8. Performance Requirement Summary (PRS).

8.1. PRS Table Explanation. The following PRS table identifies the performance objectives considered essential for the contracted services to be performed in a satisfactory manner. It is the Contractor’s responsibility to establish an effective quality control system to ensure all performance standards identified below are met or exceeded. Any performance objective, evaluated by the Government COR and determined outside the acceptable quality level will be considered as an unsatisfactory performance for inspection purposes, even if re-performed at a later date. Any performance objectives below the acceptable quality level identified for the surveillance period will be documented as unsatisfactory performance.

8.2. Inspection Rating Procedures. When performance is determined acceptable, the Dorm Manager/COR will document the acceptable performance on the inspection form. When performance is determined unacceptable, the Dorm Manager/COR will inform the Contractor’s on-site representative that performance is unacceptable, state the reasons why, and request re-performance of services, if appropriate. The COR will document the unacceptable performance, reasons why and requested re-performance completion date. The COR will request the contract manager initial the surveillance form. If the Contractor wants to dispute the results of the surveillance, the COR must refer them to the Contracting Officer for resolution of the matter. If there is a joint use area with multiple rooms attached (i.e, kitchen/bathroom), the contractors will not clean the common area, just the individual room that is vacant. If all rooms attached to joint use areas are vacant, the contractors will be responsible for the joint use area.

8.3. Unacceptable Performance. When re-performance is determined unacceptable or has not been completed in accordance with the performance work statement, the COR/Dorm Manager will inform the Contractor’s on-site representative that performance is still unacceptable, state reasons why, and request their initials and date on the surveillance form. If the Contractor wants to dispute the results of the surveillance, the Dorm Manager must refer them to the contracting officer for resolution of the matter.

8.3.1. The COR will notify the Contracting Officer of unacceptable performance. If re-performance is not practical, or if serious unacceptable performance trends develop with the Contractors’ performance, the following actions may be taken:

8.3.2. Contract Discrepancy Report (CDR) - a CDR shall be issued when unacceptable performance does not exceed the performance standard minimums, as identified in the Performance Requirement Summary below. A CDR shall also be issued in the event of non-performance, after notification to perform, or when re-performance, (due to an unsatisfactory inspection rating), has not been accomplished within the terms of the performance work statement.

8.4. Performance Assessment.

8.4.1. Random Sampling and periodic Validation. This method requires the COR/QAP to employ a “spot check” style of evaluation based on the Contractor’s schedule and a random sampling of performance per requirement. Periodic validation will be conducted on a scheduled basis and may be adjusted, based on quality trends. Any unsatisfactory inspection (defect) result shall be recorded, and the Contractor shall re-perform the service after notification by the KO or COR. Exceeding the performance threshold of these performance objectives for any two, or more consecutive or non-consecutive months during a contract period may constitute an immediate Progress Meeting with the Multi-functional Team. All remedies shall be in accordance with the FAR 52.212-4(a). Contract Terms and Condition – Commercial Items. Inspection/Acceptance.

8.4.2. Customer Complaints. The COR will receive and investigate complaints. The COR will be certify and validate customer complaints. The COR will make final determination of the validity of customer complaint(s) in case of disagreement with the Contractor. Validated customer complaints shall be re-performed after notification by the COR. Failing to meet the performance threshold for performance objective in any one month period may result in a warning or letter of concern from the KO. Failing to meet the performance threshold for performance objective for any two, or more consecutive or non-consecutive months during a contract period may constitute an immediate Progress Meeting with the Multi-functional Team. All remedies shall be in accordance with the FAR 52-212-4 (a), Contract Terms and Conditions – Commercial Items, Inspection/Acceptance.

8.4.3. Periodic Progress Meeting. The KO, COR, other government personnel as appropriate, and the Contractor shall periodically meet to discuss the Contractor’s performance. The following issues should be discussed: opportunities to improve the contract, any modifications required of the contract, unsatisfactory inspections and valid customer complaints against each performance objective observed and steps taken by the Contractor to prevent occurrence in the future. The Contractor shall provide a summation of unsatisfactory inspection and customer complaints and provide insight into any identified trends. Contracting will put the minute in writing, signed by the KO and any other signatures as deemed appropriate, distribute to the functional area and the Contractor and a copy placed in the official contract file. Should the Contractor not concur with the minutes, the contractor shall provide a written notification to the COR identifying areas of non-concurrence for resolution.
