLE The preliminary bar chart schedule includes all activities listed above with reasonable durations and sequence of work and shows completion of all activities by the end of the contract duration. Based on the schedule proposed by the
Offeror, the Government has a reasonable expectation that the
Offeror will successfully perform the required effort
UNACCEPTABLE The preliminary bar chart schedule does not include all activities listed above, the durations are not reasonable, the sequences are not reasonable, or the schedule does not show completion of all activities by the end of the contract duration.
Based on the schedule proposed by the Offeror, the
Government does not have a reasonable expectation that the
Offeror will successfully perform the required effort.
Subfactor 2.2: Experience
The Government will evaluate relevant experience of the Offeror. Relevant experience is what an Offeror has done on past projects.
The Offeror shall submit a minimum of two (2) projects within ten (10) years of the solicitation issuance date which demonstrate experience in the following features of work:
1) Offeror must have at least one (1) project demonstrating experience with working on a lock or dam structure.
2) Offeror must have at least two (2) projects demonstrating experience with construction of concrete structures involving formwork over 4 feet high.
3) Offeror must have at least two (2) projects demonstrating experience with fabricating steel structures weighing more than 1000 pounds.
All information submitted must be accurate and complete. Project examples provided must be substantially complete. Substantially complete as defined for this solicitation is when the project is sufficient for the use of which it is intended, as of the closing date of this solicitation.
All project examples shall contain a Point of Contact (POC) as well as one alternate Point of
Contact, to include the name, job title of the POC, address, telephone, and e-mail address. The
POC and alternate shall be familiar with the scope and details of the project and be a representative of the owner/customer/prime contractor, not affiliated with the Offeror. The POC and alternate shall be able to verify the experience cited.
The Government will evaluate Subfactor 2.2: Experience on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-3. Offerors who are determined “Unacceptable” will not be eligible for award.
Table C-3. Subfactor 2.2: Experience Evaluation Ratings
Rating Description
ACCEPTABLE Offerors (in combination with experience of their JV partners or committed key subcontractors) who provide the required number of examples of experience for the features of work described in the experience subfactor within ten (10) years of the solicitation issuance date will be determined to meet the minimum requirements of the contract and will be found
Acceptable.
UNACCEPTABLE Offerors (in combination with the experience of their JV partners or committed key subcontractors) failing to provide the required number of examples of experience for the features of work described in the experience subfactor within ten (10) years of the solicitation issuance date will be found
Unacceptable.
Factor 3: Past Performance
An Offeror’s past performance is a measure of the degree to which an Offeror was successful on previous construction projects. The Government will evaluate the information/performance data provided by Offerors in accordance with FAR 15.305. Evaluations of past performance shall be in accordance with this plan while utilizing the Past Performance Questionnaires (PPQ) and forms in Appendix D, Enclosure 1.
The Offeror shall submit up to five (5) PPQ’s for work performed within the last 10 years for construction projects with a dollar value equal to, or greater than three million dollars. If more than five (5) are submitted, only the five (5) most recent projects will be considered. The forms shall identify whether the contract is active or complete, whether the contract was with a
Government (federal, state, local, etc) or a commercial entity, and whether the Offeror was the prime contractor, a subcontractor, or member of a joint venture. The PPQ respondent must have been a client, or client representative, with whom the Offeror/subcontractor had a contract, or subcontract (if applicable) for one or more projects.
The PPQ respondent must hold, or have held at the time, a senior position in the client organization with responsibilities for either contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror’s performance in executing the contract or subcontract. The PPQ respondent must have first-hand knowledge of the Offeror’s performance.
In addition to the above, past performance information may be obtained from established systems such as the Contractor Performance Assessment Reporting System (CPARS), Federal
Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract
Reporting System (eSRS), or other databases; and may be obtained from other sources available to the Government, such as the Defense Contract Management Agency; and interviews with
Program Managers, Contracting Officers, and Fee Determining Officials.
The Government reserves the right to evaluate the past performance of any team member in the
Offeror’s proposal using all CAGE/DUNS numbers (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified as part of its assessment of the acceptability of that Offeror’s proposal.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
The Government will evaluate the Past Performance factor on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-4. Offerors who are determined “Unacceptable” will not be eligible for award.
Table C-4. Past Performance Evaluation Ratings
Rating Description
ACCEPTABLE Offerors whose past performance information demonstrates all of the elements being rated at satisfactory or above, or whose performance record is unknown (see note below), will be rated Acceptable for Past Performance.
UNACCEPTABLE Offerors whose past performance information demonstrates any of the element being rated as marginal or lower will be rated Unacceptable for Past Performance.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

However, acceptance of an alternative proposal is a unilateral decision made solely at the discretion of the Government. CERTIFIED COST OR PRICING DATA (JAN 2023)
(a) Definitions. As used in this provision--
Market prices means current prices that are established in the course of ordinary trade between buyers and sellers free to bargain and that can be substantiated through competition or from sources independent of the offerors.
Non-Government sales means sales of the supplies or services to non-Governmental entities for purposes other than governmental purposes.
Relevant sales data means information provided by an offeror on sales of the same or similar items that can be used to establish price reasonableness taking into consideration the age, volume, and nature of the transactions (including any related discounts, refunds, rebates, offsets, or other adjustments).
Sufficient non-Government sales means relevant sales data that reflects market pricing and contains enough information to make adjustments covered by FAR 15.404-1(b)(2)(ii)(B).
Uncertified cost data means the subset of ``data other than certified cost or pricing data'' (see FAR 2.101) that relates to cost.
(b) Exceptions from certified cost or pricing data.
(1) In lieu of submitting certified cost or pricing data, the Offeror may submit a written request for exception by submitting the information described in paragraphs (b)(1)(i) and (ii) of this provision. The Contracting Officer may require additional supporting information, but only to the extent necessary to determine whether an exception should be granted and whether the price is fair and reasonable.
(i) Exception for prices set by law or regulation--Identification of the law or regulation establishing the prices offered. If the prices are controlled under law by periodic rulings, reviews, or similar actions of a governmental body, attach a copy of the controlling document, unless it was previously submitted to the contracting office.
(ii) Commercial product or commercial service exception. For a commercial product or commercial service exception, the Offeror shall submit, at a minimum, information that is adequate for evaluating the reasonableness of the price for this acquisition, including prices at which the same product or service or similar products or services have been sold in the commercial market. Such information shall include--
(A) For products or services previously determined to be commercial, the contract number and military department, defense agency, or other DoD component that rendered such determination, and if available, a Government point of contact;
(B) For items priced based on a catalog--
(1) A copy of or identification of the Offeror's current catalog showing the price for that item; and
(2) If the catalog pricing provided with this proposal is not consistent with all relevant sales data, a detailed description of differences or inconsistencies between or among the relevant sales data, the proposed price, and the catalog price (including any related discounts, refunds, rebates, offsets, or other adjustments);
(C) For items priced based on market pricing, a description of the nature of the commercial market, the methodology used to establish a market price, and all relevant sales data. The description shall be adequate to permit the DoD to verify the accuracy of the description;
(D) For items included on an active Federal Supply Service Multiple Award Schedule contract, proof that an exception has been granted for the schedule item; or
(E) For items provided by nontraditional defense contractors, a statement that the entity is not currently performing and has not performed, for at least the 1-year period preceding the solicitation of sources by DoD for the procurement or transaction, any contract or subcontract for DoD that is subject to full coverage under the cost accounting standards prescribed pursuant to 41 U.S.C. 1502 and the regulations implementing such section.
(2) The Offeror grants the Contracting Officer or an authorized representative the right to examine, at any time before award, books, records, documents, or other directly pertinent records to verify any request for an exception under this provision, and to determine the reasonableness of price.
(c) Requirements for certified cost or pricing data. If the Offeror is not granted an exception from the requirement to submit certified cost or pricing data, the following applies:
(1) The Offeror shall prepare and submit certified cost or pricing data and supporting attachments in accordance with the instructions contained in Table 15-2 of FAR 15.408, which is incorporated by reference with the same force and effect as though it were inserted here in full text. The instructions in Table 15-2 are incorporated as a mandatory format to be used in any resultant contract, unless the Contracting Officer and the Offeror agree to a different format and change this provision to use Alternate I.
(2) As soon as practicable after agreement on price, but before contract award (except for unpriced actions such as letter contracts), the Offeror shall submit a Certificate of Current Cost or Pricing Data, as prescribed by FAR 15.406-2.
(3) The Offeror is responsible for determining whether a subcontractor qualifies for an exception from the requirement for submission of certified cost or pricing data on the basis of adequate price competition, i.e., two or more responsible offerors, competing independently, submit priced offers that satisfy the Government's expressed requirement in accordance with FAR 15.403-1(c)(1)(i).
(d) Requirements for data other than certified cost or pricing data. (1) Data other than certified cost or pricing data submitted in accordance with this provision shall include the minimum information necessary to permit a determination that the proposed price is fair and reasonable, to include the requirements in DFARS 215.402(a)(i) and 215.404-1(b).
(2) In cases in which uncertified cost data is required, the information shall be provided in the form in which it is regularly maintained by the Offeror or prospective subcontractor in its business operations.
(3) Within 10 days of a written request from the Contracting Officer for additional information to permit an adequate evaluation of the proposed price in accordance with FAR 15.403-3, the Offeror shall provide either the requested information, or a written explanation for the inability to fully comply.
(4) Subcontract price evaluation. (i) Offerors shall obtain from subcontractors the minimum information necessary to support a determination of price reasonableness, as described in FAR part 15 and DFARS part 215.
(ii) No cost data may be required from a prospective subcontractor in any case in which there are sufficient non- Government sales of the same item to establish reasonableness of price.
(iii) If the Offeror relies on relevant sales data for similar items to determine the price is reasonable, the Offeror shall obtain only that technical information necessary--
(A) To support the conclusion that items are technically similar; and
(B) To explain any technical differences that account for variances between the proposed prices and the sales data presented.
(e) Subcontracts. The Offeror shall insert the substance of this provision, including this paragraph (e), in subcontracts exceeding the simplified acquisition threshold defined in FAR part 2. The Offeror shall require prospective subcontractors to adhere to the requirements of--
