PERFORMANCE WORK STATEMENT
WASTEWATER TREATMENT SERVICE
LAKE SHELBYVILLE PROJECT
BLANKET PURCHASE AGREEMENT
DESCRIPTION/SPECIFICATIONS/ PERFORMANCE WORK STATEMENT
1. GENERAL
1.1. Scope. This agreement is to provide wastewater services to Lake Shelbyville Project Office. The contractor shall furnish all labor, equipment and material necessary to inspect, operate, perform prescribed maintenance and make minor adjustments to existing wastewater treatment lagoons, spray fields, lift stations, pumps, floats, valves, and electrical panels including components, if and when requested by the contracting officer (or the authorized representative of the contracting officer. All work shall be performed in accordance with the contract and government provided schedule, and to the satisfaction of the Contracting Officer.
1.2. Blanket Purchase Agreement. A Blanket Purchase Agreement, or BPA, is a simplified method of filling anticipated repetitive needs for supplies or services with qualified sources. BPAs are designed to reduce administrative costs in accomplishing small purchases by eliminating the need for issuing individual purchase documents. In other words, the Government uses BPAs when we know we will need a basic requirement over and over but can't say for sure when or how many of the items will be required.
1.2.1. Withdrawal of Agreement. A BPA is an agreement between the government and a contractor which sets the stage for the government to buy something quickly. BPAs are agreements, not contracts. Either side may opt out of the BPA at any time by giving at least a 30-day notice in writing. All of the conditions of sale are negotiated when the BPA Call is made.
1.2.2. BPA Calls. BPA Calls are made when it is determined a service or supply is required. The Contracting Officer will place the call to the contractor to request pricing for delivery of those items.
1.2.3. Extent of Obligation. The Government is obligated only to the extent of authorized calls actually placed against this Blanket Purchase Agreement (BPA) and shall not be liable in any manner in the event no calls are made. This agreement may be cancelled if either parties fails to agree upon any deletion, amendment or addition to this agreement which is required by statute, Executive Order, the FAR, and/or this Supplement No. Deletion, modification, addition to, or cancellation of this agreement shall affect any contracts therefore entered into between the parties in which this agreement or portion thereof has been incorporated by reference. This agreement shall be reviewed, at a minimum, annually before the anniversary of its effective date, and revised to conform to all requirements of statutes, Executive Orders, or the FAR and the Supplements. This revision shall be evidenced by the agreement modifying the BPA or by the issuance of a superseding BPA. The issuance of individual calls under this BPA will be made under the authority of FAR 13.303 Blanket Purchase Agreement.
1.2.4. Purchase Limitation. The dollar limit for each Call shall not exceed $55,000. The dollar limit for the entire term of this BPA shall be $300,000.
1.2.5. Authorized Purchasers. Only the authorized purchasers as described in this paragraph can purchase under this BPA. Only a Purchasing Agent and/or a Contract Specialist from the U.S. Army Corp of Engineers – St. Louis District, Contracting Office is authorized to make purchases against the Blanket Purchase Agreement.
1.3. Contracting Officer. The term "Contracting Officer" means the person executing this contract on behalf of the Government, and any other officer or civilian employee who is properly designated Contracting Officer; and the term includes, except as otherwise provided in this Contract, the authorized Representative of a Contracting Officer (COR) acting within the limits of their authority.
1.4. Safety. All work shall be performed in accordance with safety requirements set forth in the Corps of Engineers Manual, EM 385-1-1, entitled “Safety and Health Requirement Manual”, 30 November 2014. An electronic copy can be obtained online. The Contractor shall be responsible for complying with the current edition and all changes posted on the web. All equipment and materials will be inspected by the Government. The COR will notify the Contractor of any noncompliance with these provisions. The Contractor shall, after receipt of such notice, immediately take corrective action.
Such notice, when delivered to the Contractor, shall be deemed sufficient for the purpose. If the Contractor fails or refuses to comply promptly, the COR may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop orders shall be made the subject of claim for extension of time or for excess costs or damages by the Contractor. Compliance with the provisions of this clause by subcontractors will be the responsibility of the Contractor.
1.5. Work Schedule
1.5.1 Effective Period. The effective period of this agreement is from Time of Award until– 28 February 2027, unless sooner withdrawn in writing by the Contracting Officer. Base Period will be from Time of Award until 28 February 2023;
Ordering Period 2 will be from 1 March 2023 until 28 February 2024; Ordering Period 3 will be from 1 March 2024 until 28 February 2025; Ordering Period 4 will be from 1 March 2025 until 28 February 2026; Ordering Period 5 will be from 1 March 2026 until 28 February 2027.

Purpose: This Quality Assurance Surveillance Plan (QASP) is a Government developed and applied document used to make sure that systematic quality assurance methods are used in the administration of the Performance Based Service Contract (PBSC) standards included in this contract. The intent is to ensure that the contractor performs in accordance with performance metrics set forth in the contract documents, that the Government receives the quality of services called for in the contract, and that the Government only pays for the acceptable level of services received.
1. Critical performance processes and requirements. Critical to the performance of the contract, the contractor shall provide all personnel equipment, tools, materials, supervision, transportation, other items and services necessary to perform as defined in this Performance Work Statement (PWS). The contractor shall provide accurate transaction processing to ensure that material accountability comply with safety and security requirements, in accordance with this PWS. Additionally, the contractor shall be accountable for all auditable documents, establish/maintain effective quality, and perform required within prescribed timeframes. The performance process is the timely, accurate, and thorough completion of all contract requirements.
2. Performance Standards
a. Schedule. The dates for services and the actual accomplishment of the services in accordance with the schedule will be assessed against original dates of services and milestones established for the contract.
b. Service. The services required to be performed will be assessed against the PWS detailed in the contract, for the required content, quality, timeliness, and accuracy.
c. Past Performance. In addition to schedule and services, and cost aspects of performance discussed above, pursuant to FAR 42.15, the Government will assess the contractor’s record of conforming to contract requirements and to standards of good workmanship, the contractor’s adherence to contract schedules including the administrative aspects of performance, the contractor’s history of reasonable and cooperative behavior and commitment to customer satisfaction, and the contractor’s business-like concern for the interest of the customer.
3. Surveillance methods. The primary methods of surveillance used to monitor performance of this contract will include, but not be limited to: random or planned sampling, periodic inspection, Contractor Self Reporting, and validated customer complaints.
a. Random/Scheduled Monitoring. Random and/or scheduled monitoring will be conducted if and when deemed necessary by the COR to ensure compliance with the terms of the contract. Using the attached matrix the COR will determine whether the contractor is in compliance with the terms of the contract.
b. Contractor Self-Reporting. The contractor shall provide as needed status reports that document significant problems/issues and potential resolutions.
c. Customer Feedback. Customer feedback will be obtained from valid customer complaints.
Customer complaints, to be considered valid, must set forth clearly and in writing the detailed nature of the complaint; must be signed and must be forwarded to the COR by the contractor. The contractor shall maintain a log of all customer complaints as well as a copy of each complaint in a documentation file. The COR may request to review the log and/or documentation file at any time.
