SOURCE SELECTION
A. BASIS FOR AWARD
This acquisition is a full and open, competitive procurement utilizing Lowest
Price Technically Acceptable (LPTA) best value continuum source selection procedures in accordance with FAR 15.101-2.
A single award will be made to the Offeror who provides a technically acceptable proposal with the lowest evaluated price.
Proposed prices will be evaluated but not scored or otherwise combined with the other aspects of the proposal evaluation.
B. FACTORS TO BE EVALUATED
Factor 1: Price
Factor 2: Technical
Factor 3: Past Performance
C. EVALUATION APPROACH
All proposals will be evaluated by the Source Selection Team (SST). In order for any offeror to be considered for award, the proposal must receive an
“Acceptable” rating in every non-price factor. The two non-price factors are
Technical and Past Performance.
Factor 1: Price
Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. An award will be made to the lowest priced, technically acceptable proposal. The lowest price will be determined by adding up all listed line items. Offerors shall complete and submit the Schedule of Prices with its proposal and include a price for each line item. Failure to submit a price for any of the required line items on the Schedule of Prices will render the Offeror’s proposal as ineligible for award. Offerors will be allowed one proposal submission.
The Source Selection Evaluation Board will evaluate each Offeror’s price and verify that unbalanced pricing is not present. The Contracting Officer will evaluate each Offeror’s price in accordance with FAR 15.404-1 to determine price reasonableness. Price reasonableness will be determined by comparing all proposed prices, the Independent Government Estimate, and pricing of previous work that is equivalent or similar to the requirement.
The otherwise technically acceptable lowest priced Offeror may be required to confirm/validate their offered price. Certified cost and pricing data are not currently required; however, the
Government reserves the right to request such data prior to award.
Factor 2: Technical
The Government will evaluate the Technical Proposal on an Acceptable/Unacceptable basis.
This factor identifies the minimum requirements that are imperative to successful contract performance.
The Source Selection Team will evaluate the Offeror’s proposal against the factors listed below to determine whether the technical proposal is Acceptable or Unacceptable. To be considered acceptable, all factors under the technical proposal must receive an acceptable rating. The adjectival rating depicts whether or not the offeror’s proposal meets the Technical Proposal factor requirements.
Table C-1
Technical Proposal
Acceptable/Unacceptable Ratings
Rating Description
ACCEPTABLE Proposal meets the minimum requirements of the solicitation.
UNACCEPTABLE Proposal does not meet the minimum requirements of the solicitation.
Subfactor 1: Schedule
Technical Subfactor 1 evaluates the Offeror’s proposed schedule for the construction contract.
The Government will evaluate the Offeror’s proposed schedule to determine understanding of and compliance with the Government’s requirements.
Minimum requirements for this factor include a preliminary bar chart schedule showing the following activities, for each site as applicable, as outlined in Specification Section 01 14 00, WORK RESTRICTIONS:
a. Survey of existing lock components
b. Fabrication and delivery of traveling bitt
c. Upstream guidewall kevel rail replacement
d. Upstream guide wall checkpost removal
e. Upstream guide wall checkpost replacement
f. Downstream guide wall checkpost replacement
g. Downstream guide wall resurfacing
h. Horizontal resurfacing of the lock wall
i. Vertical joint repairs on both walls
j. Electrical repairs
k. Commissioning
l. Curing of concrete
The Government will evaluate the schedule based on demonstration of all activities listed above being complete by the end of the lock closure period.
The Government will evaluate Subfactor 1: Schedule on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-2. Offerors who are determined “Unacceptable” will not be eligible for award.
Table C-2. Subfactor 1: Schedule Evaluation Ratings
Rating Description
ACCEPTABLE The proposed Schedule includes all required activities and sequences, and shows completion of all activities by the end of the closure period. Based on the Schedule proposed by the
Offeror, the Government has a reasonable expectation that the
Offeror will successfully perform the required effort
UNACCEPTABLE The proposed Schedule does not include all required activities and/or sequences, or does not show completion of all activities by the end of the closure period. Based on the
Schedule proposed by the Offeror, the Government does not have a reasonable expectation that the Offeror will successfully perform the required effort.
Subfactor 2: Experience
The Government will evaluate relevant experience of the Offeror, and/or committed sub-contractor. Relevant experience is what an Offeror, Joint Venture (JV), and/or committed sub-contractor(s), has done on past projects.
The Offeror shall submit a minimum of two (2) projects within the last ten (10) years which demonstrate experience in the following key features of work:
1) Offeror or subcontractor must have at least one (1) project demonstrating experience with working on a lock or dam structure.
2) Offeror or subcontractor must have at least two (2) projects demonstrating experience with construction of concrete structures involving formwork over 4 feet high.
3) Offeror or subcontractor must have at least two (2) projects demonstrating experience with fabricating steel structures weighing more than 1000 pounds.
All information submitted must be accurate and complete. Project examples provided must be substantially complete. Substantially complete as defined for this solicitation is when the project is sufficient for the use of which it is intended, as of the closing date of this solicitation.
All project examples shall contain a Point of Contact (POC) as well as one alternate Point of
Contact, to include the name, job title of the POC, address, telephone, and e-mail address. The
POC and alternate shall be familiar with the scope and details of the project, and be a representative of the owner/customer/prime contractor, not affiliated with the Offeror. The POC and alternate shall be able to verify the experience cited.
For the purpose of this requirement, projects completed by a subcontractor cannot be submitted as relevant prior experience unless that subcontractor is expected to perform ten (10%) percent or more of the proposed effort.
For the purpose of this requirement, projects completed by a joint venture cannot be submitted as relevant prior experience unless that joint venture is expected to perform thirty-three (33%) percent or more of the proposed effort.
The Government will evaluate Subfactor 2: Experience on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-3. Offerors who are determined “Unacceptable” will not be eligible for award.
Table C-3. Subfactor 2: Experience Evaluation Ratings
ACCEPTABLE Offerors (in combination with experience of their JV partners or committed key subcontractors) who provide examples of experience with the key features of work described in the experience subfactor within the past ten (10) years will be determined to meet the minimum requirements of the contract and will be found Acceptable.
UNACCEPTABLE Offerors (in combination with the experience of their JV partners or committed key subcontractors) failing to provide examples of experience with the key features of work described in the experience subfactor within the past ten (10) years will be found Unacceptable.
Factor 3: Past Performance
An Offeror’s past performance is a measure of the degree to which an Offeror was successful on previous construction projects. The Government will evaluate the information/performance data provided by Offerors. Evaluations of past performance shall be in accordance with this plan while utilizing the Past Performance Questionnaires (PPQ) and forms in Appendix D, Enclosure
1.
The Offeror shall submit up to five (5) PPQ’s for work performed since 2010 for construction projects with a dollar value equal to, or greater than three million dollars. If more than five (5) are submitted, only the five (5) most recent projects will be considered. The forms shall identify whether the contract is active or complete, whether the contract was with a Government (federal, state, local, etc) or a commercial entity, and whether the Offeror was the prime contractor, a subcontractor, or member of a joint venture. The PPQ respondent must have been a client, or client representative, with whom the Offeror/subcontractor had a contract, or subcontract (if applicable) for one or more projects.
The PPQ respondent must hold, or have held at the time, a senior position in the client organization with responsibilities for either contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror’s performance in executing the contract or subcontract. The PPQ respondent must have first-hand knowledge of the Offeror’s performance.
In addition to the above, past performance information may be obtained from established systems such as the Contractor Performance Assessment Reporting System (CPARS), Federal
Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract
Reporting System (eSRS), or other databases; and may be obtained from other sources available to the Government, such as the Defense Contract Management Agency; and interviews with
Program Managers, Contracting Officers, and Fee Determining Officials.
The Government reserves the right to evaluate the past performance of any subcontractor identified in the Offeror’s proposal as part of its assessment of the acceptability of that Offeror’s proposal.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
The Government will evaluate the Past Performance factor on an Acceptable/Unacceptable basis based on the descriptions outlined in Table C-4. Offerors who are determined “Unacceptable” will not be eligible for award.
Table C-4. Past Performance Evaluation Ratings
ACCEPTABLE Offerors whose past performance information demonstrates all of the elements being rated at satisfactory or above, or whose performance record is unknown (see note below), will be rated Acceptable for Past Performance.
UNACCEPTABLE Offerors whose past performance information demonstrates any of the element being rated as marginal or lower will be rated Unacceptable for Past Performance.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”

SAM (see paragraph (c)(3) of this provision).
(2) The DLA Commercial and Government Entity (CAGE) Branch. If registration in SAM is not required for the subject procurement, and the Offeror does not otherwise register in SAM, an Offeror located in the United States or its outlying areas may request that a CAGE code be assigned by submitting a request at https://cage.dla.mil.
(3) The appropriate country codification bureau. Entities located outside the United States and its outlying areas may obtain an NCAGE code by contacting the Codification Bureau in the foreign entity's country if that country is a member of NATO or a sponsored nation. 52.204-22 ALTERNATIVE LINE ITEM PROPOSAL (JAN 2017)
(a) The Government recognizes that the line items established in this solicitation may not conform to the Offeror's practices. Failure to correct these issues can result in difficulties in acceptance of deliverables and processing payments. Therefore, the Offeror is invited to propose alternative line items for which bids, proposals, or quotes are requested in this solicitation to ensure that the resulting contract is economically and administratively http://www.sam.gov/ https://cage.dla.mil/ https://eportal.nspa.nato.int/AC135Public/scage/CageList.aspx http://www.nato.int/structur/AC/135/main/links/contacts.htm https://cage.dla.mil/ advantageous to the Government and the Offeror.
(b) The Offeror may submit one or more additional proposals with alternative line items, provided that alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation. However, acceptance of an alternative proposal is a unilateral decision made solely at the discretion of the Government. Offers that do not comply with the line items specified in this solicitation may be determined to be nonresponsive or unacceptable.

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.

“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.
“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include
Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.
(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).
(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.
Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.
(2) The first page of the proposal must show--

Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.
(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(3) It is the only proposal received.
(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal
Government processes resume.
(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at
