1.2 SUBMITTALS

Government approval is required for submittals with a "G" designation;

1.3 ADDITIONAL COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK

In addition to the requirements of FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK, comply with the following requirements:

a. Work schedule is Monday through Friday 7:30am to 4:00pm as coordinated with and approved by the Contracting Officer, or as indicated. Federal holiday and weekend work will not commence unless approved.

b. Completing the work inside the control tower to tentatively commence at 7:30am on 1 August 2019, and be completed by 4:00pm on 14 January 2020. The actual start date will be determined at the Progress Meeting, refer to paragraph PROGRESS MEETINGS, depending on the lake elevation and required outflows at that time. Prepare to initiate work within 2 calendar days after notification by the Contracting Officer.

c. After completion of repairs in one gate culvert bay, presume a delay of 7 days for the Government to increase outflow and reduce the lake elevation prior to initiating repairs in the next gate culvert bay.

The Government will compensate the Contractor with additional days if the delay is longer than 7 days.

d. Bulkheads cannot safely be removed when the pool exceeds El. 841 feet (1929 datum, approximate low elevation of the access bridge).

Therefore, if the pool forecast is to exceed El. 841 feet (1929 datum) with outflows in excess of 6,000 cfs required, cease work and remove bulkheads. Monitor water conditions at the dam. Daily conditions can be obtained by contacting the USACE Rock Island District Water Control Section, refer to paragraph COORDINATION WITH OTHERS for contact information or obtain information from https://www.rivergages.com. The Saylorville Lake pool and outflow forecast is updated daily and can be found at:

e. The release of water through the two service gates in operation will be controlled by the Reservoir Manager. Maintain a minimum of 200 cfs outflow through one of the service gates. The Contractor will have to contend with a minimum of 200 cfs in the conduit during the working period.

f. Refer to ATTACHMENT A - Pool Elevation Duration Curves and ATTACHMENT B

- Outflow Percentiles. Discharges through the dam range from 200 cfs to 16,000 cfs with outflows as high as 21,000 cfs during flood events.

g. Secure and keep unauthorized persons out of all work sites with signing, fencing, or by other approved means.

h. Work Area Requirements

(1) Radios and similar devices that can be heard outside the Contractor's work area are prohibited within that area(s).

(2) Remove dust and debris from the work areas daily.

(3) Complete work that generates noise above the exposure limits, as specified in USACE EM 385-1-1, outside the building or during non-business hours. Schedule this work with the Contracting Officer in advance.

i. Gate hoist machinery may be disassembled for removal and reassembled after work is completed. Three gates must remain fully operational for the duration of the Contract.

j. Control Tower Bridge Structural Analysis (2021): The Control Tower Bridge(s) may be used as a work platform to support construction activities. If either of the bridge(s) are used, prior to beginning work, submit a structural analysis of the existing bridge and supports to verify adequacy of the bridge to support the specific Contractor means and methods proposed to perform the work. The structural analysis must be performed and stamped by a Licensed Professional Engineer in the State of Iowa. For reference, the Control Tower Service Bridge drawings indicate the bridge was designed for HS 15-44 loading, but the original structural calculations are no longer available. The Control Tower Trashrack Bridge drawings indicate the bridge was designed for HS-20 loading, but the original structural calculations are no longer available. The bridge drawings are included in the reference drawing plan set.

k. The upstream stoplogs will be furnished by the Government. The Contractor is responsible to place and remove them. There will be a pre-use, post-use pre-final, and post-use final joint inspection of the stoplogs by the Contractor and Contracting Officer. After the pre-joint inspection, the Contractor and Contracting Officer will perform a post-use pre-final joint inspection after the last day of stoplog use, prior to returning the stoplogs, to evaluate the condition of the stoplogs. Any damage incurred, above normal wear and tear from Contractor use must be repaired by the Contractor, at the direction of the Contracting Officer, and at no additional cost to the Government, within 60 calendar days of final use and prior to returning the stoplogs to storage. The Contractor and Contracting Officer will perform a post-use final inspection once the stoplogs have been returned to storage. Coordinate with the Contracting Officer for the handover and return of the stoplogs.

l. Perform a full-assembly test-fit installation rehearsal of the upstream stoplogs at each of the stoplog recesses a minimum of 14 calendar days prior to any dewatering activities to become accustomed with the provided system and identify any potential performance issues. Ensure that stoplog recesses are clear and the slot sill free of any obstructions prior to installation. Remove all stoplogs after rehearsal.

m. The U.S. Army Corps of Engineers, Rock Island District can provide outflow restrictions from Saylorville Lake as requested by the Contractor to assist with the required contract work. Outflow restrictions can be provided from 01 November to 01 June when the lake is at or below conservation pool, and El. 836 feet NGVD 1929, and there

DOCUMENT 00 73 05 Page 5 are acceptable inflows into the lake as determined by the Rock Island District. During this time, a temporary complete shutdown of outflows from the lake can be provided for 12 hours per day or a maximum of 48 hours and an outflow restriction of 200 cubic feet per second (cfs) can be provided until the conduit mobilization, dewatering work, and demobilization has been completed. Coordinate the number and dates of requested outflow restrictions with the Rock Island District, Water Control Section, through the Contracting Officer. Contact the Contracting Officer a minimum of 7 calendar days prior to the outflow restrictions being provided.

1.3.1 Inspections

The Government may choose to hire a third party inspector to perform verification of any work. The Government's third party inspection will occur at various times throughout the duration of the project. The Contractor will be advised that third party inspection must be coordinated with the Contracting Officer, and the Contractor for all verification inspections selected by the Government.

1.4 UNANTICIPATED HAZARDOUS MATERIAL

If a hazardous material(s) is encountered where it was not indicated, cease work and immediately notify the Contracting Officer of the located potential hazardous material(s) found. Upon direction from the Contracting Officer, it may be required to conduct sampling and testing of these suspect material(s) in accordance with an Industrial Hygienist's recommended procedures and the Contract Specification Section(s) as applicable that will be provided to the Contractor as a Modification to the Contract, unless already provided. Payment for this additional work will be handled under FAR 52.243-4 CHANGES.

1.5 WORK PLAN

Submit a narrative of the procedures and sequencing proposed for the accomplishment of the work, and should typically follow the proposed timeline of the project schedule as required in Section 01 32 16 CONSTRUCTION PROGRESS SCHEDULES to sequence all work as indicated or specified. Include critical dates in the narrative. Discuss the work plan for each bay separately. Submit the plan 30 days after Notice to Proceed.

Include at a minimum, the following information, including reference to subcontractors who will be performing work associated with that item:

a. Any critical path items and how the Contractor proposes to mitigate risk (i.e., additional shifts);

b. Plans to accommodate long lead time items;

c. Plans for staging and storage areas, and implementation of power usage at the site;

d. Material delivery plans which address routes and bridge restrictions;

e. Detail any work the Contractor is anticipating performing prior to the construction closure period and provisions for maintaining operations in accordance with the Specifications;

The Contractor may be required to submit additional Work Plans as construction progresses and as required by the Contracting Officer.

1.6 COORDINATION WITH OTHERS

Schedule and coordinate operations affecting other Contractors, Government Personnel, utilities, and/or property occurring within the work limits.

Accomplish with lead time sufficient for coordination of all involved parties as necessary for timely completion of each Contract feature. At a minimum, establish coordination with each of the following point(s) of contact, as required:

1.7 ANTITERRORISM (AT) AND OPERATIONS SECURITY (OPSEC)

1.7.1 General Security Requirements and Guidance

The security requirements described apply to Contractor personnel for complying with all security requirements. Address questions regarding security matters to the Contracting Officer. Contractor personnel are critical to the overall security and safety of Government property, and security awareness training contributing to those efforts. The Department of Defense (DoD) and Army security training requirements as specified, if applicable, are performance requirements; all applicable Contractor personnel must complete initial training within 30 days after receiving Notice to Proceed. Within five business days from the completion of training, notify the Contracting Officer. Include documentation of the names of Contractor personnel trained and which training has been completed; maintain training records as part of Contract files and be prepared to provide copies of training certificates to Contracting Officer. Contractor personnel and vehicles are subject to search when entering Federal installations. Additionally, all Contractor personnel must comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (RAMs), and Health Protection Condition (HPCON) measures. Meet all performance requirements during elevated FPCON and/or HPCON levels in accordance with Government installation plans and procedures. This includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by FAR 52.243-4 CHANGES, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes affecting Contractor personnel. Ensure that all Contractor personnel are aware of the security responsibilities, including any site-specific requirements identified in local policies or procedures.

1.7.2 AT Level 1 Training

Contractor personnel requiring routine access to Government installations and controlled access areas or requiring network access must complete initial and annual refresher AT Level I Awareness Training. Submit training certificates. Online AT Level I Awareness Training is available at (website is subject to change):

1.7.3 Suspicious Activity Reporting Training

Contractor personnel must receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides Contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the Contracting Officer.

1.7.4 Formal OPSEC Program

Develop and submit for approval an OPSEC Plan within 90 days after receiving Notice to Proceed. Include a process to identify critical information, the location, who is responsible for the activity, how it will be protected. In accordance with Army and DoD regulations, provide a certified Level II OPSEC coordinator to ensure OPSEC compliance during Contract duration.

1.7.5 Training for Sensitive Information

Contractor personnel with access to critical information (as identified in the OPSEC Program) must complete initial and annual refresher OPSEC Level I Awareness training, which are available at one of the following websites (websites are subject to change):

Contractor personnel with access to Controlled Unclassified Information (CUI) must complete initial and annual refresher CUI training in accordance with applicable Army policy.

1.7.6 E-Verify Program

Comply with FAR 52.222-54 EMPLOYMENT ELIGIBILITY VERIFICATION and Subpart

22.18 to meet the Contract employment eligibility requirements using the Company Enrollment in E-Verify Program at: (website subject to change):

Cooperate with Federal and State agencies responsible for enforcing labor requirements to including eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). Submit an initial list of verified/eligible candidates no later than 3 business days after receiving Notice to Proceed. When Contracts are with individuals, the individuals must complete a Form I-9, Employment Eligibility Verification, and submit as part of the official Contract file.

1.8 ACTIVITY REGULATIONS FOR CONTRACTOR ACCESS AND USE OF PREMISES

Follow all current Army Security Regulations concerning strict visitor control and preservation of all Government assets. Immediately report all security concerns to the Contracting Officer.

Work may be affected by the following Force Protection Conditions levels:

FPCON NORMAL

When there is no discernible terrorist activity. Routine security posture.

FPCON ALPHA

When there is a general threat of possible threat activity against personnel and the installation, or both. There will be a limited impact on normal operations.

FPCON BRAVO

When there is an increased or more predictable threat. There will be an impact on normal operations but it will not cause undue hardship to personnel, substantially affect operational capabilities, or cause aggravated relations with local authorities and civilians.

FPCON CHARLIE

When an incident occurs or intelligence is received indicating imminent terrorist action. If this lasts for more than a short period it will probably create hardships for personnel and affect the peacetime activities of units and personnel.

FPCON DELTA

When a terrorist attack has occurred or intelligence indicates likely terrorist action against a specific location. This is normally declared as a localized warning and requires implementation of mandatory security measures. This cannot be sustained for an extended period without causing significant hardships for personnel and affecting the peacetime activities of units and personal.

FPCON NORMAL through FPCON BRAVO will not affect the work. FPCON CHARLIE and FPCON DELTA will affect work. FPCON CHARLIE will subject the Contractor to a higher degree of inspection and may not be able to work on-site for short periods of time as decreed by the District Security Officer. FPCON DELTA, as determined by the District Security Officer, will close the site down and the Contractor will not be able to work on the site.

1.9 SUSTAINABILITY

a. Meet USEPA recycled content requirements. Ensure all Contractor-furnished supplies contain recycled content (e.g., insulation, restroom dividers, roofing materials). The list of USEPA-Designated Recovered Material Products is available online at:

b. Meet USDA BioPreferred Program requirements. Ensure all Contractor-furnished supplies contain biobased content (e.g., interior wall panels, plastic insulating foam, plastic lumber). The list of USDA-Designated BioPreferred Program Product Categories is available online at:

c. Use energy- and water-efficient building-related products and equipment as applicable. Ensure all Contractor-furnished equipment meets energy efficiency requirements (e.g., light fixtures, gas water heaters, central air conditioners, windows, doors), and water efficient requirements (e.g., faucets, showerheads, toilets) (when applicable to the work to be performed). d. Print all deliverables double-sided on paper that contains post-consumer fiber.

1.10 MINIMUM AMOUNT OF INSURANCE REQUIRED

a. Provide in accordance with FAR 52.228-5 INSURANCE - WORK ON A GOVERNMENT INSTALLATION and procure not less than the following types of insurance in the amount specified:

b. Provide insurance certificate with the following endorsement:

Cancellation or any material change in the policies adversely affecting the interests of the Government in such insurance will not be effective for such period as may be prescribed by the laws of the state in which the Contract is performed and in no event less than 30 days after written notice to the Contracting Officer.

c. Annotate insurance certificates with the Contract number and name.

1.11 CONDITION OF EXISTING STRUCTURES, ROADWAYS, AND OTHER FACILITIES

a. Pre-Construction Condition Survey - Prior to commencement of operations by the Contractor, make a detailed survey of all existing structures, Contractor staging and parking areas, roadways, and other facilities that may be affected by the Contractor's operations. Conduct the survey with the Contractor, Area Facility Operations Specialist, and the Contracting Officer and obtain signatures from all parties. Survey sufficiently in scope to provide advance agreement among all concerned as to the condition of the existing structures, Contractor staging and parking areas, roadways, and other facilities. Presume responsibility for full and active participation in such pre-construction condition survey of existing structures, Contractor staging and parking areas, DOCUMENT 00 73 05 Page 10 roadways, and other facilities as deemed necessary to permit determination and accurate assessment of any subsequent damage to existing structures, Contractor staging and parking areas, roadways, and other facilities which may be incurred during the Contract.

b. Post-Construction Condition Survey - After completion of the work, and prior to final acceptance of the work, make a detailed post-construction condition survey of the same structures, Contractor staging and parking areas, roadways, and other facilities previously surveyed with the Contractor, Area Facility Operations Specialist, and the Contracting Officer and obtain signatures from all parties. Survey sufficiently in scope to provide for agreement among all concerned as to the post-project condition of the existing structures, Contractor staging and parking areas, roadways, and other facilities. Presume responsibility for full and active participation in such post-construction condition survey as deemed necessary to permit determination and accurate assessment of any damage to existing structures, Contractor staging and parking areas, roadways, and other facilities which have been incurred during the Contract.

c. Include, but do not limit the surveys to, photographs, videos, sketches, and written descriptions. Submit all documentation to each party involved.

d. If it is determined by the post-construction condition survey that damage has occurred to structures, Contractor staging and parking areas, roadways, and other facilities, then repair such damage to a condition equal to the pre-Contract conditions, as approved by the Contracting Officer, at the Contractor's expense.

1.12 CONDITION OF EXISTING STRUCTURES, ROADWAYS, LEVEES, AND OTHER

FACILITIES (2021)

In addition to the Main Contract Requirements, record the elevation of the top of foundation walls, finish floor elevations, possible conflicting electrical conduits, plumbing lines, alarms systems, the location and extent of existing cracks and other damage and description of surface conditions that exist before starting work. Verify and document all required outages which will be required during the course of work, and note these outages on the record document.

a. Civil Engineering Calculations and Measurements

(1) Engineering analysis revealed:

(a) The weight of each roof deck member to be removed is approximated to be 650 lbs.

(b) The weight of each drum is approximated to be 5,000 lbs.

(c) The weight of each steel frame supporting gate hoist machinery is approximated to be 8,300 lbs.

(d) The weight of each complete gate hoist machinery assembly is approximated to be 20,000 lbs.

(e) The weight of each complete gate hoist sheave assembly is approximated to be 1,100 lbs.

(f) The weight of each gate hoist wire rope is approximated to be 1,008 lbs.

(g) The weight of each complete tractor gate is approximated to be 58,900 lbs.

(2) The original design plans show:

(a) The dimensions of an entire roof panel are 11'-8" x 12'-9".

(b) The opening for the overhead garage door is 10' x 10'.

(c) The height from the bridge deck to the roof parapet is 20 feet.

(d) The dimensions of the operating floor are 53' x 30'.

(e) The floor height for the operations floor is 13 feet.

(f) The horizontal distance from the overhead doors to the wire rope drum of the emergency gate is approximated to be 23 feet.

(3) Field measurements revealed:

(a) The clear width of the control tower bridge was measured to be

11.5 feet.

(b) Asphalt parking area below the dam is approximately 0.30 acres.

(c) The pull-off lanes on the dam road are approximately 0.1 acres each in size.

1.13 U.S. ARMY CORPS OF ENGINEERS SAFETY AND HEALTH MANUAL (EM 385-1-1)

The Government Safety Manual, EM 385-1-1 (including all interim changes) will be followed and effective on the date of award. EM 385-1-1 is at the following website:

1.14 EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE

a. This special Contract requirement does not apply to terminations. See EP 1110-1-8 and FAR Part 49 TERMINATION OF CONTRACTS.

b. The base allowable cost for construction and equipment in sound workable condition, furnished by a Contractor or subcontractor at any tier on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the Contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the Contractor's accounting records, base costs for that equipment upon the applicable provisions of EP 1110-1-8, Region V.

Consider working conditions as average for determining equipment rates using the schedule unless specified otherwise by the Contracting Officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations applies. For

DOCUMENT 00 73 05 Page 12 retroactive pricing, the schedule in effect at the time the work was performed applies.

c. Equipment rental costs are allowable, subject to the provisions of FAR 31.105 CONSTRUCTION AND ARCHITECT-ENGINEER CONTRACTS, paragraph (d)(ii) and FAR 31.205-36 RENTAL COSTS. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.

d. When actual equipment costs are proposed and the total amount of the pricing action exceeds the Simplified Acquisition Threshold (SAT), the Contracting Officer will request a submission of either certified cost or pricing data, or partial/limited data, as appropriate. Submit data on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

1.15 PROGRESS MEETINGS

a. Attend progress meetings as scheduled by the Government with an agenda prepared by the Contractor. The list of attendees includes, but is not limited to, the Contractor's key site personnel, supervisor(s)/superintendent(s), safety person(s), quality control manager(s), and subcontractors' representative(s).

b. Address and discuss such items as progress of the work, potential factors for delays, proposed daily work schedule for the next period, deficiencies, utility service interruptions, protection of adjacent areas, coordination with other Contractors and Government hired labor, materials delivery schedules, submittals, quality control, and safety issues, and any other issues requiring addressing or discussions.

c. Prepare minutes of the progress meetings and obtain a list of invitees and attendees from all parties. Submit minutes to all parties involved.

1.16 INSPECTION

The presence of a Government inspector does not relieve the Contractor of the responsibility for the proper execution of the work in accordance with the Contract Specifications and Drawings. Furnish, at the request of the Contracting Officer or any inspector:

a. The use of a boat, boatmen, laborers, and material forming a part of the ordinary and usual equipment, and crew of the plant as may be reasonably necessary in inspecting and monitoring the work.

b. Suitable transportation from all points on shore designated by the Contracting Officer to and from the various pieces of plant. Should the Contractor refuse, neglect, or delay compliance with these requirements, the specific facilities may be furnished and maintained by the Contracting Officer and the cost will be deducted from any amounts due, or to become due, to the Contractor.

1.17 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work is specified in FAR 52.236-7 PERMITS AND RESPONSIBILITIES. However, if, in the judgment of the Contracting Officer, any part of the permanent work

DOCUMENT 00 73 05 Page 13 performed or completed by the Contractor is damaged by flood, earthquake, or another natural disaster in which damage is not due to the failure of the Contractor and will take reasonable precautions or exercise sound engineering and construction practices to make the repairs as directed by the Contracting Officer, and full compensation for such repairs will be made at the applicable Contract unit or job price as fixed and established in the Contract. Also, if any damage to the permanent work is caused by users of the recreational facilities, the provisions as specified for flood or earthquake will apply, providing the Contractor complies with required construction protection areas instructions as specified. If, in the opinion of the Contracting Officer, Contract unit or job prices are not applicable to any part of scheduled work, an equitable adjustment pursuant to FAR 52.243-4 CHANGES will be made as full compensation for the repairs of that part of the permanent work. Except as provided, repair damage to all work (including temporary construction), utilities, materials, equipment, and plant to the satisfaction of the Contracting Officer at no additional cost to the Government, regardless of the cause of such damage.

1.18 SPECIAL SAFETY REQUIREMENTS

Remove any employee of the Contractor's who disregards safety regulations or displays unsafe attitudes and actions from the job site, as directed by the Contracting Officer, and in accordance with EM 385-1-1.

When working over or near water, be in accordance with 29 CFR 1926.106, Section 19.A.07(i).

a. Provide employees working over or near water, where the danger of drowning exists, with U.S. Coast Guard approved life jackets or buoyant work vests.

b. Prior to and after each use, inspect buoyant work vests or life preservers for defects which would alter their strength or buoyancy.

Do not use defective units.

c. Furnish ring buoys in accordance with EM 385-1-1 and refer to Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS, paragraph LIFESAVING AND

SAFETY SKIFFS.

d. Provide at least one lifesaving skiff immediately available at a location where employees are working over or near water. Refer to Section 01 35 26 GOVERNMENTAL SAFETY REQUIREMENTS, paragraph LIFESAVING

AND SAFETY SKIFFS.

When operating mechanized equipment on a floating plant, provide positive and acceptable means of preventing this equipment from moving or falling into the water. The type of equipment addressed by this clause includes front end-loaders, bulldozers, trucks (both on- and off-road), backhoes, track hoes, and similar equipment. If the Contractor intends to use such equipment on floating plant, then develop an Activity Hazard Analysis (AHA) for this feature of work. Include a detailed explanation of the type or types of physical barriers, curbs, structures, facilities, to be incorporated to protect the operator and prevent the equipment from entering the water. Nonstructural warning devices may be considered for situations where the use of structural barriers are impracticable.

Thoroughly address the procedure and submit the AHA to the Government prior to commencing work.

1.19 LOCATION OF PARKING, STAGING, AND STORAGE AREAS

The Contractor's parking, staging, and storage areas are as indicated or as coordinated and approved by the Contracting Officer.

1.20 UNDERGROUND UTILITY LINES (2021)

The utility lines are owned by U.S. Army Corps of Engineers, Saylorville Lake Reservoir. Prior to any ground breaking, coordinate with the Contracting Officer for locating the underground utility lines.

If required, obtain digging permits prior to start of any excavation, and comply with utility locating and marking underground utilities. Submit a utility locating plan detailing the means and methods to locating all existing utilities. Contact the Contracting Officer and the local utility locating service a minimum of 48 hours prior to excavating, to mark utilities, and within sufficient time required if work occurs on a Monday or after a Holiday.

Identify and mark all other utilities not managed and located by the local utility companies. Scan the construction site with Ground Penetrating Radar (GPR), electromagnetic, or sonic equipment, and mark the surface of the ground or paved surface where existing underground utilities are discovered. Verify the elevations of existing piping, utilities,and any type of underground obstruction not indicated, or specified to be removed, that is indicated or discovered during scanning, in locations to be traversed by piping and other work to be conducted or installed.

1.21 BARRICADES AND WARNING SIGNS

Provide and maintain barricades, danger and warning signs, and, if applicable, suitable and efficient lighting at all points of entry to the area(s) that will be closed to public travel or access. Separate payment will not be made for any costs incurred for furnishing barricade and warning signs. Costs will be considered as a subsidiary obligation and included in the mobilization costs.

1.22 ONE CALL SYSTEM FOR EXCAVATORS

One call systems, established by law, are operated by owners of underground utilities for excavators. Upon notification by an excavator through a one call system, all participating operators of underground utilities in a covered area will identify and locate utilities. Use of a ground penetrating radar or services of a utility locating company is acceptable to the Government. Identify One Call system by contacting:

1.23 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER

a. Provision ER 415-1-15 specifies the procedure for determination of time extensions for unusually severe weather in accordance with FAR

52.249-10 DEFAULT (FIXED-PRICE CONSTRUCTION). In order for the Contracting Officer to award a time extension, the following must occur:

(1) The weather experienced at the project site during the Contract period was found unusually severe, that is, more severe than the adverse weather anticipated for the project location during any given month.

(2) The unusually severe weather must actually cause a delay to the completion of the project. The delay is beyond the control and without the fault or negligence of the Contractor.

b. The following schedule of monthly anticipated adverse weather delays is based on National Weather Service Climatological Data for the project location and constitutes the base line for monthly weather time evaluations. The Contractor's progress schedule must include reflecting these anticipated adverse weather delays in all weather dependent activities.

Upon receiving the Notice to Proceed (NTP) and continuing throughout the Contract, record on the daily Contractor's quality control report, the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. The number of actual adverse weather delay days are to include days impacted by actual adverse weather (even if adverse weather occurred in the previous month), be calculated chronologically from the first to the last day of each month, and recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in list item b., the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with FAR 52.249-10 DEFAULT (FIXED-PRICE

CONSTRUCTION).

1.25 DELAYS DUE TO HIGH WATER

Upon mobilization and continuing throughout the Contract, record on the daily CQC report, the high water level elevation at the site and any resultant impact to normally scheduled Contract work or specify specifics.

The Contract period will be extended by the number of calendar days that water levels prevent such work. The Government will not reimburse the Contractor for standby costs associated with delays caused by high water levels. Delays caused by high water levels will not be the basis for an adjustment in Contract price. Refer to paragraph ADDITIONAL PHYSICAL DATA CLAUSE INFORMATION, Historic River Level Data for the Duration Curves.

Accurately interpret gages and duration curves.

1.26 HIGH WATER ACTION PLAN

Provide a plan detailing the activities to minimize the adverse effects of high water. Include protection of accomplished work and Contractor's equipment and personnel. Include emergency measures to restore any damaged sections of the project. Emergency measures to provide sound engineering

DOCUMENT 00 73 05 Page 17 methods that provides protection at or greater than the height of the existing feature, should high water occur. Stoplogs cannot be safely removed when pool elevation exceeds El. 840 feet (1929 datum). Therefore, if the pool forecast is to exceed El. 840 feet (1929 datum), cease work and remove stoplogs. Provide a system to prevent ice from forming on the stoplogs.

1.27 IOWA SALES AND USE TAX EXEMPTION CERTIFICATE

Materials physically incorporated into real estate projects property are exempt from Iowa Sales and Use Taxes. However, sales of tools, fuel, lumber for forms and other end use or consumption items which are not physically incorporated into real estate are taxable sales. After receiving the Notice to Proceed, the Contractor may request the Government Sales Tax Exemption Number.

1.28 PROCESSING DAVIS-BACON ACT CERTIFIED LABOR PAYROLLS

This is an option, to the Contractor, to use a commercially available electronic system to process and submit certified payrolls electronically to the Government. The requirements for preparing, processing, and providing certified labor payrolls are established by the Davis-Bacon Act as stated in FAR 52.222-8 PAYROLLS AND BASIC RECORDS and FAR 52.222-13

COMPLIANCE WITH CONSTRUCTION WAGE RATE REQUIREMENTS AND RELATED REGULATIONS.

If the Contractor elects to use an electronic Davis-Bacon payroll processing system, the Contractor will be responsible for obtaining and providing for all access, licenses, and other services required to provide for receipt, processing, certifying, electronically transmitting to the Government, and storing weekly payrolls and other data required for the Contractor to comply with Davis-Bacon and related Act regulations. When the Contractor uses an electronic Davis-Bacon payroll system, ensure that the electronic payroll service prepares, processes, and maintains the relevant payrolls and basic records during all work and is capable of preserving these payrolls and related basic records for the required 3 years after Contract completion. If the Contractor chooses to use an electronic Davis-Bacon payroll system, then obtain and provide electronic system access to the Government, as required in accordance with the Davis-Bacon and related Act regulations over the Contract duration.

Include electronic review access by the Government Contract administration office to the electronic payroll processing system used by the Contractor.

Ensure that the Contractor's provision and use of an electronic payroll processing system meets the following basic functional criteria:

commercially available; compliant with appropriate Davis-Bacon Act payroll provisions in the FAR; able to accommodate the required numbers of employees and subcontractors planned to be employed; capable of producing an Excel spreadsheet-compatible electronic output of weekly payroll records (format at http://rmssupport.helpserve.com/) for export in an Excel spreadsheet to be imported into RESIDENT MANAGEMENT SYSTEM (RMS-CM), that in turn exports payroll data to the RESIDENT MANAGEMENT SYSTEM (RMS-GM);

demonstrated security of data and data entry rights; ability to produce Contractor-certified electronic versions of weekly payroll data; ability to identify erroneous entries and track the data/time of all versions of the certified Davis-Bacon payrolls submitted to the Government over the life of the Contract; placed on a CD or DVD and provide a PDF file record of data from the system database at end of the Contract closeout. Submit data from the electronic Davis-Bacon payroll processing system as a Closeout Submittal.

Include all Contractor-incurred costs related to the Contractor's provision and use of an electronic payroll processing service in the Contractor's price for the overall work under this Contract. The costs for Davis-Bacon Act compliance using electronic payroll processing services are not a separately bid, proposed, or reimbursed item under this Contract.

1.29 AVAILABILITY AND USE OF UTILITY SERVICES

The Government will not make any utility or facility services available to the Contractor. Provide utility services and maintain within the construction area a minimum field-type sanitary facility as approved.

1.30 SIGNAL LIGHTS

Display signal lights and conduct operations in accordance with US Coast Guard regulations (Commandant Instruction M16672.2 Series) and EM 385-1-1 on watercraft and floating plant(s).

The work includes, but is not limited to: lead abatement, roof replacement, fabrication and installation of steel sluice gates, replacing the existing sills with brass sills, fabrication of stainless steel roller track bars, fabrication of stainless steel seal bars, refurbishing of wire drums and motors, replacement of gate hoist machinery, wire rope, drum roller bearing cartridges, limit switches, brakes, sheaves/sheave bushings, cable slack switch, electrical work, and site restoration.

1.1.2 Option A - East Bays

The work includes, but is not limited to: replacing the entirety of the emergency/service gate's existing bolted steel seal bars and roller track bars with Base Bid materials, and preparation of the existing embedded ductile cast iron conduit liner to accept the new materials. Base preparation includes, but is not limited to: burning, cutting, drilling, filling, grinding, plugging, removing, sanding, and tapping of existing countersunk screws and ductile cast iron conduit liner with approved materials to produce a flat bearing surface for the new stainless steel plate materials.
